AFA Files Lawsuit to Compel Arbitration

We mentioned in our latest news on the ‘Grievances – General News’ tab on our website last week, that there was a situation in which we were addressing and would update you.

Today AFA filed a lawsuit against Compass Airlines in the United States District Court for the District of Minnesota in order to compel the arbitration of two grievances that the Company has refused to resolve or arbitrate. You may view a copy of the complaint against Compass by clicking here.

One of the grievances the Company has refused to arbitrate is the FML grievance (No. 67-99-02-28-13). AFA filed this grievance back in 2013, because Compass was denying Family Medical Leave to Flight Attendants in violation of our Contract and Federal Law.

The other grievance the Company has refused to arbitrate is the termination grievance for Flight Attendant Jeanie Montgomery (No. 67-99-02-37-13). Jeanie was unjustly terminated under Section 10 of our Contract at the end of 2013. Compass has refused to arbitrate her grievance, because Jeanie has filed a lawsuit against Compass for her illegal termination under the Family Medical Leave Act.

Compass has no legal basis to refuse to arbitrate either of these grievances, and is violating the Railway Labor Act by refusing to do so. It is AFA's hope that the Company will now agree to arbitrate these two grievances without the need for lengthy litigation. We will keep Flight Attendants updated on this case.
