AN ORDINANCE OF THE TOWN OF ROCKFORD, WRIGHT COUNTY, MINNESOTA REGULATING USE OF LAND FOR TRADE, INDUSTRY, RESIDENCE AND OTHER PURPO S E S - REGULATING THE PERCENTAGE OF LOT WHICH MAY BE OCCUPIED, SIZE OF YARDS AND OTHER STRUCTURES REQUIRING BUILDING PERMITS AND PROHIBITING BUILDING WITHOUT PERMITS PROVIDING FOR ADMINISTRATION AND ENFORCEMENT THEREOF AND REGULATING PUBLIC DUMPS, JUNK YARDS AND TRAILER COURTS.
The Town Board of the Town of Rockford of Wright County, Minnesota, ordain, as follows:
Section 1. The Town Board does hereby find that more than 70% of the voters voting on the question provided by Section 366.11 M. S. A. duly voted at a lawful town meeting in favor of authorizing the Board of Supervisors to adopt building and zoning regulations and restrictions.
Section II. A. Trailer coach park as used herein shall mean any site, lot, field or tract of land upon which two or more occupied trailer coaches are harbored, either free of charge or for revenue purposes and shall include building, structure, tent, vehicle or enclosure used or intended for use as part of the equipment of such trailer coach park.
B. No trailer coach park shall be operated or maintained in said town except insofar as the operators thereof have procured a permit from said town and town board thereof and have in all respects complied with all state laws and procured a state annual license. The permit shall be required annually in coordination with the granting of a state license, therefore. Application for permit shall be filed with the Town Clerk and no fee shall be required, therefore, the licensee paying whatever state fees, licenses and taxes required. This permit shall not be required of any trailer coach park which was established prior to the effective date of De-
cember 1, 1959, Chapter 428 of the Laws of Minnesota.
Section III: A. A public dump shall be deemed to be any dump or area maintained for the deposit of rubbish, trash, refuse, waste material, junk for the use of any persons or for the deposit of any such trash other than by the owner of such area for his own purpose.
B. No person shall maintain or operate a public dump without annually procuring a permit, therefore, from said town. Application for permit shall be in writing filed with the town clerk and accompanied by an annual fee in the sum of $5.00 and shall be approved or rejected by the town board. Any dump operated hereunder shall be maintained in a sanitary and healthful fashion and if at any time the same becomes a public nuisance the permit may be forthwith revoked and the operation thereof abated.
Section IV: Building Permits. No person may erect any structure of either reasonable value or cost of one thousand dollars or more as a dwelling, garage, place of commercial business or industrial activity or for any purpose within said town nor make any alteration of such a structure if such alteration will either cost or be of reasonable value of one thousand dollars or more without first procuring a building permit therefore. Applicant shall file such application with the Clerk of said town in which application he shall show the nature of the structure to be built, estimated cost and purpose and sufficient information to show that it complies with pertinent law; he shall file a fee of $5.00 with such application. If it appears the proposed structure or alt~ration is lawful and compIles with pertinent statutes and ordinances and codes, the town board shall thereupon grant such application and the town clerk shall issue a building permit therefore.
Section V: A. Junk yard is hereby defined as any area used for the handling, storing, processing or dealing in used metals, scrap iron, wrecked automobiles or automobiles held for wrecking or dismantling.
B. No one shall maintain a junk yard in said town unless he has first annually procured a permit therefore as hereinafter provided. Applicant shall file an application therefore with the Clerk of said town with a fee of $5.00 and a description of the proposed project. If the same appears proper and lawful and not to be a public nuisance the town board shall grant such application and the Clerk shall issue a permit therefore. This permit shall be on an annual basis.
C. This section as to junk yards shall not apply to any junk yard now in operation in said town but shall prohibit any extension thereof without annual permit and if such present junk yard is or shall become a public nuisance the same shall be illegal and this section shall not be deemed to have authorized the same.
Section VI: No building shall hereafter be erected in said district unless thereby provided a front yard of not less than 50 feet in depth from the nearest building line to any county or state highway easement line and a front yard of not less than 35 feet in depth from the nearest building line to any other street or highway easement line and a side yard on both sides of not less than 15 feet from the nearest building line to the nearest lot or property line, nor shall the same be erected on any lot or plat which is smaller than 75 feet in width or 13,000 square feet in area.
Section VII: The town board does not hereby zone fhe above town into zoning districts and all of the above regulations shall apply to the entire area of Rockford Town of Wright County, Minnesota. The Town Board reserves the right and authority to zone the town.
Section VIII: Any person, firm or corporation who shall violate any of the provisions of this ordinance upon conviction therefore shall be punished by a fine of not to exceed $100.00 and costs or by imprisonment in the county jail for not to exceed 90 days. Each day of violating any provision of this ordinance shall be deemed a separate offense and violation thereof.
Section IX: If any section
or part of this ordinance shall, for any reason, be held invalid by a court of competent jurisdiction, a such decision shall not affect the remaining parts and provisions of this ordinance and such remaining parts and provisions shall continue to be in full force and effect.
Section X: This ordinance shall be in force from and after its passage and posting pursuant to law.

ORDINANCE NUMBER 2 NOTICE That the Town of Rockford has adopted an
ordinance Number Two regulating the construction and use of buildings and structures, adopted a plumbing code, a water supply and well code and a sewage disposal code and that copies thereof are available at the office of the Town Clerk for general distribution to the public.
NOTICE IS HEREBY GIVEN That the Town of Rockford of Wright County, Minnesota, has adopted ordinance Number Two regulating the construction and use of buildings and structures, and adopted a plumbing code, a water supply and well code and a sewage disposal code. The same having been duly adopted by ordinance dated April 18, 1960, by the Town Board thereof, and that copies of said ordinance are available at the office of Herbert Beise, Town Clerk in said township, and anyone desiring may have a copy of the same.
