ABUYER'S PREMIUM A Buyer's Premium of 15% is added to the hammer price on all lots.
BVALUE ADDED TAX All lots in this auction are subject to VAT, with the exception of lots 95 to 98, which are not subject to VAT. Buyer’s Premium is always subject to VAT.
CPAYMENT Balances must be paid in full by 4.30 pm on Thursday 14th May 2009 by cash or bank transfer (our bank details are listed on the next page). If paying by bank transfer please quote your bidder number to assist us.
Cheques will NOT be accepted - NO EXCEPTIONS.
We also accept MasterCard, Access, Visa, Maestro, Switch & Delta cards. WE CANNOT ACCEPT CARDS OVER THE TELEPHONE, AS THE CARDHOLDER MUST BE PRESENT FOR PAYMENT.
We regret to announce that as at 1st July 2008, we have stopped taking Bank Drafts. Unfortunately, they have simply become too problematic to check the authenticity.
DCOLLECTION Collections can only be made after all lots purchased have been paid for in full.
Collection will not commence until approx. 200 lots before the auction ends (at which stage viewing will cease), then on Wednesday 13th May 2009 & Thursday 14th May 2009 from 8.30 am until 4.30 pm each day. Goods will only be released on production of an official "paid invoice".
LOTS NOT PAID FOR & COLLECTED BY 4.30 PM ON Thursday 14th May 2009 WILL BE SUBJECT TO A STORAGE CHARGE OF EITHER £5 PER LOT PER DAY OR 5% OF THE HAMMER PRICE PER LOT PER DAY – WHICHEVER IS THE HIGHER - NO EXCEPTIONS. (FOR FURTHER DETAILS, SEE CLAUSE 5 OF OUR GENERAL TERMS AND CONDITIONS).
Purchasers buy lots where they lie and must bring any necessary labour, lifting tackle and equipment in order to remove their lots. Portering staff are NOT available to assist, only to supervise. See Special Notice Collections page regarding forklift truck availability.
The purchaser shall comply with any directions with respect to the removal of goods, which may be given by the Auctioneers' staff.
ESMOKING No smoking is permitted anywhere upon the premises.
FTRANSFER Lots may not be transferred between buyers, and must be paid for by the successful bidder.
GDESCRIPTIONS The lots are sold 'as they lie' with all faults and errors in description, quantity or measurement (if any). Lots may be new, used, refurbished or not, working or broken, soiled, damaged, incomplete, etc. Boxed goods may not contain any relevant books, manuals, disks, leads, etc, and/or might contain different colours/models/or even different products. We recommend that buyers do not bid unless they have examined lots to their satisfaction prior to doing so - see Clause 9 of our Terms and Conditions - IF IN DOUBT DO NOT BID.
HSHORTAGES There will be no allowance made for any shortages.

JBEWARE At the fall of the hammer the security of the lot is the purchaser's responsibility. The Auctioneer will not be responsible if lots are lost, stolen, damaged or destroyed - they are at the sole risk of the purchaser.
SPECIAL ADDITIONAL NOTES
a.Please note that the white cages, grey tables, plastic boxes, pallets, screens and any other display equipment are the property of the Auctioneers and therefore notincluded in the sale.
b.Lots CANNOT be split. Therefore, when bidding for a lot which consists of more than 1 item (e.g. 4 off video cameras or 25 off rolls of fabric or whatever), the successful bidder must buy the total lot. When selling lots which involve a number of items, we will in some cases ask bidders to bid a price for the whole lot, but in other cases bidders will be asked to bid a price per item. As explained above, bidders must buy lots in their entirety, even if we are asking for bids on a price per item basis.
When selling lots where we ask for a bid per item, the lot price will be calculated by multiplying the price per item, by the number of items stated within the catalogue to be within the lot. The auctioneer will make it clear at the time of bidding which method is being adopted.
c.FOLLOW-ON Buyers should particularly note that in instances where we state “Ditto” or “similar” we will be giving the “follow on option”. This does NOT necessarily mean the items are identical. Furthermore intending buyers should note that it is possible that the follow on option is offered with similar products where some of them have additional accessories and/or components and also that such items may even have specifications which vary to a greater or lesser degree. The catalogue has been prepared in haste with insufficient time for us to check in detail and highlight any such variations – if in doubt adjust your bid accordingly or do not bid.
d.DESCRIPTIONS Before bidding please bear in mind that all quantities, descriptions, sizes and other information are approximate estimates only. Items lotted up for sale are not always checked/counted/measured by us, and additionally typing (and other) errors sometimes occur. Please note that when describing a number of the lots we have had to rely on counts (or estimates), which we have assumed to be accurate for the purpose of cataloguing, but which may well be incorrect in some cases. Bidders are recommended to check lots for accuracy, make their own assessments, and adjust their bids accordingly. Bidders will be charged for the quantity listed in the catalogue - no allowance will be made for shortages. Lots are sold "as seen" - what you see is what you buy. If you are in any doubt, please do not bid.
When selling lots involving quantities of a product, it is possible that there is a variation in colour, style or model between the different items comprising the lot, (which may or may not be pointed out in the catalogue) and buyers are urged to check prior to bidding.
What you buy is the item to which Robson Kay & Co Ltd has affixed the yellow lotting up label, regardless of the description in the catalogue. Errors in description may be minor - for example, a fridge being described as a freezer or vice versa – or they may be more major – for example, a fax machine being described as a photocopier. Buyers are urged to check lots prior to bidding to satisfy themselves as to the accuracy of the description and quantity, and if in any doubt whatsoever, are advised not to bid.
e.VEHICLES – IMPORTANT NOTE Where we have paperwork in connection to the vehicles (e.g., log book, MOT, service history, etc.) copies have been affixed inside the window of each relevant vehicle, for your inspection. As with all lots in the catalogue, it is imperative that bidders check this information, to their satisfaction, prior to bidding. Bidders should not rely solely on the information within the catalogue as an indication to anything whatsoever in relation to the vehicles. If in doubt, do not bid.

In addition to selling for Insolvency Practitioners (liquidators & administrators), we also sell surplus for a store group on a regular basis. These consist of end-of-line, ex-display, water damaged, box damaged, returns, samples, etc.
Whilst to the buyer, the same rules of auction apply to lots we sell for store groups as those we sell for liquidators & administrators, we recognise that many of the items we sell for the store group are electrical, and therefore have more potential to be faulty.
We point out in many sections of the catalogue that descriptions in our catalogues are for guidance only, and that there is no form of comeback in the event of ‘problems’, we have listed below some specific examples of situations that may occur when buying electrical items in our auctions.
- Items which normally include a remote control may be missing the remote control and/or other accessories, whether minor or major.
- We may display one or more of an item in our “powered up display area”. Buyers should not assume because an item is displayed with power that all its features have been tested, or that those boxed-up items which are similar will also power up.
- We detail the specification of computers where possible, normally by using a description from a label on the computer or its box. It is in fact possible that the specification of the item is different from that stated on the label.
- In some instances the item in the box may not be that listed on the outside of the box, and could therefore differ completely from our catalogue description.
In essence therefore, whilst we will always attempt to describe items as accurately as possible, our descriptions are for guidance purposes only, and buyers should examine lots to their satisfaction before purchasing. In the event of any complaint whatsoever, buyers will not be given refunds, cancellation of purchase or any other form of comeback. We would remind buyers that whilst many of the items we sell may be new, they are all sold on the assumption that they are not new. A sale by auction is not a consumer sale and does not give the purchaser any rights such as are available in a retail purchase.
