Subject: Immediate Delivery Election for Entries Released Electronically

Distribution: Brokers, filers, importers, carriers and other interested parties

On June 10, 2005, CBP posted ABI administrative message #05-0651 and subsequently the CBP Port of Buffalo disseminated Information Notices dated June 17, 2005 (#05-028) and May 8, 2009 (#09-FO-021), outlining the procedures for election of immediate delivery privileges (19 CFR 142.22 (a)) for entries released via PAPS. Specific programming to enhance this process has not yet occurred, however due automation, the CBPF 3461 and CBPF 3461 ALT are no longer used at release. Therefore, please see the following updated guidance:

Brokers/filers/importers conducting Customs business in the Port of Buffalo, NY, who have notalready elected immediate delivery privileges but wish to do so,may send an electronic notification to the Port of Buffalo Entry Section at ; or notification may be made on company letterhead to postal address:

Notification procedure (blanket):

Customhouse brokers/filers/importers will provide notice to the CBP Port Director, Buffalo, NYthat they are electing to use the immediate delivery privilege on all or part of their entries. They may choose to identify all shipments or specific commodities, importers and/or time frames. Notification to CBP must be made on or before the date of release and CBP will acknowledge your notification. The CBP Entry Section and the filer will retain this notice on file. If no notice is provided the default procedure at the time of release will be entry.

Notification procedure (non-blanket):

For any entry or period of time where the broker/filer/importer wishes to specifically elect either “immediate delivery” or “entry” the Customhouse broker/filer/importer will provide notice to the CBP Port Director, BuffaloNYon or before the date of release and CBP will acknowledge your notification. The CBP Entry Section and the filer will retain this notice on file.
