PROCEEDINGS OF THE HAMILTON COUNTY BOARD OF SUPERVISORS

REGULAR MEETING

The Hamilton County Board of Supervisors met in regular session on Tuesday, August 27, 2013 at 9:00 A.M. in the Boardroom of the Hamilton County Courthouse, Webster City, Iowa.

CALL TO ORDER: Called to order by Chair Pro-tem Wesley Sweedler.

PLEDGE OF ALLEGIANCE: The Board led the Pledge of Allegiance.

MEMBERS PRESENT: David Young and Wesley Sweedler. Doug Bailey arrived at 9:05 a.m.

OTHERS PRESENT: Anne Blankenship, Dan Waid, John C. Koop, Joseph Koop, John Everly, Gerald Peterson, Shelly Lumsden, Jane Adams, Mickie Shubin, DeWayne Berg, Darrel Hay, and Kim Schaa. Pat Powers arrived at 9:42 a.m.

AGENDA: Motion by Young, seconded by Sweedler to approve the agenda. Motion carried.

MINUTES: Motion by Sweedler, seconded by Young to approve the minutes of the August 13, 2013 meeting. Motion carried.

CLAIMS: General Basic Fund $147,731.19; General Basic (Public Health) Fund $29,722.12; General Basic (Conservation) Fund $30,525.59; General Supplemental Fund

$18,799.40; General Supplemental Public Health Sub Fund $2,007.05; General

Supplemental Conservation Sub Fund $1,598.86; MH-DD Services Fund $36,888.68; Rural Basic Fund $59,060.00; Secondary Roads Fund $107,439.02; Capital Projects Fund $34,105.87; Total $467,877.78. Drainage Fund $1,997.18. Motion by Young, seconded by Sweedler to approve payment of claims. Motion carried.

PROCLAMATION: Shelly Lumsden and Jane Adams from Community and Family Resources presented a proclamation to the Board proclaiming September 2013 as Addiction Recovery Month in Hamilton County.

APPLICATIONS: HOMESTEAD TAX CREDIT & MILITARY EXEMPTIONS FOR 2013: Motion by Sweedler, seconded by Young to approve all properly signed applications with the exception of: Larry L. Davis – no discharge recorded in Hamilton County.

Motion carried.

PERSONNEL ACTION: SHERIFF: Motion by Sweedler seconded by Young to approve the hiring of Lanna Rusher as a temporary part- time employee effective August 19, 2013 at a rate of $13.00 per hour. Motion carried.

CONTRACTS/AGREEMENTS: PROFESSIONAL SERVICES AGREEMENT FOR JEWELL TO ELLSWORTH TRAIL:

Motion by Young, seconded by Sweedler to approve the Federal Aid Professional Services Agreement for Drainage District #71. Motion carried.

APPOINTMENTS: MIDAS AND MID IOWA GROWTH PARTNERSHIP: Motion by Young, seconded

by Sweedler to appoint Sarah Thompson to replace Catherine Bergman on these two boards. Motion carried.

PUBLIC HEARING ON G.O. LOAN AGREEMENT NOT TO EXCEED $1,350,000:

OPEN HEARING: Chairman Bailey opened the public hearing on proposal to enter into a General Obligation Highway Improvement Loan Agreement and borrow money in a principal amount not to exceed $1,350,000.

PROOF OF PUBLICATION: Proof of publication of the hearing notice was on file.

PRESENTATION: The Board gave a brief explanation of the proposal.

PUBLIC SUPPORT OR OPPOSITION: None.

CLOSE HEARING: Chairman Bailey closed the Public Hearing.

RESOLUTION *2013-34 RESOLUTION 2013-34 TAKING ADDITIONAL ACTION TO ENTER INTO A LOAN

AGREEMENT AND AUTHORIZING THE USE OF PRELIMINARY OFFICIAL STATEMENT IN CONNECTION THEREWITH: Motion by Sweedler, seconded by Young to approve said resolution. Roll call vote: Sweedler, Young, and Bailey voting aye. Motion carried.

PUBLIC HEARINGS:

BERG FARMS, INC. – HENKE FARM LP SITE CONSTRUCTION PERMIT:

OPEN HEARING: Chairman Bailey opened the public hearing on the Construction Permit application for Berg Farms, Inc. – Henke Farm LP Site.

PROOF OF PUBLICATION: Proof of publication of the hearing notice was on file.

PRESENTATION: The Board gave a brief explanation of the project which is the construction of one new 2480 head deep pit swine finisher barns at an existing site. The site meets or exceeds the Master Matrix minimum score.

PUBLIC SUPPORT OR OPPOSITION: None.

CLOSE HEARING: Chairman Bailey closed the public hearing.

BOARD ACTION: Motion by Young, seconded by Sweedler to approve this construction permit.

Motion carried.

OPEN HEARING: Chairman Bailey opened the public hearing on the Construction Permit application for John JG Koop –Koop South Site.

PROOF OF PUBLICATION: Proof of publication of the hearing notice was on file.

PRESENTATION: The Board gave a brief explanation of the project which is the construction of two new 2200 head shallow pit swine finisher barns with slurry store for a new swine confinement facility. The site meets or exceeds the Master Matrix minimum score.

PUBLIC SUPPORT OR OPPOSITION: None.

CLOSE HEARING: Chairman Bailey closed the public hearing.

BOARD ACTION: Motion by Sweedler, seconded by Young to approve this construction permit.

JOHN C & CARRIE & JOSEPH KOOP – KOOP NORTH SITE:

OPEN HEARING: Chairman Bailey opened the public hearing on the Construction Permit application for John C. & Carrie & Joseph Koop –Koop North Site.

PROOF OF PUBLICATION: Proof of publication of the hearing notice was on file.

PUBLIC HEARING ON ROAD VACATION – ESTES AVENUE:

OPEN HEARING: Chairman Bailey opened the public hearing on proposal to vacate a portion of Estes Avenue.

PROOF OF PUBLICATION: Proof of publication of the hearing notice was on file.

PRESENTATION: Dan Waid, Hamilton County Engineer gave an explanation of the proposed vacation.

PUBLIC SUPPORT OR OPPOSITION: Waid read portions of two letters concerning the

project. The first letter was from CCP Railroad concerning the vacation near the railroad

crossing. The second letter from Century Link was in regards to the utility lines in the

right-of-way. Engineer Waid will address the concerns with both entities.

CLOSE HEARING: Chairman Bailey closed the Public Hearing.

ADJOURN: Motion by Sweedler, seconded by Young to adjourn. Motion carried, meeting adjourned at 9:50 A.M.
