[1] Art.197.§1.Whoever subjects another person to sexual intercourse by force, illegal threat or deceit, shall be subject to the penalty of deprivation of liberty for a term from 2 to 12 years.
[2] Art.197.§2.Whoever subjects another person to another sexual activity or the execution of such activity in a manner defined under §1 shall be subject to the penalty of deprivation of liberty for a term from 6 months to 8 years.
[3] Art. 197 §3.If the perpetrator commits a rape:
1) jointly with another person,
2) of a minor under 15 years of age,
3) of an ascendant, descendant, adoptee, person adopting, brother or sister, shall be subject to the penalty of deprivation of liberty for a minimum term of 3 years.
This article was amended by the provisions of the law of 5 November 2009 (Journal of Laws of 2009 No. 206 item 1589) amending this law as of 8 June 2010. The previous wording of the provision was:
Art. 197 §3.If the perpetrator commits a rape jointly with another person, he shall be subject to the penalty of deprivation of liberty for a minimum term of 3 years.
[4] Art.198.Whoever, taking advantage of the vulnerability of another person, or of the lack of ability to recognise the significance of the act or ability to control his/her conduct, resulting from mental disability or disorder, subjects another person to sexual intercourse or to another sexual activity or the execution of such activity, shall be subject to the penalty of deprivation of liberty for a term from 6 months to 8 years.
[5] Art.199.(138) §1.Whoever, abusing a relationship of dependence or by taking advantage of a critical situation, subjects such a person to sexual intercourse or makes him/her submit to another sexual act or to perform such an act, shall be subject to the penalty of deprivation of liberty for up to 3 years.
§2.If the offence under § 1 was committed to the detriment of a minor, the perpetrator shall be subject to the penalty of deprivation of liberty for a term from 3 months to 5 years.
§3.The penalty defined under § 2 shall be imposed on whoever subjects a minor to sexual intercourse or makes him/her submit to another sexual act or to perform such an act, abusing his/her trust or offering him/her a material or personal gain or promising it.
[6] Art.200.(139) §1.Whoever has sexual intercourse with a minor under 15 years of age or performs another sexual act with respect to him or subjects him to such act or its performance, shall be subject to the penalty of deprivation of liberty for a term from 2 to 12 years.
§2.Tee same penalty is imposed on someone who seeking sexual satisfaction shows to a minor under 15 years of age a performance of a sexual act.
[7] Art.201.Whoever has sexual intercourse with an ascendant, descendant, adoptee, person adopting, brother or sister, shall be subject to the penalty of deprivation of liberty for a term from 3 months to 5 years.
[8] Art.202.(142) §1.Whoever publicly presents pornographic material in such a manner that it is imposed upon a person who may not wish so shall be subject to a fine, the penalty of restriction of liberty or the penalty of deprivation of liberty for up to one year.
§2.Whoever presents pornographic material to a minor under 15 years of age or provides him with objects of such nature or disseminated pornographic materials in a manner allowing such a minor contact with them, shall be subject to a fine, the penalty of restriction of liberty or the penalty of deprivation of liberty for up to 2 years.
§3.(143) Whoever, for the purpose of dissemination, produces, records or imports, stores, or possesses or disseminates or publicly present pornographic material with the participation of a minor or pornographic material connected with the presentation of violence or the use of an animal, shall be subject to the penalty of deprivation of liberty for a term from 6 months to 8 years.
