Vehicle for Hire Commission Bylaw

Whereas, pursuant to sections 7 and 8 of the Municipal Government Act, RSA 2000, c. M-26, Council may pass bylaws dealing with transportation, business and other activities;

And Whereas, pursuant to section 145 of the Municipal Government Act, Council may pass bylaws dealing with the establishment and functions of council committees:

Edmonton City Council enacts:

part - purpose, definitions and interpretation

purpose / The purpose of this bylaw is to:
continue the City of Edmonton Taxi Cab Commission as the Vehicle for Hire Commission;
prescribe powers, functions, duties, structure and procedures for the Commission.
definitions / In this bylaw, unless the context otherwise requires:
“City” means the municipal corporation of the City of Edmonton;
“City Manager” means the Chief Administrative Officer of the City or that person’s delegate;
“Commission” means the Vehicle for Hire Commission established under this bylaw;
“Council” means the Municipal Council of the City of Edmonton;
“Member” means a person appointed to the Commission pursuant to this bylaw;
“Vehicle for Hire” or “Vehicles for Hire” means a motor vehicle with a driver used or offered for the transportation of at least one passenger in return for a fee from any place within the city to a destination either within or outside of the city;

part - establishment and objectives

establishment / The Edmonton Taxi Cab Commission established under Bylaw 6016 and continued under Bylaws 11093 and 12020 is hereby continued as a committee of Council, and renamed as the Vehicle for Hire Commission.
POWERS, DUTIES
AND FUNCTIONS / The mandate of the Commission is to regulate Vehicles for Hire in the city of Edmonton, and in doing so:
has all the powers, duties and functions as delegated to the Commission by Council by this or any other bylaw, subject to any applicable legislation; and
may exercise the powers, duties, and functions as may be required by Council from time to time.
Subject to the provisions of this bylaw and all other City, Provincial, or Federal laws, the Commission, in fulfilling its mandate shall:
establish regulations, pursuant to the City Vehicle for Hire Bylaw 14700, governing Vehicles for Hire, drivers and business operations in the city of Edmonton;
recommend to Council any changes to rates, fees or fines under the City Vehicle for Hire Bylaw 14700;
recommend to Council any changes to the number of Vehicle for Hire Licences permitted to be issued under the City Vehicle for Hire Bylaw 14700;
direct the City Manager in regard to issuing new licences under the City Vehicle for Hire Bylaw 14700; and
advise Council on matters relating to Vehicles for Hire in the city of Edmonton, including recommending changes to this bylaw and the City Vehicle for Hire Bylaw 14700.
SOLICITOR / An independent solicitor may be appointed by the City Manager, in consultation with the Commission, to advise the Commission about Vehicles for Hire and related matters.

part - structure and procedures

structure / The Commission will consist of seven citizens-at-large appointed in accordance with Council policies and procedures.
Members shall:
not have an interest in a Vehicle for Hire licence or a brokerage who holds a Vehicle for Hire licence within one year prior to application to become a Member, unless Council directs otherwise; and
submit a written declaration of past and present associations with the Vehicle for Hire industry prior to appointment.
Each appointment made by Council is for a term of two years, or other term as may be approved by Council, to a maximum of six consecutive years.
If one or more positions on the Commission is not filled or becomes vacant, the Commission may continue with fewer Members.
The Commission will request Council to terminate the appointment of any Member who is absent from three consecutive meetings, or who misses three regular meetings in six months unless the absence is authorized by resolution of the Commission.
Non-voting advisors to the Commission may be appointed as follows:
one advisor appointed by the Chief of Police of the City of Edmonton; and
two advisors appointed by the City Manager.
Advisors to the Commission may attend and speak at any meetings of the Commission or its subcommittees.
Notwithstanding section 9(2), advisors must leave any meeting if requested to do so by the Chair.
procedures / Subject to the provisions of this bylaw, Bylaw 12300, the Procedures and Committees Bylaw and all other City, Provincial or Federal laws, the Commission:
may establish its own rules of procedure; and
shall establish for approval of the City Manager:
a Code of Conduct, including conflict of interest provisions; and
a Records Management Policy.
The Commission shall select from its Members, a Chair and a ViceChair.
The duties of the Chair will be to:
represent the Commission at Council and its Standing Committees, and in other public functions;
act as presiding officer at all meetings of the Commission;
call special meetings of the Commission; and
any other duties as may be determined by the Commission.
The duty of the Vice-Chair is to act as the Chair in the Chair’s absence; and in the absence of the Chair and the Vice-Chair, the Commission may elect one of its Members to preside at a meeting.
meetings / The Commission will meet:
on a schedule approved by the Commission; and
at special meetings called by the Chair.
The Chair may call a special meeting at any time provided notice is given in accordance with this bylaw.
The Chair must call a special meeting within fourteen days after receiving a request in writing to do so from a minimum of three Members of the Commission.
Members shall be given at least three business days’ written notice of a special meeting, such notice to include a statement of purpose of the meeting, unless all of the Members give written consent before or at the commencement of the meeting to dispense with notice.
Each Member has one vote and a motion is lost when a vote is tied.
Quorum of the Commission is a majority of the existing appointed Members of the Commission.
subcommittees and public consultation / The Commission may establish subcommittees to assist the Commission in the performance of its duties and to make recommendations to the Commission.
When establishing a subcommittee, the Commission will:
establish a Terms of Reference;
set out the number of members;
set out the term and method of appointment;
set out the processes and procedures of the subcommittee, including any solicitation of public input; and
allocate any necessary budget or other resources.
The Commission shall set by resolution on an annual basis the maximum number of meetings for each subcommittee. Any additional meeting of a subcommittee must be approved by the Commission.
Subcommittees:
shall be chaired by a Commission Member;
may consist of persons from outside the Commission; and
shall report back to the Commission for consideration of findings.
The Commission, by resolution, may solicit input from the public.
REMUNERATION and expenses / Members may be paid such remuneration as may be fixed from time to time by Council.
Members shall be reimbursed for their reasonable out-of-pocket expenses, business travel and training expenses required to carry out the business of the Commission, in accordance with City policies.
Persons from outside of the Commission serving on a subcommittee of the Commission may be reimbursed for their reasonable out-of-pocket expenses required to carry out the business of the subcommittee, in accordance with City policies.

part - finance and administration

budget / The Commission’s budget and any other expenses arising from the operation of the Commission in fulfilling the Commission’s responsibilities must be submitted to Council for approval.
The budget will be prepared by the Commission in consultation with the City Manager.
The Commission’s budget will be administered by the City Manager.
All Licence fees paid to the City pursuant to this bylaw and every bylaw dealing with licensing of Vehicles for Hire will be placed in the general revenue of the City and earmarked for the sole use of the Commission, and any excess revenue each year shall be retained for the future use of the Commission unless otherwise determined by Council.
resources / Professional, technical and administrative support to the Commission will be provided by the City Manager through service deliverable agreements, and be paid for out of the Commission’s budget.
The Commission may refer any dispute over service deliverable agreements to the City Manager for resolution. The decision of the City Manager shall be final.
effective date / This bylaw comes into force on the same day as the City Vehicle for Hire Bylaw 14700.
