Providing of Defence standardization in the Ministry of Defence competence

For realisation of the law No.309/2000Coll., on Defence standardization, codification and government quality assurance of the products and services appointed to provide defence of the State and Change of trade law, in amended wording, (hereafter “law”), and in conjunction with the Appendix to theCzech Republic Government resolution No. 1194, dated Nov. 27, 2000 on Review procedure rules to NATO standardization agreement ratification proposal and method of comments’ settlement (hereafter “resolution”), I hereby set down:

1.General regulations

1.The main tasks of defence standardization[1)] (hereafter “standardization”) are as follows:

a) to provideratification process of NATO standardization agreements (hereafter “STANAGs”);

b) to implement STANAGs, which means incorporation of the STANAG contents requirements into the legal regulations of the Czech Republic, Czech technical standards (hereafter “ČSN”), Czech Defence Standards (hereafter “Standards”, “ČOS”) and MoD internal and military regulations;

c) to provide Standards production.

2.According to the contents, standardisation is dividend to operational, materiel and administrative standardisation.

3.Operational standardisationincludesstandardisation agreements and standards, containing concepts, doctrines, operational, tactical and technical procedures, requirements to logistical support, training, organisational structure, reports, forms, maps and schemas, regarding activities of armed forces and influencing current or future principles, forms and methods of its activity.

4. Materiel standardisationincludes standardisation agreements and standards, containing requirements to current and future military technique, including communication systems and devices for data processing and transmission, to production of special technique, to different types of the materiel and to support armaments life cycle.

5.Administrativestandardisationincludes standardisation agreements and standards, containing requirements to administrative and managing activities, including financing, education, personnel and social policy, to environmental protection and terminology.

6. Standardisationis further dividend to Standardisation groups and classes, which are determined by the Defence standardisation, codification and government quality assurance authority (hereafter “Authority”).

7. Registration, reception, storage and distribution of STANAGs, Standards and other standardization documents maintains Authority at Defence standardisation registry according to specific internal regulation.

2. Responsibility for standardisation management

8. The Authoritydirectoris responsible for management of standardisation process withinMinistry of Defence (hereafter MoD)competence.

9. Following MoD top managers are responsible for management and realisation of standardisation within theircompetence:

a) Chief of the General staff of the Czech armed forces for:

- administrative standardization of the groups of Environmental protection and Operational terminology;

- materiel standardization of the groups of Petroleum products andGeneral protection against weapons of mass destruction;

- all operational standardisation groups except forthe groups mentioned inparagraphs b), c) andd) of this article;

b) Deputy MoDfor management of inspection and supervision division for operational standardization of Flight safety group;

c) Military Intelligence director foroperational standardization of Military intelligence group;

d) Chief of Military police for operational standardization of Military police group;

e) Deputy MoD formanagement of armaments and acquisitionsdivision for all materiel standardization groups except forthe groups mentioned inparagraph a) andfor administrative standardisation of the groups Planning and projects, Research anddefence technologies andLife cycle management;

f) MoD State secretaryfor administrative standardisation of Human resources group;

g) Deputy MoD formanagement of economy and property division for administrative standardization of Financing and budgeting group;

h) The Authority director for administrative standardisation of the groups Terminology, Codification and Government quality assurance.

10.MoD top managers, whose are responsible for management and realisation of standardisation, nominate Standardization group custodians within their competence and announce this information to the Authority. The Standardization group custodians precede similarly regarding to nomination of Standardization class custodians. The Standardization group custodian can nominateStandardization class custodian out of his direct subordination only with previous approval of the superior of the nominee. The Authority maintains up-to-dateoverview of Standardization group and class custodians.

3. Standardisation planning and financing

12.Requirements for standardisation in MoD competence are maintained at the Defence standardisation plan, which is composed particularly from:

a) STANAGs determined for ratification and implementation;

b) STANAGs determined for translation;

c) Standards determined for development and revision;

d) STANAGs determined for revision of ratification response.

STANAGs and Standards with relation to the Capabilitygoals are prioritized in the Defence standardisation plan.

12a.Standardisation class custodian can propose following STANAG ratification responses:

a)„Ratifying and implementing“, if it should be implemented in full extent;

b)„Ratifying and implementing, with reservations“, if it should be implemented only partially;

c)„Ratifying, future implementation“, if it should be implemented fully, but at presentit is not possible to set the implementation date;

d)„Ratifying, future implementation, with reservations“, if it should be implemented only partially, and at present it is not possible to set the implementation date;

e)„Not ratifying“, if he disagrees with STANAG contents;

f)„Not participating“, if MoD does not take part at the STANAG related activities.

12b.All of STANAG ratification responses according previous article, letters b) to f) have to be justified in the form of comments and/or reservations in the relevant part of ratification proposal.

13.The Authorityreleases and continually maintains the Defence standardisation plan for the current year with overview to following years.Sources for Defence standardisationplan are standardisation documents received fromNATO, requirements and proposals submitted byStandardizationgroup custodians and STANAGs related to the Capability goals. Defence standardisation plan is approved by Authority director.

14.The Authority director is responsible for planning of the finance resources necessary for fulfilment of the tasks related to STANAG ratification and development of Standards. Standardization group custodians submitnecessary information for budget proposal to the Authority director according his requests.

15. The relevant Standardizationgroup custodian is responsible for planning of financial resources, necessary for fulfilment of the tasks, related to STANAG implementation, change or cancellation or toStandard publishing and submits it toproposals of MoD mid-term plan of activities and development and MoD chapter of the State budget.

4. Maintenance of STANAGs and Standards

16. The Authority distributes STANAGs, Standards and other necessary standardization documents to the Standardizationgroup custodians according to its contents. Standardization group custodians assign them to relevant Standardizationclass custodians. The Authority maintains up-to-date overview of Assignment of STANAGs and Standards to Standardization group and class custodians(Responsibility matrix).

16a.If the STANAG ratification response of already promulgated STANAG was different from „Ratifying and implementing” or „ Not participating“,the relevant Standardization group custodian has to revise chosen ratification responseevery 5 years from the first choice.If the revision concludes to the need of change the ratification response, Standardization class custodian submits change proposal to the Authority through Standardization group custodian. During realisation of the changes articles 18 to 24 of this order apply.

16b.Standards custodians, nominated by Authority director, have to revise the Standard every 3years. If the revision concludes to the need of change the Standard contents or Standard cancellation, submits relevant proposal to the Authority.During realisation articles 25 to 31 of this order apply.

16c.Standards custodians submitRevision results to the Authority through Standardization group custodianin written form by 6 month from planned revision terms.

17.The Authority director announces information about publishing, change and cancellation of STANAGs and Standards in the MoD competence and about implementation of STANAGs at the MoD Bulletin.

5. STANAG ratification

18. Standardisation class custodian provide a STANAG analysis in given term, elaborates draft version of STANAG ratification proposal according to Appendix 1 of this Order and submits both documents through Standardization group custodian for MoD internal review to relevant MoD organisational bodies, whose competencethe STANAG falls (hereafterReviewer). InevitableReviewer to STANAG ratification proposal from area of materiel standardization is Property custodian.

19.The Reviewer states in his position on the STANAG analysis and draft version of STANAG ratification proposal, if he agrees with proposed ratification response to the STANAG or if he has any comments to this proposal, or if he proposes different solution.

20.If the Reviewers’ positions onthe analysis and draft version ofproposal are affirmative, the Standardization class custodian elaborates final version of the proposal and submits it to the Authority through Standardization group custodian for development of STANAG ratification responseof the Czech Republic.

21.If the Reviewers’ positions are different, Standardization class custodian discusses them with Reviewers at common meeting. If the consensus regarding to the Reviewers’ positions is not reached, the Standardization class custodian submits the draft version of STANAG ratification proposal together with discrepant positions on theStandardization group custodian for discussion with the Authority.

22.Based on the Authority director decision, the Standardization class custodian elaborates final version of the proposal and submits it to the Authority through Standardization group custodian for development of STANAGratification responseof the Czech Republic.

22a.The Authority sends a copy of final version of STANAG ratification proposal to MoD legal division for information.

23.If the STANAG exceeds MoD competence, the Standardization class custodian elaborates draft version of STANAG ratification proposal and submits it to the Authority through Standardization group custodian for providing review by external authorities and comments’ settlement according to the Resolution of the Government. MoD internal review, including comments’ settlement to this proposal is provided by the Standardization class custodian according to this Order.

23a.If it is not possible to fulfil given term for the national ratification response from the objective reasons, the Standardization class custodian requests its prolongation. Properly justified request for prolongation of the term he submits to the Authority through Standardization group custodian for sending information to the relevant NATO body.

24. After fulfilment of the tasks, related to STANAG implementation, the Standardization class custodian elaborates STANAG implementation report in accordance with Appendix 2. If the STANAG is implemented exclusively by Military order, he submits STANAG implementation report to the Inspectorate of General Staff for obtaining position; in other cases he submits it to MoD legal division for obtaining position. This finalised STANAG implementation report he further submits to the Authority through Standardization group custodian for providing the tasks according to §3 art.2 of the Law.

24a.If it is not possible to fulfil planned (expected) term for STANAG implementation, the Standardization class custodian without any delay elaborates a new STANAG ratification proposal with properly justified new term of expected implementation and submits it to the Authority through Standardization group custodian.

6. Standard development

25.The heads of organizational bodies of the MoD submit the Standard development proposal according to Appendix 3 of this Orderthrough Standardization group custodian. The proposal includes subject and scope of proposed Standard, justification of the need for Standard development and its effective date.

26.If the Authority does not agree with submitted Standard development proposal, sends its decision to the proposer.

27.If the Authority director agrees with submitted Standard development proposal, includes it in the Defence standardization plan and determines aprocessor of a Standard proposal, who can be head of organizational body of the MoD, Standardization group custodian or Standardization class custodian.

28.The processordiscusses the Standard proposal at the MoD internal review procedure. The processor sends the Standard proposal for obtaining of position to the Authority, to relevant Standardization group custodian, Standardization class custodian, Property custodian, to proposer of the Standard development and eventually to another MoD body determined by Authority director.

29.If during MoD internal review procedure there are any comments on the Standard proposal, the processor discusses them with the bodies which raised them. If the consensus is not reached after the discussion, the processor submits to Authority the Standard proposal with discrepant positions and proposal for the solution.

30.The Authority director decides about final wording of Standard proposal at MoD competence after discussion with Standardization group custodian. The processor then modifies Standard proposal according to the decision of Authority director.

31.After announcement of the Standard proposal in the Bulletin of the Czech Office for standards, metrology and testing, the processor continues during further discussion on the Standard proposal according to §7art. 1to 4of the Law.

7. Representation at NATO tasking authorities and working groups

32.The MoD top managers, whose are responsible for management and realisation of standardisation, nominate their representatives to standardization boards and working groups for support of standardization tasks in NATO. The nominated representatives have to meet qualification, security and language proficiency requirements.

33.Relevant MoD top managers inform the Authority director about their nominations of representatives. When these representatives receive a STANAG, related NATO standardization document or translation of it, they submit it to the Defence standardization registry for registration up to 14 days after receiving it.

8. Standardisation in the area of terminology

34.The Terminology committee is established to review terminology issues. Its main task is to review Czech terminology in dependence on progressing changes of NATO terminology.

35.The chairman and members of Terminology committee are nominated by Authority director on the base of proposal of MoD top managers, whose are responsible for management and realisation of standardisation. MoD Legal division have also a member, nominated by its Organisation management department director.

36.The Terminology committee fulfil following important tasks:

a) It reviews proposal of MoD terminology programme;

b) It discusses NATO terminology changes and their adoption to Czech military terminology;

c) It reviews specialized terminology dictionaries and translations of standardization documents from the perspective of NATO terminology adherence in conjunction with specialized terminology and standard of Czech language.

9.Documentation extent, maintained by the Authority and Stand. groups and classes custodians

37.The Authority registers and stores at the Defence standardization registry following originals of standardization documents:

a) STANAG ratification proposals;

b) Revisions of STANAG ratification responses;

c) Related translations, analysis or specialist positions on standardization documents, developed on the base of contract;

d) Positions on STANAG ratification proposals from external review procedure;

e) CZE ratification responses to STANAG;

f) STANAG implementation reports of the relevant bodies;

g) CZE STANAG implementation reports

h) Standard development proposals, protocols about Standard approval and revision,prints of valid Standard editions.

38.Standardization group custodians are responsible for registration and storage of following originals of standardization documents:

a) STANAG ratification proposals, related analysis or specialist positions on standardization documents;

b) Positions on STANAG ratification proposals from MoD internal review procedures;

c) MoD STANAG implementation reports;

d) Standard development proposals;

e) Data for update of Defence standardization plan.

I oblige hereby MoD top managers subordinated to Minister of Defenceto ensure in their competences realisation of the tasks and principles which I set in this Order.

This Order enters in the force by the day of its announcement in the MoD Bulletin and cancels validity of previous MoD Order No. 18/2003MoD Bulletin.
