Special Terms & Conditions of Work

The following Terms and conditions shall be read and construed along with the General Terms and conditions of Form ‘A’ In case if any conflict of inconsistency the special condition shall prevail:-

1. The Scope of work under the tender is the work as given in the Tender Specification.The rates shall remain firm in all respect during the currency of the contract.

2. All material T& P,labour required for the work will be arranged by the contractor at his own cost.

3. PAYMENT:-

90% payment shall be made against running bills subject to availability of fund and balance 10% shall be retained towards faithful performance of the contract which shall be paid after 6 months of satisfactory completion of work. For claiming 100% payment the contractor shall have to submit Bank Guarantee/FDR/CDR of 10% value of the contract value,which shall be released after satisfactory completion of performance period.

4. VARIATION:-

The quantity of any work may increase or decrease as per site conditions but the value of the tender shall remain the same.

5. SECURITY:-

Security @ 1% of the contract value shall be deposited by the contractor at the time of executing the agreement,however if security is not deposited by the Contractor the Earnest Money is deposited by the contractor shall be retained as security which will be released after satisfactory completion of work.

6. PERFORMANCE GUARANTEE:-

The 10% amount retained as security amount against the performance guarantee from final bill. However if any discrepancies is observed during the guaranteed period,the firm shall repair the same free of cost and no liability shall be borne by MVVNL whatsoever.

7. COMPLETION PERIOD:-

The date of start of work shall be given by SDO concerned. The work is required to be completed within 45 days thereafter. However if certain part of work is delayed on account of non-availability of shut down or material to be supplied by department that delay shall not be treated as delay on the part of the Contractor.

8. PENALTY:-

Penalty @ ½% per week subject to a maximum of 10% value of the work not completed within the stipulated completion time shall be deducted from the Contractor’s bills as per Form ‘A’.

9. The work shall be carried out by the contractor with all necessary precautions and due care.The department shall not be responsible for any accident causing injury or death to contractor’s personnel due to negligency.The department shall not be responsible for payment of any compensation to the work men of the contractor on this account.

10. Executive Engineer,Electricity Distribution Division Ist,Sitapur or his SDO concerned shall supervise all the works covered under the agreement. The payment and all other commercial matter shall be dealt by Executive Engineeer,EDD Ist.Sitapur.

11. DISPUTE:-

In case of any dispute between the contractor and Engineer incharge the matter shall be

referred to Superintending Engineer,Electy.Distribution circle,Sitapur whose decision shall be binding on both the parties.

12. All disputes relating to the subject matter of the order shall be subject to the jurisdiction of the local court Sitapur.

13. LIABILITY:-

Any loss/theft of department material shall be of the responsibility of Contractor due to negligence or otherwise the cost of which shall be recovered from the Contractor’s bill.

14. ELECTRICITY RULES:-

All work shall be carried out in accordance with revised and latest provisions of the Indian Electricity Act and the rules make under. The Contractor will be responsible for paying the Compensation to the workers in case of any accident took place due to non- observation of the safety rules.

15. TAXES & DUTIES:-

Taxes & duties as legally applicable shall be deducted from the Contractor’s bills paid to Contractor as per prevailing rules.

16. Undersigned reserves the right to delete/add any items of works and also to distribute the works amongst various tenderers.

17. SERVICE TAX:-

No service Tax shall be payable extra.

18. OTHERS:-

All other Terms & Conditions of From ‘A’ of UPPCL shall be applicable is respect of the above work.
