Brewer Application Form

Under the LCBO’s Ontario Small Brewer Distribution policy, a SmallOntario Brewer[1] may be authorized to warehouse and deliver beerfor other Small Ontario Brewers directly to LCBO stores, licensees and grocery stores that are authorized or licensed to sell beer.

A brewer who qualifies as a Small Ontario Brewer at any time will continue to be considered a Small Ontario Brewer under the Ontario Small Brewer Distribution policy for the remainder of the initial ten year term of the Master Framework Agreement between Brewers Retail Inc., Labatt Brewing Company Ltd., Molson Canada 2005, Sleeman Breweries Ltd. and Her Majesty the Queen in Right of Ontario, unless it becomes an affiliate of a brewer that is not a Small Ontario Brewer.

An application by a Small Ontario Brewerto be authorized under this policy should be made to the LCBO on this form (and include copies of required documentation) and be directed to:

Confirmation of Eligibility

    and understand the terms and conditions set out in the policy entitled “Ontario Small
    Brewer Distribution”.
  • I confirm that the Applicant produced* less than 150,000 hectolitres of beer in the fiscal year
    ending March 31, 2015 (or the most recent full fiscal year if the Applicant was not a licensed
    brewer in 2014-15).

    of Ontario.

[1] A “Small Ontario Brewer” means a brewer in Ontario (i) that holds a valid manufacturer’s licence issued by the Registrar of Alcohol and Gaming, (ii) whose annual worldwide production was less than 150,000 hectolitres of beer in the fiscal year ending March 31, 2015 (or the most recent full fiscal year if the Applicant was not a licensed brewer in 2014-15), and (iii) who is not an affiliate of any brewer that does not meet the criteria described in (i) and (ii).

The following must be included in determining the amount of a brewer’s worldwide production of beer for a particular fiscal year:

1. All beer manufactured during the fiscal year by the brewer, including beer that is manufactured under contract for another beer manufacturer.

2. All beer manufactured during the fiscal year by an affiliate of the brewer, including beer manufactured by the affiliate under contract for another beer manufacturer.

3. All beer manufactured during the fiscal year by another brewer under contract for the brewer or for an affiliate of the brewer.
