INFORMATION NOTE ON THE PROCEDURES FOR OPERATORS ON THE TRADE OF ANIMAL BY-PRODUCTS (ABPS) AND DERIVED PRODUCTS IN ACCORDANCE WITH ARTICLE 48 OF EU REGULATION 1069/2009

TRADE IN ARTICLE 48 ABPS FROM OTHER MEMBER STATES TO THE REPUBLIC OF IRELAND

·  An operator from another Member State intending to dispatch Article 48 ABPs to the Republic of Ireland should contact the Milk & Meat Hygiene/ABP Division of the Department of Agriculture, Food and the Marine (tel. 057 869 4345) for an application form (also available on the website: http://www.agriculture.gov.ie/agri-foodindustry/animalbyproducts/tradeinanimalby-productsunderarticle48ofregulation10692009). The operator must also notify the Competent Authority of Member State origin of their intention to dispatch the ABP.

·  When this application form is fully completed, it should be submitted to Milk & Meat Hygiene/ABP Division, Department of Agriculture, Food and the Marine, Grattan House, Grattan Business Centre, Portlaoise, Co. ·  The Department of Agriculture, Food and the Marine must respond within 20 days of receipt of a fully completed application form. The signed, stamped application form will be returned to the operator advising if load is accepted, rejected or accepted with conditions. A copy of this authorisation form including any conditions will also be returned to the Member State of origin. Where the application is accepted, the default authorisation period will be for 12 months unless otherwise specified.

·  Where an application is received for cattle or pig manure for the purposes of land application at the place of destination, the Competent Authority of the Member State of origin must communicate its agreement to such trade.

·  Where the application is accepted, the Department of Agriculture, Food and the Marine will issue a letter to the plant/farm of destination as specified on the application form, stating that authorisation has been granted to XX operator from XX MS for trade of XX ABP to their plant/farm for XX duration of time and advising them of any conditions attached to the authorisation.

·  The haulier of the ABP material must be registered as an ABP haulier with Milk & Meat Hygiene/ABP Division of the Department of Agriculture, Food and the Marine.

·  The load consignment must be transported in compliance with the ABP Regulations, i.e. covered, leak-proof, clean, etc.

Controls And Documentation Required

·  Article 48 of Council Regulation 1069/2009 requires the receiving Competent Authority (the Department of Agriculture, Food and the Marine) to be informed by the Competent Authority at the point of dispatch of the details of each consignment prior to export. The authorisation holder must therefore ensure that the sender of the animal by-products advises their Competent Authority which will then notify the Department of Agriculture, Food and the Marine by means of the TRACES system.

·  The recipient must be notified that the following documentation must be kept for at least 2 years:

-  A copy of the commercial document which accompanied the ABP;

-  The date each consignment was received;

-  The quantity of ABP received.

The recipient plant/farmer must also be informed that they must notify their Regional Veterinary Office (RVO) within one working day of the arrival of each consignment.

·  The RVO must return TRACES message to acknowledge receipt of consignment.

DAFM Veterinary staff will perform checks on plants/farms where animal by-products have been received to ensure compliance with trade requirements.

Trade in Manure from Northern Ireland

The basic requirements for the trade of poultry manure from Northern Ireland to the Republic of Ireland are as follows:

· The farm of origin in the north must submit the application form in Annex XVI (Ref 1097/20120) to Milk & Meat Hygiene/ABP Division of the Department of Agriculture, Food and the Marine in order to get authorisation for this trade.

· Once authorisation is received, the farmer in NI must obtain a health certificate for the consignment from the Department of Agriculture and Rural Development (DARD) and this document must accompany the load consignment.

· An ABP commercial document must also accompany the consignment. During transportation, the ABP material must be accompanied by a fully completed commercial document in accordance with EU Regulation 142/2011, Annex VIII, Chapter III. The document must include the actual weight of the material to be traded, or, in the case of whole carcasses, the number of these and the species from which they were derived. The document must also give a description of the number of containers and their marking and should be kept for a period of 2 years.

· The farmer from NI must ensure that arrangements are made with DARD for an official TRACES message to be sent for the load to the RVO of the recipient.

·  The recipient farmer is also sent a copy of the Guidance document on the land spread of poultry manure.

·  In the case of all manures, the recipient farmer must be informed that:

a)  the manure must be applied directly to land at the farm of destination;

b)  the following records must be kept;

-  The health certificate which accompanied the manure

-  A copy of the commercial document which accompanied the manure

-  The date each consignment was received

-  The quantity of manure received

-  The name and address of the premises of origin

-  A record of the lands to which the manure has been applied.

TRADE IN ARTICLE 48 ABPS TO OTHER MEMBER STATES FROM THE REPUBLIC OF IRELAND

Where an operator wishes to trade Article 48 ABP to another member state they should contact the relevant Competent Authority (CA) in that state and send the application directly to the CA. A copy of the completed application form must also be sent to the Milk & Meat Hygiene/ABP Division, Department of Agriculture, Food and the Marine, Grattan House, Grattan Business Centre, Portlaoise, Co. Laois.
