Minutes of the Council meeting of the Delhi Medical Council held on 12thNovember, 2014in Conference Room, Delhi Medical Council, New Delhi
A meeting of the Delhi Medical Council was held on 12th November, 2014at 2.30 pm in Conference Room, Delhi Medical Council, New Delhi.
The following were present :-

The meeting was adjourned at 2.30 pm due to lack of quoram. The meeting was reconvened at 3.00 pm.
Dr. A.K. Agarwal, President, chaired the meeting.
Dr. A.K. Agarwal welcomed the members to the meeting.
The following agenda was discussed :-
- Confirmation of the minutes of the last meeting held on 1st October, 2014.
Minutes of the last Council meeting held on 1st October, 2014, which were circulated to all the members, were confirmed.
- Action taken report of minutes of the meeting held on 1st October, 2014
Action taken report, which was circulated to all the members, appended herewith as Annexure ‘A’ was approved.
- To discuss cases of medical negligence and unethical conduct
(i)The Order of the Disciplinary Committee in complaint No. 1005of Shri Praveen Joshi, H.No.399, 3rd Floor, Sector-18-B, Dwarka, New Delhi-110075, alleging medical negligence on the part of the doctors of Bensups Hospital, in the treatment administered to the complainant’s father at Bensups Hospital, Sector-12, Dwarka, New Delhi-110075, was confirmed by the Delhi Medical Council.
(ii)The Order of the Disciplinary Committee in complaint No. 961 of Shri Sanjay Kumar Srivastava, Flat No. 5, Plot No. 436, Sector-4, Vaishali, Ghaziabad-201012, forwarded by Medical Council of India, alleging medical negligence on the part of doctors of All India Institute of Medical Sciences, Ansari Nagar, New Delhi-110029, in the treatment administered to the complainant’s daughter Ms. Gargi Srivastava at All India Institute of Medical Sciences, resulting in her death on 21.10.11, was confirmed by the Delhi Medical Council.
The Council also confirmed the punishment of warning awarded to Dr. A. Jayaswal (Dr. Arvind Jayaswal) (Delhi Medical Council Registration No.35714) by the Disciplinary Committee.
(iii)The Order of the Disciplinary Committee in complaint No. 966of Ms. Shikha w/o. Shri Karan, r/o. F-8/116, Sector-15, Rohini, Delhi – 110085, alleging medical negligence on the part of Dr. Rachana and Dr. Renu Gupta, in the treatment of the complaint, was confirmed by the Delhi Medical Council.
The Council also confirmed the punishment of warning awarded to Dr. Rachna (Delhi Medical Council Registration No.DMC/R/01099)by the Disciplinary Committee.
(iv)The Order of the Disciplinary Committee in complaint No. 1310 from Manager HR, Primus Super Specialty Hospital, Chandragupta Marg, Chanakyauri, New Delhi – 110021, alleging professional misconduct on the part of Dr. Naval Bhatia, was confirmed by the Delhi Medical Council through majority decision.
Whist confirming the Order of the Disciplinary Committee, the Council observes that the decision of the Disciplinary Committee holding Dr. Naval Bhatia (Delhi Medical Council Registration No. 4862) guilty of professional misconduct is final. However, the Order directing the removal of name from the State Medical Register of Delhi Medical Council shall come into effect after 30 days from the date of the Order.
The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.
(v)The Order of the Disciplinary Committee in complaint No. 958- A representation of SHO, Police Station Malviya Nagar, Delhi, forwarded by Medical Council of India, seeking medical opinion on a complaint of Shri Shashi Bhushan, s/o Shri Ram Ayodhya Prasad, GB-16C, Pul Prahalad Pur, New Delhi, alleging medical negligence, in the treatment administered to the complainant’s wife Smt. Rinku, was taken for confirmation before the Delhi Medical Council.
Whist confirming the Order of the Disciplinary Committee, the Council observes that the decision of the Disciplinary Committee holding Dr. Anusha Joshi (Delhi Medical Council Registration No. 13684) guilty of medical negligence is final. However, the Order directing the removal of name from the State Medical Register of Delhi Medical Council shall come into effect after 30 days from the date of the Order. The Council also confirmed the punishment of warning awarded to Dr. Dinesh Chandra (Delhi Medical Council Registration No. 4064) and Dr. Asheesh Pravin Lal (Delhi Medical Council Registration No. 19811).
The Council further observed that in the facts and circumstances of this case, the punishment of removal of name of Dr. Neeraj Agarwal (Delhi Medical Council Registration No. 4402)was a bit harsh punishment and the same was not warranted. It was further observed that the interests of justice will be served if a warning is issued to Dr Neeraj Agarwal(Delhi Medical Council Registration No. 4402).
The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.
(vi)The Order of the Disciplinary Committee in complaint No. 1011 of Smt. Maya Devi, r/o, House No.HR-233, Gali No. 5-A, Pul Prahalad Pur, New Delhi-110044, alleging medical negligence on the part of Dr. Sameer Grover, in the treatment administered to the complainant’s son Shri Ashwani at Batra Hospital & Medical Research Centre, 1, Tughlakabad Institutional Area, Mehrauli-Badarpur Road, New Delhi-110062, was confirmed by the Delhi Medical Council.
(vii)The Order of the Executive Committee in complaint No. 1154of Shri Gyan Deep Dixit c/o. Rashmi Dixit r/o. B-253, 3rd Floor, Mohan Garden, Uttam Nagar, New Delhi – 110059, alleging medical negligence on the part of Dr. Madhu Chadda and Dr. V.S. Solanki of Amar Leela Hospital, in the treatment administered to complainant’s wife Smt. Rashimi Dixit at Amar Leela Hospital, B-1/6, Janakpuri, Main Najafgarh Road, New Delhi – 110058, was confirmed by the Delhi Medical Council.
(viii)The Order of the Executive Committee in complaint No. 1190- A representation from Sub-Divisional Magistrate, Rajouri Garden, Delhi, seeking expert opinion on a complaint of Smt. Rashmi Devi r/o. Shri Ram Colony, Preet Vihar, Opp. District Jail, Dasana, Ghaziabad, UP, alleging medical negligence on the part of doctors of DDU Hospital, in the treatment administered to complainant’s sister late Kanchan at DDU Hospital, Hari Nagar, New Delhi, resulting in her death on 29.5.2012, was confirmed by the Delhi Medical Council.
(ix)The Order of the Executive Committee in complaint No. 1178 of Shri Raj Kumar Prasad, r/o, S-608, Nehru Enclave, School Block, Shakarpur, Delhi-110092, alleging professional misconduct on the part of Dr. Vardhman Jain and Dr. Y.K. Kaushik of Som Dutt Medical Centre, S-524, Schook Block, Shakarpur, Delhi-110092, was confirmed by the Delhi Medical Council.
(x)The Order of the Executive Committee in complaint No. 1129 of Shri. Udit Bhatia r/o. NP-971 B, Pitampura, Delhi– 110034 forwarded by Directorate of Health Services, Govt. of NCT of Delhi, alleging medical negligence on the part of Dr. Sanjay Gogia, Dr. Tripathi and Max Hospital, New Delhi, in the treatment administered to the complainant’s mother late Nirupma Bhatia at Max Hospital, Shalimar Bagh, Delhi-110088, was confirmed by the Delhi Medical Council.
(xi)The Order of the Executive Committee in complaint No. 1200 of Shri Som Nath Dawar r/o. 495 A, School Block, Shakarpur, Delh – 110092, alleging medical negligence on the part of Dr. Himanshu Singh Pundir and Somdatt Medical Centre, in the treatment administered to the complainant at Somdatt Medical CentreS-534, School Block, Shakarpur, Delhi, was confirmed by the Delhi Medical Council.
(xii)The Order of the Executive Committee in complaint No. 1203 of Smt. Ritu Rani w/o. Shri Vivek Kumar r/o. 14/266, Trilokpuri, Delhi – 110091, alleging medical negligence on the part of Dr. Parinita and Max Super Speciality Hospital, in the treatment administered to the complainant and her new born baby at Max Super Speciality Hospital, 108A, Indraprastha Extn., Patparganj, Delhi – 110092, was confirmed by the Delhi Medical Council.
(xiii)The Order of the Executive Committee in complaint No. 1212 of Shri Bablu Singh s/o. Shri Rajbir Singh r/o. B-891, New Sabzi Mandi, Azadpur, Delhi – 110033, alleging medical negligence on the part of Dr. Aakash Dua, Dr. Zeba Khan and Shree Balaji Charitable Hospital, in the treatment administered to the complainant at Shree Balaji Charitable Hospital, Plot No. 2, Near Shiv Mandir, Mukundpur, Delhi – 110042, was confirmed by the Delhi Medical Council.
(xiv)The Order of the Executive Committee in complaint No. 1208 of Smt. Seema w/o. Shri Lokesh Kumar r/o. T-21, Kala Rait, Malka Ganj, Subzi Mandi, Delhi – 110007 alleging medical negligence on the part of Dr. Jai Kishan of Tirath Ram Shah Hospital, in the treatment administered to the complainant at Tirath Ram Shah Hospital, 2A, RBL Ishwar Dass Sawhney Marg, Raj Pur Road, Delhi – 110054, was confirmed by the Delhi Medical Council.
- To discuss about the recommendations to frame guidelines for diagnostic centres.
The Secretary informed that the guidelines for diagnostic centre are yet to be finalized.
- To discuss about the minutes of the Anti Quackery Committee.
The Minutes of the Anti Quackery Committee meeting held on 28th October, 2014 which was circulated to the Council members present (appended herewith as annexure ‘B’, was confirmed.

No further matter was discussed.
