Minutes for City Council Regular Meeting

Held at 7pm on Monday, June 27, 2016

CALL TO ORDER

The meeting was called to order at 7pm by Mayor David Lossing. The meeting was held in the Council Chambers on the lower level of the Mill Building at 201 N. Main Street, Linden, Michigan.

PLEDGE OF ALLEGIANCE

The Pledge of Allegiance to the American Flag was recited by all present. A moment of silence in memory of those who have served on behalf of the United States was observed by all.

MINUTES

Motion by Ross, second by Cusson, to approve the minutes of the June 13, 2016 regular City Council Meeting. Motion carried.

PUBLIC HEARING/PRESENTATION

(A)  State Bank Presentation by Jeanine Sapelak and Bev Vondra

ICS (Insured Cash Sweep) program. This is a product unique to State Bank. It would entail moving all City funds to State Bank and from there State Bank would invest the money with other banks. This is to ensure all the City funds are protected by the FDIC limit.

Zelenak – can we see a list of banks and choose which ones we want our money at?

Lossing – State Bank chooses, but we can change the banks?

MacDermaid – Is this all our money? Shouldn't we be investing somewhere?

McKone – I'm not sure what the state requires to keep the money in Michigan. I will have to check into that. Can you get a portion and not all the funds invested?

Cusson – How do you keep it separate with all the different accounts?

Zelenak – Co-Mingling of funds is my main concern. How do we ensure that we know which amount is right?

(A)  CAS 25-16 Spectrophotometer with RFID – DPW Purchase

Motion by Cusson, second by MacDermaid, to purchase the Spectrophotometer with RFID not to exceed the amount of $4,375.60. Motion carried.

(B)  CAS 26-16 Resolution No. 07-16 2015-2016 Budget Amendments

Motion by Cusson, second by MacDermaid, to approve Resolution No. 07-16 2015-2016 Budget Amendments for the General Fund. Motion carried.

(C)  CAS 27-16 Ordinance No. 377 Administrative Site Plan Review Process Amendment

Motion by Ross, second by Cusson, to adopt Zoning Ordinance No. 377 and amendment to Section 3.5.2 of the City of Linden Zoning Ordinance pertaining to the administrative site plan review process. Motion carried.

CITY MANAGER’S REPORT

City Manager, Paul Zelenak reported on:

B & B Gas Station Testing: There have been additional monitoring wells installed as part of the B&B gas station testing. We have had several conversations and emails with the DEQ and the State of Michigan regarding B&B over the last several months. The DEQ and B&B and the Assistant Attorney General met recently denied discussing the FAR. We expect that they will be in contact with us very soon regarding the results of that meeting.

Dr. Wax Property: Adam and I met with the DEQ regarding the Dr. Wax property and the potential for using the Brownfield Redevelopment Act to clean up a portion of the property (including potential City right of way) and assist in mitigating the contamination on site. We are working with the DEQ, the MEDC and Genesee County to discuss establishing a Brownfield here in Linden for this site and others.

Friday Night Car Shows: The car shows are again being held in the parking lot behind Thimbleberry's every Friday night from June 3rd through August 26th. We hope the events will be even more successful than last year and bring more visitors to downtown. We are looking at partnering the Car Show with the Forward 4 West Fireworks and Run this coming August.

Gus Macker: The event this year was held this past weekend. They were scheduled to have close to 150 teams, which is a 20% increase in teams over last year. The event was held in the grade school complex of Hyatt and Linden Schools.

Music by the Mill: They will again be held this year in Downtown at the Gazebo. We will hold events throughout the month of August (see attached schedule). The first concert was during our Memorial Day celebration. We received a commitment from State Bank to sponsor both the Music by the Mill and Farmers Market. These monies will be used to offset costs for these events.

Farmers Market: The event will again be held on the property now owned by Dr. Wax. The event will run from July 13th thru August 31st.

Back to the Bricks Car Show: This year's event will be held on August 10th. This year we will be adding a shuttle that will allow people to park off site at either the Loose Center or Hyatt Elementary School. This will allow us also to have additional classic car parking at Linden Elementary School.

Redevelopment Committee: Adam and I are preparing information and working with everyone's schedule to have a meeting with this committee. Our first meeting will be held this upcoming week. We will report back after the meeting.

CITY ATTORNEY’S REPORT

The City received a MTT from Spring Meadows Country Club. I would recommend getting a local appraiser on board. They work much faster on MTT's than back in the day.
