Purchaser Agrees to the Following Terms and Conditions

1. Seller guarantees the cat/kitten to be in good health feline leukemia negative and free of parasites to the best of knowledge at the time of sale. The purchaser agrees to have the cat examined by a licensed veterinarian within 72 hours of receipt of the cat/kitten, at his/her sole expense. The kitten/cat will be accepted for return if returned within 5 days with a veterinarian’s certificate that the kitten has a health defect, stating specifically what that defect is, and why it is harmful. All veterinary expenses are the responsibility of the purchaser(s). A fee of $75 is deducted to cover veterinary examination upon return.

A. Seller must be notified immediately, and the Cat/Kitten must be returned intact to seller with a copy of the veterinary report. In such case, upon receipt of the Cat/Kitten along with a veterinary report of the illness, Seller will refund all funds paid. Under no circumstances shall seller be responsible for payment of any medical treatment provided to the Cat/Kitten by Buyer during the time in which the Cat is in Buyer's possession, nor will seller be responsible for any other miscellaneous expenses, i.e.; transportation, shipping, etc. In the event of the death of the cat, the Buyer must provide a copy of complete necropsy report.

B. Seller agrees to replace the Cat/Kitten in the event the Cat/Kitten dies of a congenital defect within the first year of its life. A veterinary autopsy/necropsy report must be provided to verify the cause of death. Seller will replace the Cat/Kitten with another cat of similar quality as available. If buyer does not want a replacement Cat, Pundit Cattery will have no further obligation towards buyer.

2. If the purchaser wishes to return the cat/kitten due to unforeseen circumstances, it may be returned to the seller in the same condition in which it was received (within 5 days).

A. During that time the Cat/Kitten may be returned for a full refund minus a $75.00 deposit/handling fee, which will be used for a veterinary exam. After the one-week period, any refund will be at the sole discretion of Seller.

B. If there is another cat(s) resident in the household, a certificate of health must accompany the returned cat/kitten, indicating the resident cat is good health, and is FIV/Feline Leukemia, free,

Infectious Peritonitis negative with tests of the resident cat accompanying the returned cat/kitten. (During this time, the kitten may NOT receive any additional or unnecessary inoculations, other than those approved by the breeder. All veterinary expenses are the responsibility of the purchaser(s).

3. Under no circumstances will this cat/kitten be sold, leased, or given away, or placed with any pet shop, research laboratory or similar facility. With the prior approval of the seller, the cat/kitten will be placed in a satisfactory pet home, or returned to the seller without reimbursement of the purchase price. (If this involves a healthy returning kitten, a refund may be provided at the sellers discretion, if the kitten can be re-sold within a reasonable amount of time (30 days), minus any and all expenses incurred by the breeder.)

4. Purchaser agrees to keep the cat/kitten indoors at all times. The purchaser agrees to the best of his/her ability, to provide reasonable health care (yearly exam), including regular inoculations, and veterinary services as required maintaining a healthy animal. The buyer is advised that vaccination with any vaccine for Feline Infectious Peritonitis will result in the health and replacement guarantee for this kitten to be null and void, as there is currently no scientific evidence that the vaccines are 100% safe and effective and evidence has shown they may cause illness. NEVER allow your Kitten or cat to be given two Vaccinations at once (Rabies and Booster) for the sake of convenience. The Siamese breed and derived breeds, Oriental Shorthair and Colorpoint Shorthair is extremely sensitive, and this can cause serious health problems. The Buyer shall not voluntarily cause nor ask an agent to cause the untimely demise of the cat without a veterinarian's certification that such is necessary for veterinary or humane reasons;

5. Other than expressly stated herein, seller makes no warranties, express or implied, about the quality, characteristics, or fitness for a particular purpose of this cat/kitten.

6. The buyer agrees never to declaw this kitten/cat, and understands that declawing is mutilation and a cruelty that is likely to alter the kitten/cat’s temperament and health. Declawing can result in a $500 penalty and/or repossession of the cat/kitten. CFA will not permit declawed cats in its shows. (I suggest clipping the claws every 10 to 14 days, and providing a suitable scratching post.)

7. If this cat/kitten is not neutered by age of six (6) months, the kitten will be considered by the seller as a potential breeder, and the full breeder price of $1,200.* will become immediately due and payable to the seller upon demand. A signed statement from the veterinarian or clinic performing the neuter/spay will be sent to the breeder as evidence of compliance with the terms of this contract at that time.

8. * The buyer agrees and guarantees that this feline will not be used for breeding. Violations will result in paying a fine of $1,000. PLUS; the difference between the pet and breeder price; plus $600 for each litter, and, in addition, alter, or return the cat immediately upon notification thereof, without a reimbursement.

9. The parties acknowledge that this contract was made in the State of Maryland, and that if any legal action is instituted the parties agree that the proper jurisdiction and venue lies in the state of Maryland, in the county of Montgomery, and the parties consent to venue and jurisdiction in Montgomery County and the parties waive the right to a trail by jury.

10. The undersigned are entering into this contract in good faith, with clear understanding of, and full agreement to, its terms and conditions. Purchaser's signature indicates full agreement to all previous conditions.

Health and inoculation records are provided on an accompanying form.
