Guidelines – Parentage Testing Service

The following are the procedural Guidelines which apply to the provision of

ParentageTesting Services.

  1. The Laboratory shall submit to Legal Aid Queensland (“LAQ”) a list of the names of the collection centres it proposes using throughout Australia, including locations in remote and isolated areas.
  1. LAQ shall provide to the Laboratory a list of LAQ agents which is to be referred to in all dealings to signify request for testing under the tender agreement.
  1. LAQ Lawyer or LAQ agent shall contact the Laboratory by facsimile transmission to advise the location of all donors. Use Parentage Testing Request Form.
  1. The Laboratory shall arrange delivery of sample collection kits (including Form 4) to the relevant collection centre for the male donor and within 48 hours of the initial contact shall advise LAQ lawyer or LAQ agent by facsimile transmission a two week period in which the donor is to provide a test sample.
  1. Upon receipt of this advice (paragraph 4 above), LAQ lawyer or LAQ agent shall by letter advise the male donor of the following:

where sample collection is to take place

the telephone number of the collection centre

to contact the collection centre to make an appointment for sample collection in the nominated two week period

and provide him with a Form 2 (donor affidavit).

  1. Within twenty-four (24) hours of the receipt of the male donor valid bodily sample by the Laboratory, the Laboratory shall notify LAQ lawyer or LAQ agent by facsimile transmission and arrange delivery of sample collection kits (including Form 4) to the relevant collection centre for the mother and child/ren.
  1. Within 72 hours of the receipt of a test sample from the male donor, the Laboratory shall advise LAQ lawyer or LAQ agent by facsimile transmission of the two week period in which the mother and child/ren are to provide test samples.
  1. Upon receipt of this advice, LAQ lawyer or LAQ agent shall by letter, notify the mother of the following:

where sample collection is to take place

telephone number of the collection centre

to contact the collection centre to make an appointment for sample collection for herself and child/ren in the nominated two week period

and provide her with a Form 2 (for each child if more than one child).

  1. Within twenty-four (24) hours of receipt of the bodily samples of the mother and the child/children by the Laboratory. The Laboratory shall notify LAQ lawyer or LAQ agent by facsimile transmission.
  1. The sample collection centres shall ensure that the relevant parties complete and execute Forms 2 and 4 in accordance with Reg 21F and 21J of the Regulations.
  1. The Laboratory shall notify LAQ lawyer or LAQ agent by facsimile transmission within three (3) days of any appointment if any of the bodily samples are not received within the time limits referred to in Reg 21L of the Regulations or if forms/photos do not comply with Reg 21F and 21J.
  1. Testing by the Laboratory shall commence only where valid bodily samples are received within the time-frames referred to in Reg 21L of the Regulations.
  1. If a donor fails to provide a bodily sample in the nominated two week period, the Sampler shall immediately notify the Laboratory of the non-attendance of that party and the Laboratory shall notify LAQ lawyer or LAQ agent by facsimile transmission within twenty-four (24) hours of the non-attendance.
  1. The guidelines are subject to change by LAQ from time to time in the interests of providing an efficient service and/or complying with amendments to the Family Law Act and Regulations and will be notified to the Laboratory in writing.
