1.  This permit application is for a church in the R-55 Zone. The property was down zoned from the C-S-C Zone to the R-55 Zone on 11/17/09 by the Marlboro Pike Sector Plan. Permit #3656-99-U was approved for a church by Park & Planning on 5/13/99. A church in the R-55 Zone located on a lot less than 1 acre in size is permitted by special exception. Per Tax Assessments this property is 0.248 acres or 10,803 sq. ft. Since this use legally existed per permit #3656-99-U prior to the Marlboro Pike Sector, the church must be certified as a nonconforming use. 10/14/15 – Ok per PGCPB 15-73.

9/12/13 – Peter called to let me know he will submit the NCU application. I told him to submit the entire completed package.

9/16/13 – Mr. Odagbodo came into the office to submit the certification of nonconforming use package. I briefly went through the package and noticed that the prior certificate of occupancy 3656-99-U was submitted with no issuance date, signature of inspector and it was printed on the form signed by Haitham Hijazi, Building Code Official. E-Permits system indicates permit 3656-99-U was cancelled owner/agent on 12/18/2000. I told Mr. Odagbodo that if he cannot produce an issued certificate of occupancy then the nonconforming use would be referred to the Planning Board.

9/23/13 – Updated permit comments per certification of nonconforming use package:

1.  The justification statement must state that the use of a church has operated on this property from ______to the present without any break in operation for 6 months or more. 10/14/15 – Ok per PGCPB 15-73.

2.  Applicant must submit documentation from 2009 and January 2011. 10/14/15 – Ok per PGCPB 15-73.

3.  The submitted certificate of occupancy 3656-99-U has no effective date or signature from issuing inspector. During my research of the property the e-permitting computer system indicates this permit was cancelled by owner/agent as of 12/18/2000 by William Hamilton. I contacted the Inspectors office and no copy of the certificate was found nor was there any documentation that the certificate of occupancy was issued. All available information submitted by the inspector’s office indicates this permit was voided therefore the applicant should contact Edward Holley at 301-952-3215 to pursue this nonconforming use before the Planning Board or pursue a Special Exception. 10/14/15 – Ok per PGCPB 15-73.

1/15/14 – Peter came into the office and checked the update of this permit. I referred him to Bill Edelin in the inspection office to discussed permit 3656-99-U. See comment #3 above.

1/29/14 – I spoke with Sue Hall and she indicated Mr. Odagbodo is in her office indicating permit 3656-99-U is a valid certificate which was printed in the permits office. Sue confirmed that this is NOT a valid certificate and should not have been printed for this customer.

2/12/14 – I gave permit and NCU package to Edward Holley.
