MEMORANDUM OF AGREEMENT
This agreement made in duplicate this 1st day of January 2010.
BETWEEN:
Manitoba First Nation Education Resource Centre Inc.
(hereafter referred to as “MFNERC”)
- and -
Tataskweyak Education Authority – Tataskweyak Cree Nation
(hereafter referred to as “Split Lake”)
1. PURPOSE:
This MOU is the formal agreement for the employment relationship/guidelines for the Student Information System Information Workers located within the respective community.
2. THE PARTIES AGREE AS FOLLOWS:
2.1 The term of employment of the Information Worker will generally be based on a twelve month period from April 1st to March 31st of each fiscal year,;
2.2 The MFNERC will pay the Information Worker’s salary and benefits as per their financial management regime;
2.3 The two percent (2%) increment will be managed by the MFNERC each fiscal year until the end of the project and will be dependent to approval of project funding by Indian and Northern Affairs Canada;
2.4 The Information Worker Job Description will be developed by the MFNERC and a copy will be provided to Split Lake;
2.5 Recruitment and selection of the Information Worker will be handled by the said Education Authority;
2.6 The Information Worker’s employment will be supervised, governed and evaluated by the Education Director or designate of the said community; and thus will follow the Split Lake’s and MFNERC’s Policies and Procedures with respect to employment as well as any Tataskweyak Cree Nation by – laws;
2.7 The parties agree to collaborate openly about any issues for the duration of the Student Information System Project.
2.8 This MOU will be automatically renewed on an annual basis until terminated or suspended by either party.
3. TERMINATION OR SUSPENSION:
Either party may terminate this MOU at any time during the project due to any unforeseen circumstances such as termination of funding. A notice of 30 days will be required by either party to terminate this agreement.
4. NOTICE:
Any notice required to be given hereunder by any party, shall be in writing and is effective if delivered in person, or on delivery by facsimile transmission or other electronic means that produce readable copy, on delivery by overnight courier or messenger, or 5 days after mailing by certified or registered Canadian mail, return receipts requested, postage prepaid, duly addressed to the party to whom it is intended at the addresses set out below or such other address of which notice is so given.
