Program Administration and Oversight–Staff Supports–Provisions for personal and professional needs

Combined Proposed New Language:

The early learning services provider must provide for the personal and professional needs of their staff by:

1) Having a secure and convenient place to store their personal belongings that is inaccessible to children.

2)Having a readily accessible phone to use for emergency calls or brief conversations with parents.

3)Providing some file and storage space for professional materials.

4)Having a space for confidential staff conversations during hours children are in attendance.

Early learning and services programs must meet Washington State Department of Labor and Industries rules including, but not limited to, required breaks, pay and benefits.

Justification:

FIRST: The alignment analysis found issues with this topic being excluded from WAC. It is recommended for inclusion in Caring for Our Children, Child Care Center Licensing Guide Book, ERS and in Labor and Industry WAC.

SECOND: Language from CFOCB and alignment with ERS standards for Minimal (3) requirements were incorporated into the new WAC to improve quality measures.

5.4 Facilities provided for staff meals/snacks (Ex. Refrigerator space; cooking facilities).

5.5 Accommodations made to meet needs of staff with disabilities even if no one with disabilities is currently employed.

7.1 Separate adult lounge area (no dual use).

7.2 Comfortable adult furniture in lounge.

7.3 Staff have some flexibility in deciding when to take breaks.

7.1 Well-equipped office space for program administration (Ex. Computer, printer, photocopier, answering machine used).

7.2 Program has space that can be used for individual conferences fand group meetings that is conveniently located, comfortable, and separate from space used for children’s activities.

Justification:

FIRST: The alignment analysis found issues withduplication and progression which is the basis for the change.

22. INDUSTRIAL INSURANCE COVERAGE

The Contractor shall comply with the provisions of Title 51 RCW (Industrial Insurance). If the Contractor fails to provide industrial insurance coverage or fails to pay premiums or penalties on behalf of its employees as may be required by law, DEL may collect from the Contractor the full amount payable to the Industrial Insurance accident fund. DEL may deduct the amount owed by the Contractor to the accident fund from the amount payable to the Contractor by DEL under this Contract, and DEL may also transmit the deducted amount to the Contract Number: XX-XXXX Printed Date: Page 18 of 27

Department of Labor and Industries (L&I), Division of Insurance Services. This provision does not waive any of L&I’s right to collect from the Contractor.

FOURTH: Resource or research used that may not have been available at the time of original analysis (CFOC Basics matrix, CCDF Reauthorization plan, etc) List resource used.

1
