Environmental Protection Act 1990: Part II A Contaminated Land

Environmental Information Regulations 2004: Request for environmental information pertaining to1 - 2 City Park, The Droveway, Hove, BN3 7PY.

Thank you for your Environmental Information Regulations (2004) Request.Please find below, the historical maps relating to the search site.

On the maps below, premises which have had previous commercial and industrial purposes have been shaded. These particular premises have been identified as potentially contaminated land under the provisions of the Environmental Protection Act 1990. It should be noted that the term ‘potentially contaminated land’ simply means that there is the potential that some localised land contamination may have occurred on site. To call a site ‘contaminated land’ has a specific legal meaning which carries with it associated consequences. To date, there are no ‘contaminated land’ sites as defined by the Environmental Protection Act 1990, within Brighton and Hove.

Potentially contaminated land sites have been risk rated for further investigation whereby the highest priority sites are rated as A’s and the lowest priority sites are rated as E’s. There are 3 Category A sites and about 1000 Bs in Brighton and Hove.

Based on former or current uses, there are approximately 3000 potentially contaminated land siteswithin Brighton and Hove. Due to this large number, it is not possible toprovide a date when further investigation of those sites listed below will occur.

From the information below it can be seen that the search site has not been prioritised for further investigation under the provisions of the Environmental Protection Act 1990.Additionally, from the maps below, you will see that there no prioritised potentially contaminated land sites at or adjacent to the search address.

However, from the historical maps, it can be seen that there have been changes on the ground at this site, implying that there may be some made ground present which may potentially contain some contaminants of concern.

The records the Council have from East Sussex Fire and Rescue Service listing the sites that were licensed for petroleum fuel storage (the derelict tank register) have also been consulted. There do not appear to be any entries for eitherThe Droveway or Orchard Roadon the latest register (January 2013).

Derelict tank records are held externally so if further information is required, I recommend you make contact with the Petroleum Officer, Mick Huckstepp at East Sussex Fire and Rescue Service on 01323 462130. Please be aware that a charge may be made for any searches requested in writing from East Sussex Fire and Rescue.

Please note that from 1st April 2015, new charges were introduced. There is now a charge of £25 per Environmental Information Regulations 2004 request and then £25 per hour thereafter for requests that take longer than an hour.
