Meeting Minutes

Acting Chairman - Mike Amundson called the October 6, 2014, Supervisor’s Meeting to order at 7:00 pm, Baytown Community Building, 4020 McDonald Dr. N., Baytown. Members present: John Fellegy, Ron Fredkove, John Hall, and Mike Amundson. Also present Dave Magnuson, Attorney, Marsha Olson, Treasurer, Diane Meitz, Deputy Clerk and Connie Fredkove, Town Clerk. Kent Grandlienard was absent

Approval of Minutes and payment of bills

Ron Fredkove moved to approve the September 8, 2014 minutes as published seconded by John Fellegy. All in favor, motion passed.

Ron Fredkove moved to pay the September 2014 bills and accept the deposits as read, seconded by John Fellegy. All in favor, motion passed.

Request for Minor Subdivision – St. Clair

Staff report has been completed.

Patricia St. Clair made the following comment concerning question on access see wording in #2 from the township’s planner. Is there some way to change the wording to make it less demanding? #1 could the word “Owner” be “the current Owners of the parcels/easement”. #2 “in compliance with Town standards.” could the language be modified to say “in compliance with existing Town Standards for a private access road or driveway”.

Mr. Magnuson stated that this wording as presented by the town planner is currently in other township easement statements. Most joint driveways are created with family members.

Sherri Buss stated that Washington County will probably demand this statement.

Ron Fredkove moved to approve the Minor Subdivision as requested by Patricia and Gregory St. Claire, 14949 30TH St, N, Baytown Township, with the following conditions:

1.  The minor subdivision shall be in substantial compliance with the Preliminary Plat received by the Township on September 8, 2014.

2.  The applicants shall dedicate an easement over the driveway on Lot 2, to provide access to Lot 1 and the adjacent parcel to the east. The easement shall be filed at Washington County with the plat. The following statement shall be included in the easement: “Should the town desire to acquire all right title and interest in the driveway easement, the Town must notify the Owners in writing of its intention, and within ninety (90) days after the notification, the Owner, in consideration of One Dollar ($1.00), shalltransfer all right title and interest in the driveway easement to the Town. To the extent that the easement is not in good repair or in compliance with Town standards, the Owner is obligated to bring the easement into good repair at the time of transfer.”

3.  The applicants shall pay the park dedication fee of $800 for Lot 2 to the Township before the approval of the Final Plat.

4.  The applicants shall present the Final Plat to the County Recorder/Registrar of Titles for recording within 120 days of Plat Commission approval. Plat Commission approval is null and void after 120 days.

5.  The applicants shall obtain the required septic system permit from Washington County when residential development is proposed on Lot 2.

6.  The applicants shall obtain a building permit when construction is proposed on Lot 2.

7.  The applicants shall obtain any required Watershed District permits for construction,

John Fellegy moved to approve Resolution 12-2012 The Preliminary Plat and Final Plat for Copper Leaf Development as presented, seconded by John Hall. All in favor, motion passed.

Joint Powers Agreement Bayport/Miller Excavating /Baytown

Dave Magnuson presented Addendum No. 4 to the Joint Powers Agreement dated Oct. 3, 2005 between City of Bayport and Baytown Township. Miller Excavating at 3721 Stagecoach Trail has requested the township to ask the city of Bayport to extend the municipal water service to provide municipal water service to the development.

Code Red Joint Powers Agreement

John Hall Moved to approve the Joint powers agreement between the Washington County Sheriffs office and Baytown township to enter into a contract with Emergency Communications Network for the purposed of providing a Mass Emergency Notification System also known as Code Red (an Opt in program) and to pay $135.42 per year until 2019, seconded Ron Fredkove. All in favor, motion passed.

Miller Excavating Sanding Contract

The new contract was reviewed by the Board, there is a slight increase from 2013-2014

Ron Fredkove moved to approve the Miller Excavating contract for snowplowing, removal and sanding for the 2014-2015 snow season as presented:

5 yd Loaders $112.50 per hour

Graders $112.50 per hour

Bobcats $103.00 per hour

Truck w/sander and or Plow $97.50 per hour

Sand $12.00 per yard

Salt/Sand – 12% Mixture $54.50 per ton

Rock Salt $158.00 per ton

Tandem Trucks (14 yds) Hauling Snow - $98.00 per hour

Man and Pickup $95.00 per hour

Minimum charge $75.00

seconded by John Fellegy. All in favor, motion passed

Supervisor reports/announcement

Ron Fredkove - Mike and Ron did a road assessment 3 hours 43 miles of driving. Northbrook and 30th St. repair for the 2015 summer. Hold off Osgood for awhile.

Dennis Trenda , there is a dip on Odegard, it settles on the east side. Ron will have Miller Excavating look at it. Maybe we can get through the winter and fix in summer of 2015.

John Fellegy – Sept 11 meeting of the MSCWMO. John Hall also attended the Sept 11 meeting. The topic of MIDS standards was discussed. Sherri Buss stated that the Township just adapts the same water Management Plan concerning infiltration and the standards as Washington County. So the MSCWMO should just talk to Washington County to adapt the standards and then the Township will ultimately follow the county.

Mike Amundson – No progress on Gateway. Manning Ave project is being stretched out. Round-about on 10th St. N. and Manning.

Kent Grandlienard - Kent is going to attend a meeting with the MAC Commission.

John Hall – was scheduled to attend the Tax training class, it was cancelled. He will find out when the next session will be held and attend. Bayport Fire Department Advisory commission meeting will be scheduled yet this fall to discuss the new building, etc.

New Business

Rick Weyrauch applied for the Valley Branch Watershed volunteer position; he is waiting to hear from the Valley Branch Watershed.

Old Business

Osgood Ave – Mike Amundson talked to Jim Studenski asking him to re-stake the limits of the project as it is now, with lack of ditches noted and if we can move the permanent easement. Mike Amundson will stay in touch with Mr. Studenski. The township will try and get the answers to the questions, we may hold off the upgrading of Osgood for another year.

Conditional Use Permits

Clerk informed the board as to the results of the correspondence with the holders of the conditional use permits in the township. There are still 3 holders who haven’t responded to the letter, the clerk will follow up with them.

John Fellegy moved to remove the Conditional Use Permit from 4401 Osgood Ave., N. Selling saunas, seconded by Mike Amundson. All in favor, motion
