JANUARY 17, 2006

The Faribault County Board of Commissioners met pursuant to the recess of January 3, 2006 at the Courthouse in the City of Blue Earth at 9:00 a.m. on January 17, 2006. The following members were present: Bill Groskreutz, Loren Lein, Barb Steier, Tom Loveall, and Tom Warmka, Commissioners. County Auditor John Thompson and County Attorney Brian Roverud were also present.

The meeting was called to order Chairman Groskreutz.

Warmka/Steier motion carried unanimously to approve the synopsis and official proceedings of the January 3, 2006 regular meeting.

Public Works Director John McDonald met regarding office business.

Warmka/Lein motion carried unanimously to purchase a 2006 tandem truck from Boyer Ford Sterling for $60,940.37 from the state contract.

Warmka/Steier motion carried unanimously to purchase a loader from Ziegler Caterpillar for $149,446.13 from the state contract.

Loveall/Warmka motion carried unanimously to approve Resolution 06-CB-05 in support of a constitutional amendment to dedicate motor vehicle sales tax revenue to the transportation fund. Commissioners Groskreutz, Lein, Loveall, Steier, and Warmka voted yes.

R E S O L U T I O N

WHEREAS, Minnesota’s transportation infrastructure forms the backbone of the state’s economy and has a direct impact on future economic development;

WHEREAS, too many Minnesotans are being killed in traffic crashes on dangerous roadways;

WHEREAS, funding for highway and transit systems in Minnesota has remained stagnant and is failing to keep pace with growing population and growing demands;

WHEREAS, local governments throughout the state are struggling to maintain local transportation systems while the state’s gas tax has not been increased since 1988 and transit budgets have been cut in recent years;

WHEREAS, the Minnesota Legislature has repeatedly turned to revenue from the motor vehicle sales tax, which has been viewed as user fee revenue, in order to fund both highway and transit systems including the current dedication of 54% of motor vehicle sales tax for transportation purposes;

WHEREAS, the legislature passed a proposed constitutional amendment during the 2005 Legislative Session that would appear on the ballot November 7, 2006 asking voters if the remaining 46% of motor vehicle sales tax revenue currently used for other purposes should be used for highways and transit systems;

WHEREAS, passage of this amendment would mean an increase in stable revenue for highway and transit systems throughout the state that would rise to approximately $300 million per year once the transfer of revenue is fully phased-in by 2011;

NOW, THEREFORE, BE IT RESOLVED, that Faribault County supports passage of the proposed amendment to the Minnesota Constitution dedicating all of the motor vehicle sales tax revenue to transportation with 40% of the revenue for public transit assistance and 60% of the revenue for highway purposes.

Steier/Lein motion carried unanimously to appoint Commissioners Tom Warmka and Tom Loveall a gravel pit committee.

Ralph Prescher, Vic Vriesen, and Dick Millo of Interfaith Caregivers met regarding their organizations activities. Transportation, respite care, caregiver coaching, telephone visits, meal preparation and delivery, administration of Rose grant, and funding sources were discussed. A 2007 budget request was made for region-wide transportation system and coordination of $10,000.

Steier/Warmka motion carried unanimously to designate February as Interfaith Caregivers Month.

Feedlot and Zoning Technician Bruce Blakesley met regarding office business.

Steier/Lein motion carried unanimously to approve Resolution 06-PZ1-06 granting a conditional use permit to Allied Equipment/Scott Greimann in Section 26 of JoDaviess Township. Commissioners Groskreutz, Lein, Loveall, Steier, and Warmka voted yes.

R E S O L U T I O N

CONDITIONAL USE PERMIT

ALLIED EQUIPMENT / SCOTT GREIMANN

WHEREAS, Allied Equipment / Scott Greimann applied for a conditional use permit under the Faribault County Zoning Ordinance requesting a permit for a Minnesota Vehicle Dealer’s License and Sales on an existing farmstead in the A-2 General Agriculture District, located at the following described property:

The Northeast Quarter (NE ¼) of Section Twenty-six (26) , Township One Hundred Two (102) North, Range Twenty-eight (28) West, Jo Daviess Township, Faribault County, Minnesota.

WHEREAS, the planning commission finds:

a. that the conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity, and is compatible with the existing neighborhood;

b. the establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding vacant property for uses predominant in the area, conforms to the comprehensive land use plan of the county;

c. that adequate utilities, access roads, drainage and other necessary facilities have been or are being provided;

d. the soils conditions are adequate to accommodate the proposed use; and

e. the use is of the same general character as other conditional uses in the Agriculture District and will not be detrimental to the general health and welfare of the county.

f. that proper facilities are provided which would eliminate any traffic congestion or traffic hazard which may result from the proposed use.

NOW THEREFORE BE IT RESOLVED, the Faribault County Board of Commissioners approve the conditional use permit for Allied Equipment/Scott Greimann for a Minnesota Vehicle Dealer’s License and Sales on an existing farmstead located in theA-2 General Agriculture District with the following conditions:

1. A maintenance fee of $50.00 shall be paid to the Zoning Office every two years starting January 3, 2008.

2. The conditional use permit is non-transferable.

Lein/Loveall motion carried unanimously to approve Resolution 06-PZ2-07 granting a conditional use permit to South Central Minnesota Youth for Christ in Section 8 in Foster Township. Commissioners Groskreutz, Lein, Loveall, Steier, and Warmka voted yes.

CONDITIONAL USE PERMIT

SOUTH CENTRAL MN YOUTH FOR CHRIST

WHEREAS, South Central MN Youth for Christ applied for a conditional use permit under the Faribault County Zoning Ordinance requesting a permit for development of a church into a Prayer Retreat Center in the R-2 Shoreland Residential District, located at the following described property:

The Northwest Corner of the Southwest Quarter (SW ¼ ) of Section Eight (8), Township One Hundred Two (102) North, Range Twenty-four (24) West, Foster Township, Faribault County, Minnesota.

See Exhibit A.

WHEREAS, the planning commission finds:

a. that the conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity, and is compatible with the existing neighborhood;

b. the establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding vacant property for uses predominant in the area, conforms to the comprehensive land use plan of the county;

1. A maintenance fee of $50.00 shall be paid to the Zoning Office every two years starting January 3, 2008.

2.  A letter of recommendation from the owner or a representative to grant the conditional use permit. The letter needs to be on file before January 17, 2006.

3.  Need a lease agreement for a septic system.

4.  Must meet all state, federal and county regulations on people staying over night with sleeping quarter accommodations for 25 people maximum.

5.  The conditional use permit is non-transferable.

Warmka motion to review conditional use permit annually died for lack of a second.

Loveall/Warmka motion carried unanimously to approve the board chair’s signature on the pay equity report.

Steier/Warmka motion carried unanimously to approve request from T. Duit to attend CornerHouse forensic child abuse interview training in Minneapolis.

Warmka/Steier motion carried unanimously to approve Resolution 06-CB-08 that designates Prairieland to administrate the hauler-collected service fee program. Commissioners Groskreutz, Lein, Loveall, Steier, and Warmka voted yes.

R E S O L U T I O N

WHEREAS, Faribault County (“County”) is a member of the Prairieland Solid Waste Board (“Prairieland”), which was established through a Joint Powers Agreement (“Agreement”) with Martin County; and

WHEREAS, Prairieland owns and operates the Prairieland Compost and Resource Recovery Facility (“Facility”) in Truman, Minnesota that composts and otherwise recovers resources from solid waste generated by residences, businesses, and institutions in the County and helps reduce reliance on landfills for management of solid waste pursuant to direction to the County under the Minnesota Waste Management Act (Minn. Stat. Chap. 115A); and

WHEREAS, the County amended its Solid Waste Service Fee Ordinance (“Ordinance”) in 2005 to implement a hauler-collected service fee on waste generators based upon the amount of solid waste generated by each entity that has solid waste collection service, effective January 1, 2006; and

WHEREAS, Section V.3.B of the Ordinance permits the County to contract with Prairieland to administer the hauler-collected service fee program and the County already has a Solid Waste Services Agreement with Prairieland.

NOW, THEREFORE, BE IT RESOLVED, that the County hereby designates that Prairieland shall administer the hauler-collected service fee program pursuant to Section V.3.B of the Ordinance and the Solid Waste Services Agreement.

Law Enforcement Center discussion was held regarding the visit to the Steele County Detention Center. Testing of geothermal was also discussed.

Steier/Lein motion carried unanimously to approve a test well at the proposed site of the Law Enforcement Center and to accept the cost, sharing with Blue Earth Light and Water if available.

Steier/Loveall motion carried unanimously to authorize the Sheriff to implement a Pay to Stay fee to all eligible inmates per statute.
