WHEREAS, the Bernards Township Committee adopted Resolution #090411 on November 10, 2009 awarded a professional services contract toBeth A Pochtar, P.E. N.J. Lic # 24GE03610800 of the firm Andrew F. Anderson Consulting Structural Engineers, 59-65 Minebrook Road, Bernardsville, NJ 07920 for professional engineering services for condition of exterior structural columns; and

WHEREAS, the Bernards Township Committee on April 13, 2010, passed resolution # 2010-0159 requiring a time extension in the performance of professional engineering services for condition of exterior structural columns; and

WHEREAS,Beth A Pochtar, P.E. N.J. Lic # 24GE03610800 of the firm Andrew F. Anderson Consulting Structural Engineers, requires an additional time extension in the performance of engineering services for the Bernards Township Library due to contractor performance.

NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Bernards that an extension of contract be awarded toBeth A Pochtar, P.E. N.J. Lic # 24GE03610800 of the firm Andrew F. Anderson Consulting Structural Engineers, 59-65 Minebrook Road, Bernardsville, NJ07920until March 31, 2011, at no additional cost to the town.

Explanatory Statement:
In May 2010 Fratesi Masonry & General Contractors, LLC, contracted to demolish and rebuild the column near the front entrance to the Library. Fratesi demolished the upper section of the column on July 26 and erected a temporary support for the roof overhang. Repeat requests from Beth Pochtar, the Structural Engineer from Andrew Andersen, and from me did not achieve any results and Mike Fratesi (the owner) eventually stopped picking up our phone calls.
On September 1, 2010, Township Attorney John Belardo wrote to Mike Fratesi at Fratesi Masonry and wrote that Fratesi is in default of the contract unless he (John Belardo) hears from Fratesi within five days. If he does not “BernardsTownship will declare the contract terminated and will make no payments to Fratesi for any work done to date.”
The Structural Engineer has remained involved and made suggestions to shore up the temporary column when hurricane winds were predicated for Labor Day weekend. At this time, we need to have one of the other two vendors who submitted quotes, resubmit a quote that will deduct the cost of the partial demolition from the new quote. Structural Engineer Beth Pochtar will oversee the rebuilding of the column and requires preliminary drawings from the vendor to insure that the work will be completed correctly.
Because of this delay, the Library needs another time extension to have this project completed.
