The Peters Drain was petitioned to be cleaned and was deemed necessary by the Board of Determination. This drain cleaning will be paid by you and the other parcel owners in the drainage district. The contract to do this work was sent out for competitive bids. The bids are due back to the MCDC at 10:00 a.m. on November 9, 2017. You are invited to the MCDC office at 1005 South Raisinville Road, Monroe, Michigan on November 14, 2017any time between 9:00 a.m. and 5:00 p.m. to review the plans and specifications of the project, find out the costs associated with the project, ask any project related questions, and find out how much this drain clean out project will be assessed to your parcel on your winter tax bill(s). You are further advised in accordance with Public Act 171 of 2016 that the Monroe County Drain Commissioner intends to perform maintenance work within the drain easement on your property after November 14, 2017. This contract provides that the Contractor shall furnish all necessary labor, materials, tools and equipment for the construction, repair and cleanout of the Peters Drain, unless otherwise indicated on the Construction Plans.
All property owners or freeholders which said Peters Drain will traverse are required to remove all fences on lines of said drain unless otherwise specified, and if not removed, any damage done to said property will not in anyway obligate the Drainage District or the Successful Bidder, if the above referred to specifications have been completed.
All property owners or freeholders which said Peters Drain will traverse are required to flag and mark all tiles outletting into the drain unless otherwise specified, and if not flagged and marked, any damage done to said outlet tiles will not in anyway obligate the Drainage District or the Successful Bidder, if the above referred to specifications have been completed.
The owner of any land in the special assessment district who may feel aggrieved by the apportionment of benefits made by the Drain Commissioner may, within 10 days after the Day of Review, appeal therefrom by making application to the Probate Court of Monroe County for the appointment of a Board of Review and may further appeal from the report of the Board of Review by application for a Writ of Certiorari by the Circuit Court of Monroe County, all as provided in Sections 155 and 161 of the Drain Code (Act 40 of the Public Acts of Michigan, 1956, as amended).
You are further advised that, pursuant to Section 155 of the Michigan Drain Code, any owner of land within the drainage district or any city, village, township, district or county, feeling aggrieved by the apportionment of benefits made by the Drain Commissioner, may appeal the apportionment within 10 days after the Day of Review of apportionment by making an application to the Monroe County Probate Court for the appointment of a Board of Review.
The Monroe County Drain Commissioner will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audio tapes of printed materials being considered at the meeting, to individuals with disabilities at the meeting/hearing upon 7 days notice to the Monroe County Drain Commissioner. Said job will be let in accordance with the diagram now on file with the other papers pertaining to said Drain, in the office of the County Drain Commissioner of the County of Monroe to which reference may be had by all parties interested, and bids will be made and received accordingly.
Contracts will be made with the lowest responsible bidder giving adequate security for the performance of the work, in the sum then and there to be fixed by me, reserving to myself the right to reject any and all bids, and to adjourn such letting to such time and place as I shall publicly announce.
The date for the completion of such contract, and the terms of payment therefor, shall and will be announced at the time and place of letting. Apportionments against land and municipalities will be collected in the same manner as property taxes. Any apportionments against lands and municipalities that are collected by installments, may be paid in full with any interest to date at the time and thereby avoid further interest charges. The Day of Review will be held to finalize apportionment amounts [the amount you will pay]and receive complaints on assessments to properties within said county drainage districts. At the Day of Review, the computation of costs for said Drain will also be open for inspection by any interested parties.
