Terms and Conditions of Entry

  • The “I heart DSITA Ekka competition” (“Competition”) is conducted by the State of Queensland through the Department of the Science, Information Technology, Innovation and the ArtsABN 65 959 415 158 (“the State”).
  • Information on how to enter and the prizes form part of these Terms and Conditions of Entry (“Terms and Conditions”). By entering the Competition, the Entrant accepts the Terms and Conditions.

How to enter

  • The Competition commences at 8.00 amon Thursday 8 August 2013. Entries close at midnight on Saturday 17 August 2013 (“the Closing Date”).
  • To enter the Competition, before the Closing Date Entrants must:

-visit the DSITIA stand at the Ekka

-create a sign and write why you ”heart” science, IT, innovation or the arts

-go into the photo booth and display your sign in a photo

-take a photo of your photo (or a separate photo with your sign) and upload your photo on Twitter, Facebook or Instagram using #iheartDSITIA (“the Entry”).

  • Any Entry received after the Closing Date will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected Entries.
  • Entrants must not enter more than once.

Eligibility

  • Entry is open to persons aged thirteen years and over (subject to the consent of their parent or guardian for persons under eighteen years)(“the Entrant”).
  • For Entrants aged under eighteen years, the onus is upon the Entrant (not the State) to obtain the consent of a parent or guardian.
  • Employees of the Department of the Science, Information Technology, Innovation and the Arts and their immediate familiesare ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child, parent or step-parent.

Prize

  • There are 5 individual prizes to be won.
  • Each winner will receive one double complimentarypass (“Prize”) to performances at QPAC from the following:

-2 x double passes toChitty Chitty Bang Bang

-2 x double passes to The Rocky Horror Show

-1 x double pass to The Nutcacker

  • The value of each individual Prize is up to $300 (inclusive of GST).
  • The Prize will be valid for the duration of the show, including:

-Chitty Chitty Bang Bang: from 19 November to 8 December 2013

-The Rocky Horror Show: opening 31 December 2013

-The Nutcacker: 6 to 21 December 2013

  • Seats are subject to availability and will be allocated by QPAC and the winner is responsible for contacting QPAC and to request the preferred session (as per instructions outlined on a letter that will be sent to each winner).
  • The Prize excludes travel to and from QPAC and any other costs of a personal nature not stated.
  • Any change in the value of any Prize occurring between the publishing date and date the Prize is claimed is not the responsibility of the State.
  • Prizes are not transferable or exchangeable, and cannot be taken as cash.
  • The State does not make any representations about the quality or functionality of any Prize, nor is it endorsing the Prizes or any party associated with the Prizes.

Judging

  • All entries will be collated and allocated a number and the winners will be drawn randomly using a random number generator, such as
  • The winners will be notified via the social media channel they uploaded the photo to within three (3) business days of the drawing of the Prize and winners will be required to contact the State within ten (10) business days to redeem their Prize.If the winners do not contact the State within ten (10) business days to redeem their Prize, they forfeit their claim, and another random winner will be drawn and notified for that Prize.
  • QPAC performance preferences will be given to winners on a first come, first served basis on who contacts the State first in order to claim their Prize.
  • If the winners do not contact the State within 10 working days to redeem their prize another random winner will be drawn and notified.
  • The winners’ names will be publishedvia a news items on the DSITIA internet – – by the end of August 2013.
  • The State’s decision on the winner of the Competition is final and no further correspondence will be entered into.

Entrant’s consents and warranties

  • By submitting the Entry, the Entrant warrants to the State that the Entrant is the sole owner of the copyright in the Photo, and grants the State a paid up, non-exclusive, non-transferrable, irrevocable, perpetual licence (including the right to sub-licence) in respect of any Photo or submitted material; to use, reproduce, adapt and exploit and otherwise exercise all intellectual property rights (including to publish) for any purpose connected with the Competition. The Entrant also consents to any act that might otherwise constitute an infringement of their ‘moral rights’ under the Copyright Act 1968 (Cth).
  • The Entrant warrants and agrees that the Entrant must not post or submit any material in the course of the Competition that the State considers to be or may deem to be in breach of any intellectual property, privacy, publicity or other rights, or which is obscene, derogatory, fraudulent, indecent, harmful, harassing, threatening, abusive, defamatory, vulgar, pornographic, sexually inappropriate, or otherwise unsuitable for publication.
  • The Entrant uses Facebook, Twitter or Instagram (‘social media’) entirely at their own risk, and acknowledges that they may be subject to separate terms and conditions in using social media.
  • The Entrant also consents to the State providing personal details and a copy of the Photo to the State’s appointed public relations company for its use in the abovementioned purposes. The Entrant accepts that media may contact them to discuss the Entry.
  • The Entrant acknowledges and agrees that:

a)their personal information will be collected by the State for the purpose of coordinating/ administering the Competition;

b)their Photo may be put on display at the DSITIA Show stand;

c)the personal information of any other persons featured in a Photo will be collected by the State for the purpose of coordinating/administering Competition and/or display at the DSITIA Show stand. It is the Entrant’s responsibility to ensure that any other person featured in the Photo consents to this collection and use of their personal information; and

d)if the Entrant wins a prize, the Entrant consents to the State publishing their name in connection with the Competition in current or future promotional materials.

General

  • Compliance with any lawful requirements is the responsibility of the Winnerand their companions.
  • If this Competition is compromised in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the State, the State reserves the right in its sole discretion to modify, suspend, terminate or cancel the Competition.
  • To the full extent permitted by law, the State is not liable for any injury, damages, expenses or loss whatsoever (including but not limited to indirect or consequential loss) to persons or property by reason of any act or omission, deliberate or negligent, by the State, or its officers and agents in connection with participation in the Competition or the arrangements for supply, or the supply, of any prizes to the winners of the Competition.
  • Except for any liability that cannot by law be excluded, the Entrant releases the State (including its officers and agents) from, and grants indemnity against, all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way from the Competition.
  • The State reserves the right to amend the Terms and Conditions at any time until the Closing Date.
  • To the full extent permitted by law, no person is entitled to claim compensation or loss from the State for any matter arising out of the Competition, including but not limited to a failure by the State to comply with the Terms and Conditions.
  • The State’s decision in relation to any aspect of the Competition is final and binding on every person who enters.
  • The State reserves the right to accept or reject any Entry at its sole discretion.
  • If the Entrant breaches these Terms and Conditions, the State may immediately terminate their Entry and/or involvement in the Competition.
  • The Terms and Conditions will be governed by the laws of Queensland.
