TEMPORARY CERTIFICATED EMPLOYMENT AGREEMENT

1.Agreement

This Agreement is entered into this ___ day of _____, 19__, between the Pleasanton Unified School District (hereinafter "DISTRICT"), and ______(hereinafter "EMPLOYEE").

2.Temporary Employment

You are hereby offered employment, and classified as a temporary employee, pursuant to:

[ ]Education Code Section 44909, to perform services in a Categorically Funded Program or Project of Indeterminate Duration;

[ ]Education Code Section 44910, (pursuant to Section 52301) to perform services at a Regional Occupational Center or Program;

[ ]Education Code Section 44917, to perform services as a substitute when, after September 1, no regular employee is available;

[ ]Education Code Section 44919, to perform services in:

*Temporary classes, or

*Special day and evening adult classes, or

*Schools of migratory population, or

*Supervising athletic activities, or

*An emergency;

[ ]Education Code Section 44920, to perform services because a certificated employee is on leave of absence;

[ ]Education Code Section 44921, to perform services for first semester if expect decline in enrollment due to graduation;

[ ]Education Code Section 44929.25, to teach adults for not more than 60% of the hours per week considered full-time for comparable assignment.

[ ]Education Code Section 44986, to perform services when a certificated employee is on a STRS disability leave of absence.

Your service as a temporary employee is for the maximum period of ______, 19__, to ______, 19__, inclusive; provided, however, that this employment may terminate in accordance with applicable law or under the provisions of this Agreement or both. 4.General Duties

The services to be rendered by EMPLOYEE, and all terms and conditions of employment, are subject to and shall be in accordance with the laws of the State of California, the rules and regulations of the State Board of Education, and the policies and rules adopted by the DISTRICT.

EMPLOYEE, as an express condition of this employment Agreement, shall at all times have and maintain all certification and other employment qualifications and register all certification documents, as required by the laws of the State of California, the rules and regulations of the State Board of Education, and the policies and rules adopted by the DISTRICT, for the position specified herein.

10.Notice of Termination of Services

In accordance with law, your employment is subject to dismissal at the pleasure of the Board and you may be summarily dismissed during the term of this Agreement at any time prior to when you will have served 75% of the number of days the regular schools of the District are maintained during the school year. If you serve 75% or more of said days in one school year, the DISTRICT may notify you prior to June 30, the end of the school year, of its decision not to reelect you for the following school year. If so dismissed or released, you shall not be entitled to any statement of reasons, nor shall you have a right to a hearing. (EC 44954)

TEMPORARY EMPLOYMENT CATEGORIES

[ ]Education Code Section 44909

Any person employed by the governing board of any school district as a certificated employee in programs and projects to perform services conducted under contract with public or private agencies, or categorically funded projects which are not required by federal or state statutes, may be classified as temporary employee.

[ ]Education Code Section 44910

Any person employed as an instructor in classes conducted at regional occupational centers or programs shall not be included in computing the service required as a prerequisite to attainment of, or eligibility to, classification as a permanent employee.

[ ]Education Code Section 44917

Any person employed after September 1 of any school year by the governing board of any school district for the remainder of the school year, where the position is one for which no regular employee is available, including persons retired for service under the state teachers= retirement system, may be classified as a substitute employee.

[ ]Education Code Section 44918

Any employee classified as a substitute or temporary employee, who serves during one school year for at least 75% of the number of days the regular schools of the district were maintained in that school year and has performed the duties normally required of a certificated employee of the school district, shall be deemed to have completed a complete school year as a probationary employee if employed as a probationary employee for the following year. Employees classified as substitutes, and who are employed to serve in an on-call status to replace absent regular employees on a day-to-day basis, shall not be entitled to the benefits of this section.

Any person employed as a certificated employee other than a substitute employee, who is employed to serve from day-to-day during only the first three school months of any school year either to teach temporary classes or perform any other duties which will not last longer than the first three school months, or to teach in special day and evening classes for adults or in schools of migratory population for not more than four school months of any school term shall be classified as temporary employees.

Service in a limited assignment supervising athletic activities of pupils shall not be included in computing the service required as a prerequisite to attainment of, or eligibility to, classification as a permanent employee of a school district.

Service by a person in an appointment on a temporary basis when an emergency arises shall not be included in computing the service required as a prerequisite to attainment of, or eligibility to, classification as a permanent employee of a school district.

[ ]Education Code Section 44920

Any person employed by a district as a teacher, based upon the need for additional certificated employees for a particular semester or school year because a certificated employee has been granted leave, or is experiencing a long term illness, may be classified as a temporary employee.

[ ]Education Code Section 44921

Any certificated person employed for the first semester only whenever the district expects a reduction in student enrollment during the second semester due to students completing graduation requirements at mid-year may be classified as a temporary employee. Persons so employed who are continued in employment beyond the first semester shall be deemed probationary employees for the entire school year.

[ ]Education Code Section 44929.25

Any person who is employed to teach adults for not more than 60% of the hours per week considered a full-time assignment for permanent employees having comparable duties shall be classified as a temporary employee, and shall not become a probationary employee under the provisions of section 44954.

[ ]Education Code Section 44986

Any person employed to fill vacancies caused by the absence of certificated employees who are classified as permanent and are receiving a disability or insurance allowance or benefit from the system or from a group insurance plan and is on leave of absence for not more than 39 months, shall be classified as a temporary employee. The term of employment of the temporary employee shall be equal to the number of days of absence of the employee receiving the disability allowance.

[ ]Education Code Section 44954

Governing boards of school districts may release temporary employees requiring certification qualifications under the following circumstances:

(a)At the pleasure of the board prior to serving during one school year at least 75 percent of the number of days the regular schools of the district are maintained.

(b)After serving during one school year the number of days set forth in subdivision (a), if the employee is notified before the end of the school year of the district=s decision not to reelect the employee for the next succeeding year.
