ORDER – SAC v. YAGOBI ET AL.
COMPLAINT NO: 2012-0011
By the authority vested in Section 8906 of Chapter 1 of Title 25 of the Unconsolidated Laws and the regulations promulgated thereunder and after concluding an open meeting of the State Athletic Commission (“SAC”) on March 26, 2014, it is hereby found and ordered that:
- A hearing was held on June 5 and October 24 and 31, 2013 before Hon. Roger Schneier, an Administrative Law Judge (“ALJ Schneier”) appointed by SAC to preside over the complaint in the Matter of SAC v. Yagobi et al. Pursuant to the complaint, SAC alleged, inter alia, that the Respondent Yagobi engaged in acts detrimental to the interests of boxing by failing to cooperate with an investigation being conducted by SAC and by providing false information to SAC during an investigation.
- At the conclusion of the aforementioned proceedings, ALJ Schneier issued a non-binding decision and order to SAC which opined, in part:
It is clear that the respondents’ conduct in this matter was detrimental to the interest of boxing. In the face of a lawful inquiry by the State Athletic Commission into a complaint made against them by a boxer the respondents submitted a fraudulent affidavit and declined to supply financial documents pertinent to their dealing with the complaining boxer, and then falsely tried to place the blame on their attorney. Such conduct cannot be condoned as it tends to undermine the entire regulatory scheme established by the Legislature to protect the integrity of professional boxing, and, I find, is too serious to be dealt with the imposition of just a fine.
- As a penalty, ALJ Schneier recommended that Mario Yagobi and Boxing 360 Promotions LLC’s: “license as a professional boxing promoter be revoked and that any contractual relationship they may have or claim within the jurisdiction of the State Athletic Commission be declared void.”
- After reviewing all the facts and circumstances of this matter, the members of SAC hereby accept the recommendation of ALJ Schneier in its entirety.
