I, , and my heirs and assigns, hereby release and hold harmless Aerojet as well as its respective current and former related entities, affiliates, successors, subsidiaries, employees, agents, officers and directors (hereinafter referred to as "Company") from any and all claims, demands, actions, causes of actions, suits, damages, losses, costs, attorneys' fees and /or expenses, known or unknown, which I may claim to have against the Company arising from my presence on Company's facility and I hereby promise not to assert any such claims, demands, actions or causes of actions.
Consideration for executing this General Release of Claims includes the award of a Purchase Order/contract that does not meet Aerojet’s insurance requirements as set forth in the solicitation.
I expressly waive and relinquish all rights and benefits afforded by Section 1542 of the Civil Code of the State of California, and do so understanding and acknowledging the significance of such specific waiver of Section 1542. Section 1542 of the Civil Code of the State of California states as follows:
“A general Release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the Release, which if known by him must have materially affected his settlement with the debtor.”
Thus, notwithstanding the provisions of Section 1542, and for the purpose of implementing a full and complete release and discharge of the Releases, I expressly acknowledge that this Agreement and General Release is intended to include in its effect without limitation, all claims which I do not know or suspect or exist in my favor at the time of execution hereof, and that this General Release contemplates extinguishment of any such claim or claims.
I promise never to file a lawsuit asserting any claims that are released in this Agreement. If I break this promise and file such a lawsuit, I will pay for all costs incurred by Company, including reasonable attorneys’ fees, in defending against my claim.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND THE PROVISIONS OF THIS AGREEMENT INCLUDING MY WAIVER OF CLAIMS AGAINST THE COMPANY (AEROJET). I HAVE NOT RELIED UPON ANY OTHER REPRESENTATION OR STATEMENT, WRITTEN OR ORAL.
