2. / This notice has been issued to inform you at the earliest possible stage that an allegation has been made that you may have breached the Standards of Professional Behaviour and/or committed a criminal offence and that there is to be an investigation into your conduct. The investigation will be in accordance with Managing Misconduct (Police Staff) Policy but also, if appropriate, the provisions set out in the Police Reform Act 2002 and the IPCC Statutory Guidance, which set out how complaints from the public are to be dealt with (IPCC Website – Info for Police).
You may provide a written response to the allegation(s) using standard form PS16, and any supporting documentation you feel may assist. You should provide these to the misconduct investigator, within 10 working days of receiving this notice.
3. / In the case of a criminal matter, you will be cautioned and any response you give will be noted. The person serving this form is required to complete a Statement of Witness where the investigation relates to a public complaint oralleged criminal offence.
4. / You are expected to co-operate honestly with any investigation and to provide any information which will assist the misconduct investigator/s in carrying out a fair and proportionate investigation.
As this is a confidential process you should not discuss this with anyone other than those directly involved in investigating the allegations and representing/supporting you.
5. / The fact that you have received this notice does not necessarily mean that misconduct or criminal proceedings will be taken against you, but is given in order to safeguard your interests. An interview will be arranged in due course to enable you to respond to the allegations. You will be given seven days notice of this interview, unless this is arranged earlier by mutual agreement. All the available evidence which can be disclosed will be provided to you at the earliest opportunity.
6. / You have the right to consult and be accompanied at any meeting or interview by a colleague, Staff Association or Unison representative who is not otherwise involved in the matter, however arranging this representation should not impose undue delay in these proceedings.

7. / If, after receiving this notice the proposed level of misconduct proceedings is revised, you will be given a further written notice explaining the reasons for that change, as soon as practicable.
8. / The misconduct investigator will update you on the progress of the investigation at least every 28 days. You will also be informed if there is likely to be any undue delay in completing the procedure. Whatever the outcome of the allegation, you will be informed of the result of the investigation.
9. / If, following the investigation, it is decided that there is a misconduct/gross misconduct case for you to answer; you will be given written notice of attending a formal misconduct meeting/hearing. Any documents to be referred to at the meeting/hearing, including a copy of the investigator’s report, will be provided to you with the meeting/hearing notice.
10. / The panel decision will be determined on the balance of probabilities. Any right of appeal will be in accordance with theManaging Misconduct (Police Staff) Policy and Managing Misconduct (Police Staff) How to Guide.
11. / Outcomes available in misconduct proceedings will be in accordance with Managing Misconduct (Police Staff) Policy and Managing Misconduct (Police Staff) How to Guide.
12 / If you are dismissed as a result of these proceedings, you will be included on the barred list. Whilst included on the barred list, this will act as an absolute bar to being employed or appointed by a police force or other specified law enforcement body. After 5 years of being included on the barred list, you will have the option to have your barred status reviewed which may result in your removal from the barred list.
