ORDINANCE NO. 2013-04
AN ORDINANCE ENACTING FLOODPLAIN DAMAGE PREVENTION REGULATIONS.
WHEREAS, the State of Colorado Department of Natural Resources, Water Conservation Board (“CWCB”), has adopted standards for floodplain management, which are outlined in the Rules and Regulations for Regulatory Floodplains in Colorado (the Rules), effective January 14, 2014; and
WHEREAS, in order for the Town to participate in the National Flood Insurance Plan (“NFIP”) and be eligible to receive grant funding from CWCB, it must adopt the Rules, to become effective on or before January 14, 2014; and
WHEREAS, the Federal Emergency Management Agency (“FEMA”) has advised if the Rules are not adopted: federally backed loans and other financial assistance for acquisition or improvement of buildings in the mapped NFIP area will be unavailable; if a Presidential Disaster Declaration for flood is made, aid to survivors will be severely limited because the Town will not have demonstrated management of its flood risks by participating in NFIP; and Hazard Mitigation funding through FEMA would be unavailable; and
WHEREAS, the Town Board of Trustees has reviewed the Rules and by this Ordinance adopts them and incorporates them into the Keenesburg Municipal Code as the minimum standards for the Town.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF KEENESBURG, COLORADO:

Floodplain Damage Prevention
Sec. 18-3-10Statutory authorization.
TheLegislatureoftheStateofColorado has, in Title29, Article20oftheColorado Revised Statutes, delegated theresponsibilityoflocalgovernmentalunitstoadoptregulationsdesigned to minimize flood losses. Therefore,theBoard of TrusteesofKeenesburg, Colorado, does herebyadopt thefloodplainmanagementregulations set forth in this Article.
Sec. 18-3-20Findings of fact.
(a) Theflood hazard areasofthe Town of Keenesburgaresubjectto periodic inundation, whichcan result in lossoflife and property, health and safetyhazards, disruptionofcommerceandgovernmental services, andextraordinarypublic expendituresfor flood protectionand relief, allofwhichadversely affect thehealth, safetyand generalwelfareofthepublic.
(b)Thesefloodlosses arecreatedbythecumulativeeffectof obstructions infloodplainswhichcause anincreaseinfloodheightsandvelocities,andbytheoccupancy offloodhazardareasby uses vulnerabletofloodsandhazardoustootherlandsbecausethey areinadequately elevated, floodproofed or otherwiseprotected fromflood damage.
Sec. 18-3-30Statement of purpose.
It isthepurposeofthisordinance topromotepublichealth, safetyand generalwelfare andto minimizepublic and private lossesdue to flood conditionsinspecific areasbyprovisions designed to:
(1) Protecthuman life and health;
(2) Minimizeexpenditureofpublicmoney for costly flood controlprojects;
(3) Minimizetheneed for rescueand reliefeffortsassociated with floodingand generally undertakenattheexpenseofthegeneralpublic;
(4) Minimizeprolonged businessinterruptions;
(5) Minimizedamage to criticalfacilities, infrastructureand other publicfacilities such as water, sewer and gasmains;electric and communications stations;and streetsand bridgeslocated in floodplains;
(6) Help maintainastabletaxbasebyproviding for the sound use and developmentof flood- prone areasinsuch amanner astominimizefutureflood blightareas; and
(7) Insure thatpotentialbuyersarenotified thatpropertyislocatedin aflood hazard area.
Sec. 18-3-40Methods of reducing flood losses.
In order to accomplish itspurposes, thisordinanceusesthefollowingmethods:
(1) Restrictor prohibitusesthat aredangerousto health,safetyor propertyin timesof flood, or causeexcessive increasesin flood heightsor velocities;
(2) Require thatusesvulnerable to floods, including facilities whichservesuch uses, be protectedagainstflood damage atthetimeofinitialconstruction;
(3) Controlthealteration of naturalfloodplains, streamchannels, andnaturalprotectivebarriers, which are involved in theaccommodation of flood waters;
(4) Controlfilling, grading, dredgingand other developmentwhichmayincreaseflood damage;
(5) Preventor regulate the construction of flood barriers which willunnaturallydivertflood watersor which mayincreaseflood hazardsto otherlands.
Sec. 18-3-50Definitions.
Unless specificallydefined below, wordsor phrasesused in thisordinanceshallbeinterpretedto give them themeaningtheyhave in common usageand to give thisordinanceitsmostreasonable application.
100-YEARFLOOD- Aflood havingarecurrenceinterval thathasaone-percent chanceofbeing equaled orexceeded duringany givenyear (1-percent-annual-chanceflood).Theterms“one-hundred-year flood”and“onepercent chanceflood”aresynonymouswith theterm“100-year flood.”Thetermdoesnotimplythat theflood willnecessarilyhappen onceeveryonehundred years.
100-YEARFLOODPLAIN- The areaofland susceptibleto beinginundatedasaresultofthe occurrenceofaone-hundred-year flood.
500-YEARFLOOD- Aflood havingarecurrenceintervalthathasa0.2-percent chanceofbeing equaled orexceeded duringany givenyear (0.2-percent-chance-annual-flood).Thetermdoesnot implythat theflood willnecessarilyhappen once every fivehundred years.
500-YEARFLOODPLAIN- The areaofland susceptibleto beinginundatedasaresultofthe occurrenceofafive-hundred-year flood.
ADDITION- Anyactivitythat expandstheenclosed footprintor increasesthesquarefootageofan existingstructure.
ALLUVIAL FANFLOODING- Afan-shaped sedimentdepositformed byastream thatflowsfromasteepmountain valleyorgorgeonto aplain or thejunction ofa tributarystreamwiththemain stream. Alluvialfanscontain activestream channelsand boulder bars, and recentlyabandoned channels. Alluvialfansarepredominantly formed byalluvialdepositsandaremodified byinfrequent sheetflood, channel avulsionsand other streamprocesses.
AREAOFSHALLOWFLOODING- Adesignated ZoneAOor AHon a community'sFlood InsuranceRateMap (FIRM) with aonepercent chanceor greaterannual chanceof floodingto an averagedepth ofoneto threefeetwhereaclearlydefined channeldoesnotexist, wherethepath of floodingisunpredictableand wherevelocity flowmaybe evident. Such floodingischaracterized by pondingor sheetflow.
BASE FLOODELEVATION(BFE)-Theelevation shown on aFEMAFlood InsuranceRateMap forZones AE, AH, A1-A30, AR, AR/A, AR/AE, AR/A1-A30, AR/AH, AR/AO, V1-V30, and VE thatindicatesthewater surface elevation resulting fromaflood thathasaonepercentchanceof equalingor exceedingthatlevel inany givenyear.
BASEMENT - Anyareaofabuildinghavingitsfloor sub-grade(belowground level) onallsides.
CHANNEL - Thephysical confineofstreamorwaterwayconsistingofabed and streambanks, existinginavarietyof geometries.
CHANNELIZATION-Theartificialcreation, enlargementor realignmentofastreamchannel.
CODE OFFEDERAL REGULATIONS(CFR) - Thecodification ofthe generaland permanent Rulespublished in theFederalRegister bythe executivedepartmentsandagencies oftheFederal Government. It isdividedinto 50titlesthatrepresentbroad areas subject to Federalregulation.
COMMUNITY- Anypoliticalsubdivision inthestateofColorado thathasauthorityto adoptand enforcefloodplain managementregulationsthrough zoning, including, butnotlimited to,cities, towns, unincorporated areasin the counties, Indian tribesand drainageand flood controldistricts.
CONDITIONAL LETTEROF MAPREVISION(CLOMR)–FEMA’scommentonaproposed project, which doesnotrevise an effectivefloodplain map,thatwould, upon construction, affect the hydrologicor hydrauliccharacteristicsofaflooding source and thusresult in the modification ofthe existingregulatory floodplain.
CRITICAL FACILITY– A structureor relatedinfrastructure, butnottheland on whichit is situated, as specifiedin Section 18-3-230, that if flooded mayresult in significanthazardsto publichealthand safetyorinterruptessentialservicesand operationsfor thecommunityat anytime before, duringand afteraflood. SeeSection 18-3-230.
DEVELOPMENT - Anyman-made change in improved and unimproved realestate, includingbut not limited to buildingsor other structures, mining, dredging,filling, grading, paving, excavation or drillingoperationsor storageofequipmentormaterials.
DFIRMDATABASE- Database(usuallyspreadsheetscontainingdataandanalysesthat accompany DFIRMs). TheFEMAMappingSpecificationsandGuidelinesoutlinerequirementsfor the developmentand maintenanceofDFIRMdatabases.
DIGITAL FLOOD INSURANCE RATE MAP(DFIRM)- FEMAdigital floodplainmap.These digitalmaps serve as“regulatoryfloodplain maps”for insuranceand floodplain management purposes.
ELEVATEDBUILDING- Anon-basementbuilding(i) built,in thecaseofabuildinginZones A1-30, AE, A, A99, AO, AH, B, C, X, and D, to have the top oftheelevated floorabove the ground levelbymeansofpilings, columns(postsand piers), or shear wallsparallelto the flowofthe waterand (ii) adequatelyanchored soasnot toimpair thestructuralintegrityof thebuildingduringa flood ofup to the magnitudeofthebaseflood. In the caseof Zones A1-30, AE, A, A99, AO, AH, B, C, X, and D, “elevated building”also includesabuildingelevatedbymeansof fillor solid foundation perimeter walls with openings sufficientto facilitatetheunimpeded movementof flood waters.
EXISTING MANUFACTUREDHOMEPARKOR SUBDIVISION- A manufactured home park or subdivision for which the construction of facilitiesfor servicingthe lotson which the manufactured homesareto be affixed (including, ata minimum, the installation ofutilities, theconstruction ofstreets, and either finalsitegradingor thepouringofconcretepads) is completed before theeffectivedate ofthefloodplainmanagementregulationsadopted bya community.
EXPANSIONTOANEXISTING MANUFACTUREDHOME PARKOR SUBDIVISION-Thepreparation ofadditionalsitesbythe construction of facilitiesfor servicing the lotson which the manufactured homesareto be affixed (includingtheinstallation ofutilities, theconstruction of streets,and either finalsitegradingor thepouringofconcretepads).
FEDERAL REGISTER- Theofficialdailypublication for Rules, proposedRules, andnoticesofFederal agenciesandorganizations,as wellasexecutiveordersandother presidentialdocuments.
FEMA- FederalEmergencyManagementAgency,the agencyresponsiblefor administeringtheNationalFlood Insurance Program.
FLOODORFLOODING- Ageneralandtemporarycondition ofpartialorcomplete inundation of normallydryland areasfrom:
1. Theoverflowofwater from channelsand reservoir spillways;
2. Theunusual and rapid accumulation or runoffofsurfacewatersfrom anysource;or
3. Mudslidesor mudflowsthatoccur from excess surfacewaterthatiscombinedwith mud or other debristhatis sufficiently fluid so asto flowover thesurfaceofnormallydryland areas (such asearthcarried bya currentofwaterand deposited alongthepath ofthecurrent).
FLOOD INSURANCERATE MAP(FIRM) – Anofficialmapofa community, on which the FederalEmergencyManagementAgencyhasdelineated both theSpecialFlood Hazard Areasand therisk premiumzonesapplicable tothecommunity.
FLOOD INSURANCE STUDY(FIS)- Theofficialreportprovided bytheFederalEmergency ManagementAgency. ThereportcontainstheFlood InsuranceRateMapas well asflood profiles for studied floodingsourcesthat can beused to determineBaseFlood Elevations forsome areas.
FLOODPLAINORFLOOD-PRONE AREA-Anyland areasusceptibleto beinginundated asthe resultofaflood, includingtheareaofland over which floodwater would flowfrom thespillwayofa reservoir.
FLOODPLAIN ADMINISTRATOR- The communityofficialdesignated bytitleto administer and enforcethefloodplainmanagementregulations.
FLOODPLAIN DEVELOPMENT PERMIT – Apermit required before construction or development begins within anySpecial Flood Hazard Area (SFHA).IfFEMA has not defined theSFHA within a community, the communityshall requirepermits for all proposed construction orotherdevelopment in the communityincludingtheplacement ofmanufactured homes, so that it maydeterminewhethersuch construction orotherdevelopment is proposed within flood-prone areas.Permits are required to ensurethat proposed development projects meet the requirements oftheNFIPand this floodplain management ordinance.
FLOODPLAINMANAGEMENT -Theoperation ofan overallprogramofcorrectiveand preventive measuresfor reducing flood damage, includingbutnotlimitedto emergencypreparedness plans, flood controlworksand floodplain managementregulations.
FLOODPLAINMANAGEMENT REGULATIONS- Zoningordinances,subdivision regulations, buildingcodes, health regulations, specialpurposeordinances(suchasafloodplain ordinance, gradingordinanceanderosion controlordinance)and otherapplicationsofpolicepower. Theterm describes such stateorlocalregulations, in anycombination thereof, whichprovidestandardsfor the purposeof flood damagepreventionand reduction.
FLOODCONTROL STRUCTURE- Aphysicalstructuredesignedand built expresslyor partially for thepurposeofreducing, redirecting, or guidingflood flowsalongaparticular waterway. These specialized floodmodifyingworksare those constructedin conformancewith sound engineering standards.
FLOODPROOFING- Anycombination ofstructural and/or non-structuraladditions,changes, or adjustmentsto structureswhich reduceor eliminateflood damage to real estateor improved real property, water and sanitary facilities, structuresandtheircontents.
FLOODWAY(REGULATORYFLOODWAY)- Thechannelofariver orother watercourseand adjacentland areasthat mustbereserved in order todischarge thebase flood withoutcumulatively increasingthewater surfaceelevation more than adesignated height. TheColorado statewide standard for thedesignated height to beused for allnewlystudied reaches shallbeone-half foot(six inches). Letters ofMap Revision to existingfloodwaydelineations maycontinueto usethe floodwaycriteriain place at thetimeofthe existingfloodwaydelineation.
FREEBOARD- Theverticaldistance in feet aboveapredicted water surfaceelevation intended to provideamargin ofsafetyto compensatefor unknown factorsthatcould contributeto flood heights greater than theheight calculated for aselectedsize flood such asdebrisblockageofbridgeopenings and the increased runoffdue to urbanization ofthe watershed.
FUNCTIONALLY DEPENDENT USE - Ausewhich cannotperformitsintended purposeunless it islocated orcarriedoutin closeproximityto water. Theterm includesonlydocking facilities, port facilitiesthatarenecessary for the loadingand unloadingofcargo or passengers, and ship building and ship repair facilities, butdoesnotincludelong-termstorageor relatedmanufacturing facilities.
HIGHEST ADJACENT GRADE – The highestnaturalelevation oftheground surfacepriorto construction nextto theproposed wallsofastructure.
HISTORIC STRUCTURE - Anystructure that is:
1. Listed individuallyin theNational RegisterofHistoricPlaces (alistingmaintained bytheDepartmentof Interior) orpreliminarilydeterminedbytheSecretaryoftheInterioras meetingtherequirementsfor individual listingon theNationalRegister;
2. Certified orpreliminarilydetermined bytheSecretaryoftheInterior ascontributingto thehistorical significanceofaregistered historicdistrict oradistrict preliminarily determined bytheSecretaryto qualifyas aregistered historicdistrict;
3. Individuallylisted on astateinventoryofhistoricplaces in states with historic preservation programs which havebeen approved bytheSecretaryofInterior; or
4. Individuallylisted on alocal inventoryofhistoricplaces in communities with historic preservation programs that havebeen certified either:
a. Byan approved stateprogram asdetermined bytheSecretaryoftheInterior or;
b. DirectlybytheSecretaryoftheInterior in states without approved programs.
LETTEROFMAPREVISION(LOMR)- FEMA'sofficialrevision ofan effectiveFlood InsuranceRateMap (FIRM), or Flood Boundaryand FloodwayMap (FBFM), or both. LOMRsare generallybased on theimplementation ofphysicalmeasuresthat affect thehydrologicor hydraulic characteristicsofafloodingsource and thusresultinthemodification oftheexistingregulatory floodway, the effectiveBaseFlood Elevations(BFEs), or theSpecialFlood Hazard Area(SFHA).
LETTEROFMAPREVISIONBASEDONFILL (LOMR-F) – FEMA’s modification ofthe SpecialFlood Hazard Area(SFHA)shown on theFlood InsuranceRateMap (FIRM) based on the placementof filloutsidethe existingregulatory floodway.
LEVEE – Aman-madeembankment, usuallyearthen, designed and constructed inaccordancewith sound engineeringpracticesto contain, control, or diverttheflowofwater soasto provideprotection from temporary flooding.For a leveestructure tobereflected on theFEMAFIRMsasproviding flood protection,theleveestructure mustmeettherequirements setforth in 44CFR 65.10.
LEVEE SYSTEM- Aflood protection systemwhich consistsofa levee, orlevees, and associated structures, such asclosureand drainagedevices, which are constructed and operatedin accordance with sound engineeringpractices.
LOWEST FLOOR- Thelowestfloor ofthe lowestenclosed area(includingbasement). Any floor used for livingpurposeswhich includes working, storage, sleeping, cookingand eating, or recreation or anycombination thereof. Thisincludesany floor that could be converted tosuch ausesuchasa basementorcrawlspace.The lowestfloor isadeterminatefor thefloodinsurancepremiumfor a building, homeor business. An unfinished or flood resistant enclosure,usable solely for parkingor vehicles, buildingaccessor storage in anareaother than abasementarea isnotconsidered a building'slowestfloor;provided thatsuch enclosureisnotbuiltso asto renderthestructure in violation oftheapplicablenon-elevation design requirementofSection 60.3 oftheNationalFlood insuranceProgramregulations.
MANUFACTUREDHOME - A structuretransportable in oneormoresections, which is builton a permanent chassisand isdesigned for usewith or withoutapermanentfoundation when connected to therequiredutilities.Theterm“manufactured home” doesnot includea“recreationalvehicle.”
MANUFACTUREDHOME PARKOR SUBDIVISION- Aparcel(or contiguousparcels) ofland divided intotwo or moremanufactured homelotsfor rentor sale.
MEAN SEALEVEL - For purposesoftheNationalFlood InsuranceProgram, theNorth American VerticalDatum(NAVD) of1988 or other datum, to which BaseFlood Elevations shown on a community'sFloodInsuranceRateMaparereferenced.
MATERIAL SAFETY DATA SHEET (MSDS) – Aformwith dataregardingthepropertiesofa particular substance. An importantcomponentofproductstewardshipand workplacesafety, it is intended toprovideworkersand emergencypersonnelwithproceduresfor handlingor workingwith thatsubstance inasafemanner,and includesinformation suchasphysicaldata(meltingpoint, boilingpoint, flash point,etc.),toxicity, health effects, first aid, reactivity, storage, disposal, protectiveequipment,andspill-handlingprocedures.
NATIONAL FLOOD INSURANCE PROGRAM(NFIP)– FEMA’sprogramof flood insurance coverage and floodplainmanagementadministeredin conjunction with theRobertT. Stafford Relief and EmergencyAssistanceAct.TheNFIPhasapplicableFederalregulationspromulgated inTitle44 oftheCodeofFederalRegulations.TheU.S. CongressestablishedtheNFIPin 1968 withthe passageoftheNationalFlood InsuranceActof1968.
NEW MANUFACTUREDHOMEPARK OR SUBDIVISION- Amanufactured homepark or subdivision for which theconstruction of facilitiesfor servicingthe lotson which themanufactured homesare to be affixed (includingataminimum,the installation ofutilities, theconstruction of streets,and either finalsitegradingor thepouringofconcretepads) iscompleted on orafter the effectivedateof floodplain managementregulationsadopted bya community.
NO-RISE CERTIFICATION– Arecord oftheresultsofan engineeringanalysisconducted to determinewhetheraprojectwill increaseflood heightsin afloodway. A No-RiseCertificationmust besupported bytechnicaldataand signed byaregistered Colorado Professional Engineer. The supportingtechnical datashould bebased on thestandard step-backwatercomputermodel used to develop the100-yearfloodwayshown on the FloodInsuranceRateMap(FIRM)orFlood Boundaryand FloodwayMap (FBFM).
PHYSICAL MAPREVISION(PMR) - FEMA’s action wherebyoneormoremap panels are physicallyrevised andrepublished. A PMRis used to change flood risk zones, floodplain and/or floodwaydelineations, flood elevations, and/orplanimetric features.
RECREATIONAL VEHICLE - meansavehiclewhich is:
1. Builtonasinglechassis;
2. 400 squarefeetor less when measuredatthelargesthorizontalprojections;
3. Designed to beself-propelled or permanentlytowablebya lightdutytruck; and
4. Designed primarilynotfor use asapermanentdwellingbut astemporarylivingquarters for recreational, camping, travel, or seasonaluse.
SPECIAL FLOODHAZARD AREA– The land in thefloodplain withinacommunitysubject toa onepercentor greater chanceof floodingin any given year, i.e., the100-year floodplain.
START OFCONSTRUCTION- The datethebuildingpermitwasissued, includingsubstantial improvements, provided theactualstartofconstruction, repair, reconstruction,rehabilitation, addition, placement, orother improvementwas within 180 daysofthepermitdate.Theactualstart meanseither thefirstplacementofpermanent construction ofastructureon a site,suchasthe pouringofslab or footings, the installation ofpiles, the construction ofcolumns, or anywork beyond thestageofexcavation;ortheplacementofamanufactured homeonafoundation. Permanent construction doesnotinclude land preparation, suchasclearing, gradingand filling;nor doesit include the installation ofstreetsand/or walkways;nor doesitincludeexcavation for basement, footings, piersor foundationsor theerectionoftemporary forms;nor doesit includetheinstallationon thepropertyofaccessorybuildings, such asgaragesor shedsnotoccupiedas dwellingunitsor not partofthemain structure.For asubstantialimprovement,theactualstartofconstruction meansthe first alteration ofanywall,ceiling, floor, or other structuralpartofabuilding, whether or notthat alterationaffectsthe externaldimensionsofthebuilding.
STRUCTURE - A walled and roofed building, includingagasor liquid storage tank, whichis principallyaboveground, as wellasamanufacturedhome.
SUBSTANTIAL DAMAGE - Damageofanyorigin sustainedbyastructure wherebythe costof restoringthestructure toitsbefore-damaged condition would equalorexceed 50 percentofthe marketvalueofthestructure justprior to when thedamageoccurred.
SUBSTANTIAL IMPROVEMENT - Anyreconstruction,rehabilitation,addition,or other improvementofastructure, thecostofwhichequalsor exceeds50 percentof the market valueofthe structurebefore“StartofConstruction”oftheimprovement.Thevalueofthestructureshallbe determined bythe local jurisdiction havingland useauthorityin the areaofinterest.Thisincludes structures which have incurred“SubstantialDamage,”regardlessofthe actualrepair work performed. Thetermdoesnot,however, include either:
1. Anyprojectfor improvementofastructureto correct existing violationsofstateor local health, sanitary, or safetycodespecifications whichhavebeenidentified bythe localcode enforcementofficialandwhich are theminimumnecessaryconditionsor
2. Anyalteration ofa“historicstructure”providedthatthealteration willnotprecludethe structure'scontinued designationasa“historicstructure.”
THRESHOLDPLANNING QUANTITY(TPQ)– Aquantitydesignated for each chemicalon the listofextremelyhazardous substancesthattriggersnotification byfacilitiestotheStatethatsuch facilitiesaresubject toemergencyplanningrequirements.

VIOLATION- Thefailureofastructureor other developmentto befullycompliantwiththe community'sfloodplain managementregulations. Astructureor other developmentwithout the elevation certificate, othercertifications, or otherevidenceofcompliancerequired in Section60.3(b)(5), (c)(4), (c)(10),(d)(3), (e)(2),(e)(4),or (e)(5) of the National Flood Insurance Program regulationsispresumed to be in violation untilsuchtimeasthatdocumentation isprovided.
WATER SURFACE ELEVATION- Theheight, in relationto theNorth AmericanVerticalDatum(NAVD) of1988 (or other datum,wherespecified), of floodsof various magnitudes and frequenciesinthefloodplainsofcoastalor riverine areas.
Sec. 18-3-60Land to which this Article applies.
Theordinanceshallapplyto allSpecialFlood Hazard Areas andareasremoved from thefloodplain bythe issuanceofaFEMALetter ofMap RevisionBased on Fill(LOMR-F)within thejurisdiction ofKeenesburg, Colorado.
Sec. 18-3-70Basis for establishing the special flood hazard area.
Since Special Flood Hazard Areas have not been identified, water surface elevations have not been provided, nor has sufficient data identifying the floodway been provided by the Federal Emergency Management Agency (FEMA), the town shall obtain, review, and reasonably utilize data available from other federal, state or other resources.
Sec. 18-3-80Establishment of floodplain development permit
AFloodplain DevelopmentPermitshallberequired to ensureconformancewith theprovisionsof thisordinance.
Sec. 18-3-90Compliance
No structureor land shallhereafter belocated,altered, or have itsusechangedwithin theSpecial Flood Hazard Areawithoutfull compliancewiththe termsofthisordinanceand otherapplicable regulations. Nothingherein shallprevent theTown of Keenesburgfrom takingsuch lawful action asisnecessaryto preventor remedyanyviolation.Theseregulationsmeet theminimum requirementsas set forth bytheColorado Water Conservation Board andtheNationalFlood InsuranceProgram.
Sec. 18-3-100Abrogation of greater restrictions
Thisordinance isnotintended to repeal,abrogate, orimpair anyexistingeasements,covenants, or deed restrictions. However, wherethisordinance and another ordinance, easement,covenant, nor deed restriction conflictoroverlap, whichever imposesthemorestringentrestrictions shallprevail.
