BYLAWS OF THE BOARD: FORMULATION OF BOARD POLICIES ANDADMINISTRATIVE REGULATIONS - ADMINISTRATIVE REGULATIONS

Under the laws of the State of California, all authority for the control of schools is vested in the Board of Trustees operating as an official body in duly constituted sessions. The Board of Trustees consider their responsibilities to be the development of policy, recognizing the development of administrative regulation growing out of the policy is the responsibility of the District Superintendent and his staff.

Policies are statements of general principles by which the District is governed. They should be broad enough to indicate a line of action to be taken by the administration in meeting day-to-day problems; they should be specific enough to give the administration clear guidance.

I. Procedural Steps in Policy Development

A.Initial Proposal: Proposed policies, revisions and ideas for policies are to be documented in writing and forwarded to the Superintendent who will be responsible for the execution of the policy upon adoption by the Board.

1.The administrative head shall be responsible for reviewing the initial proposal and for executing all subsequent steps in policy development as outlined in these regulations.

2.Areas of responsibility for policy development are as follows:

District Superintendent

Section 1000 - Community Relations

Section 2000 - Administration

Section 9000 - Board Operation

Assistant Superintendent-Business Services

Section 3000 - Business Services

Section 7000 - Construction

Assistant Superintendent and Senior Director - Instructional Services/Curriculum/Staff Development

Section 5000 - Students

Section 6000 - Instruction

Senior Director-Personnel

Section 4000 - Certificated and Classified

B. Development of the Proposal (See Appendix for chart)

1. Formulation and Editing of Preliminary Draft

a.The administrative head will work closely with the originator or proposer in drafting the new or revised policy to coincide with the idea or intent of the proposal.

b.A copy of the preliminary draft of the proposed policy shall be sent to the Superintendent's office for a check on the policy's compliance with the law; and consistency with other policies. The Superintendent or designee also shall be responsible for editing the policy for composition and format and assigning an index number for the policy.

2.Evaluation of Proposed, Revised or Reviewed Policies

a.All policies up for review, revision, or first consideration shall be distributed to Superintendent's cabinet, Board of Trustees, principals, representatives of all employee associations, public libraries, and directly affected individuals when appropriate. Each recipient will be invited to comment on the policies in question.

b.Such policies shall be placed on the agenda of a subsequent board meeting.

c.The Superintendent or designee shall review comments received prior to the Board meeting for policy review and shall incorporate suggested changes when appropriate.

d.Policies up for review with no recommended changes require no action by the Board of Trustees and may appear on a single agenda. Other policies, either new or revised, shall appear on at least two policy review agendas to be discussed at intervals of thirty to sixty days. In most instances, policies will appear first as an informational item, then on two subsequent agendas for "first reading" and "adoption." This allows ample time for thorough review of proposed policies or revisions, and enables staff and community members the opportunity to submit written comments or suggestions on any policy under consideration.

e. New and amended policies may be adopted or amended only after second reading.

C.Distribution of Approved Policy

1.Upon adoption by the Board of Trustees, the Superintendent or designee shall be responsible for distribution of the approved policy. The policy will be distributed along with a revised table of contents and index pages to holders of policy manuals.

Each certificated employee shall receive a copy of rules and regulations concerned with evaluation of their performance of assigned duties.(EC 35171)

3.In addition to the above, a copy of the approved policy shall be appended to the official Board's minutes.

II. Procedural Steps for Administrative Regulations Formulation

A.Upon adoption of a policy by the Board, administrative regulations shall be developed by the Superintendent or designee, as needed.

B.The regulations shall be presented to the Board for information, discussion, and/or modification. The Superintendent is responsible for development and implementation of administrative regulations which are consistent with the policies adopted by the governing board. In the event of an emergency, the Superintendent may alter current administrative regulations if in his/her sole opinion a need exists.

C.Distribution of the regulations shall follow the same procedure as stipulated in policy distribution.
