FIRST CUT DRAFT – BLUFF POINT PUD CONDITIONS

While the staff developed conditions address the developers interests in created the PUD, the countyBoard of Supervisors has a responsibility to also address the bigger picture of how the proposed PUD will affect the public generally. Therefore the residents directly affected by the proposed PUD request the following conditions be set by the Northumberland Board of Supervisors.

1. CONDITION: The Developer SHALL improve Bluff Point, Jarvis Point and Monarch Shores Road to accommodate anticipated traffic loads at full build out prior to any development on the proposed parcels. The Developer SHALL fund traffic analysis and road improvements for the Town of Kilmarnock.

EXPECTED RESULT: VDOT funds and master plan do not provide for meaningful or signification upgrades to these road. The PUD Proposal suggests the Developer does not assume responsibility for traffic impacts outside the development grounds. This condition assigns responsibility for traffic problems caused by the PUD directly to the developer and ensures road improvements and traffic flow are addressed as a first priority.

2. CONDITION: The Developer SHALL first fully construct Phase II and III PUD Low Cost Housing, waste water treatment plant and well in the non-conservation district prior to any Phase I construction in the conservation district.  needs more specific detail and wording.

RATIONALE: The county’s first responsibility to its residents is to ensure the provision of health, police, rescue and emergency services. The PUD proposal leaves the matter vaguely addressed and essentially volunteers to contribute up to $100,000 for two year to the Kilmarnock Volunteer Rescue Squad and Fire Departments.
