Annex 1 – Mandatory Conditions

1 / No supply of alcohol may be made under the premises licence:
(a) at any time when there is no designated premises supervisor in
respect of the premises licence, or
(b) at any time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2 / Every supply of alcohol under the premises licence must be made or
authorised by a person who holds a personal licence.
3 / This licence is subject to such further conditions as are consistent
with any restrictions imposed on the use of the premises for the
existing licensable activities under the licence by virtue of the
enactments hereinafter set out:-
The Children and Young Person Act 1933
The Cinematograph (Safety) Regulations 1955
The Sporting Events (Control of Alcohol etc) Act 1985
4 / When door supervisors or other persons carrying out security
activities at specified times are employed such individuals must be
licensed by the Security Industry Authority.
For the purposes of this condition "security activity" means an
activity to which paragraph 2 (1)(a) Schedule 2 to the Private
Security Industry Act 2001 applies.
5 / 1. The admission of children under 18 to the exhibition of any film
shall be restricted in accordance with any classification and
recommendation in respect of that film made by the British Board of
Film Classification or any other film classification body designated
under Section 4 of the Video Recording Act 1984.
2. Notwithstanding the above condition a film may be exhibited and
children under 18 may be admitted thereto if the permission of
Stockton Borough Council is first obtained and any condition of such
permission are complied with. For the purpose of this condition the
venue operator must submit any film to the council that it intends to
exhibit 28 days before it is proposed to show it.

Annex 2 – Conditions Consistent With The Operating Schedule

PREVENTION OF CRIME AND DISORDER
1 / The licence holder and/or the designated premises supervisor or a
person nominated by them shall actively participate and be a member of a Pubwatch scheme for the area within which the premises is located.
2 / No person in possession of a drink in a sealed or unsealed container
shall be allowed to enter the premises except for the purposes of
delivery.
3 / The restriction on the permitted hours for the supply of alcohol shall not prohibit the consumption of alcohol during the first 30 minutes after the terminal hour for the supply of alcohol.
4 / The premises shall be fitted with internal CCTV. Tapes or hard drives to be retained for a period of 14 days or much longer period as may be agreed with the police.
5 / Persons banned under the pubwatch scheme shall not be allowed on the premises.
6 / An incident book shall be retained on the premises and made available to any responsible authority on request.
7 / Alcoholic and other drinks shall not be removed from the premises in open containers save for consumption in any external area provided for that purpose.
PREVENTION OF PUBLIC NUISANCE
1 / All external doors and windows shall be kept closed when regulated
entertainment is being provided except in the event of an emergency.
Any music played within the premises shall not cause a disturbance at
the nearest residential premises. Any music shall be played indoors
only.
2 / The licence holder or his representative shall conduct periodic
assessments of the noise coming from the premises when used for
regulated entertainment and shall take steps to reduce the level of
noise where it is likely to cause a disturbance to local residents. A
written record shall be made of those assessments and shall include,
the time and date of the checks, the person making them and the
results including any remedial action. All records shall be retained
for one year.
3 / Use appropriate management controls to reduce the likelihood of
customers causing noise disturbance to local residents when vacating
the premises. This should include placing at all exits from the
premises, in a place where they can be seen and easily read by the
public, notices requiring customers to leave the premises and the area
quietly. (Note, this may also include a reference to vehicles)
4 / Any odours created from cooking on the premises shall be adequately
vented and/or provided with odour control so that they do not cause a
nuisance to nearby premises.
5 / There shall be provided at the premises containers for the storage and
disposal of waste foods and other refuse from the premises. Those
containers shall be constructed, maintained, and located so that
access to them by vermin and unauthorised persons is prevented and
arrangements shall be made for the regular lawful disposal of their
contents.
6 / No nuisance shall be caused by noise coming from the premises or by
vibration transmitted through the structure of the premises.
7 / There shall be no consumption of alcohol by customers outside the building after 23.00. There shall be no music played externally, and no use of flood lighting likely to cause a nuisance to local residential properties.
PROTECTION OF CHILDREN FROM HARM
1 / No film exhibition shall be shown at the premises unless it has been
classified by the British Board of Film Classification or by the
Licensing Authority and only the following classifications shall be
applied:
U - Universal = Suitable for audiences aged four years and over
PG - Parental Guidance = Some scenes may be unsuitable for young
children
12A - Passed only for viewing by persons aged 12 years or older or
persons younger than 12 when accompanied by an adult
15 - Passed only for viewing by persons aged 15 years and over18 -
Passed only for viewing by persons aged 18 years and over.
2 / Children under the age of 16 shall not be permitted to enter the premises after 21.00.
