HOLD HARMLESS AND RELEASE OFFIBER ENERGY PRODUCTS AR, LLCWNFAF,LLC

A. The undersigned for himself/herself and all persons under his/her direction and control, including minor children, does acknowledge the inherent dangers associated with equestrian activities and the unpredictable behavior of animals such as horses and cattle in connection with the use and enjoyment of the facilities at the Josey Ranch or when participating in any off-premises related activity. The undersigned, stipulates, acknowledges and agrees that: (______)(initial)

1. The Contestant is an experienced rider and has the ability to ride, stop and control the Contestant’s horse safely; and

2. Contestant agrees to abide by all rules and regulations imposed by Fiber Energy Products AR, LLC., WNFAF,LLC., and Hero’s Arena, their agents, employees, instructors and/or anyone acting on their behalf, including, but not limited to the rules and regulations which are attached hereto as Exhibit “A” and incorporated herein as though listed verbatim; and

3. Fiber Energy Products AR, LLC, WNFAF,LLC and Hero’s Arena, and their agents, servants, employees, instructors, organizers, officers, directors, sponsors, officials, and/or anyone acting on their behalf or at their direction are authorized to seek medical treatment for the below named student in the event of emergency. Any pre-existing medical conditions and/or any medications to which the applicant/rider may be allergic are listed as follows:

B. In consideration of the privileges afforded the Contestant as listed aboveand other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged and confessed, the undersigned, as and/or for the Contestant does:

1. Hereby release and agrees to indemnify FIBER ENERGY PRODUCTS AR, llc., WNFAF,LLC., and hEROS ARENA, and their agents, servants, employees, instructors, organizers, officers, directors, officials, sponsors and/or anyone acting on their behalf or at their direction from any and all claims, actions or causes action for injury (including death) to the Contestant and/or the horse the Contestant is riding and from loss or damage to other personal property in the possession of and/or owned by student/rider; and (______) initial

2. The undersigned has read and voluntarily signs this release and waiver of liability and indemnity agreement and further agrees that no oral representations or statements of inducements apart from the foregoing written agreement have been made; and

3. The undersigned parent/guardian has authority to sign this HOLD HARMLESS AND RELEASE on behalf of theContestant listed above.

LIMITATION of LIABILITY for GUESTS of RIDERS/STUDENTS and MINOR CHILDREN: (____) initial

The undersigned agrees that any and all minor children must be accompanied and supervised by a parent or legal guardian at all times while on the property of Hero’s Arena in Natural Dam Arkansas, or when participating in any off-premises related activity, and accepts full responsibility for their safety.

The undersigned hereby releases and agrees to indemnify Fiber Energy Products, AR, LLC, WNFAF,LLC,and Hero’s Arena, and their agents, servants, employees, instructors, organizers, officers, directors, sponsors, officials, and/or anyone acting on their behalf or at their direction from any and all claims, actions or causes of action for injury (including death to the undersigned or to any person or persons accompanying the undersigned) whether minor or adult.

The undersigned has read and voluntarily signs this release and waiver of liability and indemnity agreement applying to any person or persons (whether minor or adult) accompanying (the contestant as named on the foregoing page) and further agrees that no oral representations or statements of inducement apart from the foregoing written agreement have been made.

The undersigned acknowledges, for himself/herself and for all persons under his/her management or control, including minor children, the inherent dangers associated with equestrian activities and the unpredictable behavior of animals such as horses and cattle and in the use and enjoyment of the facilities at the Hero’s Arena or when participating in any off-premises related activity, hereby agrees to use extraordinary care and prudence in his/her activities and does further agree to abide by all rules and regulations imposed by Fiber Energy Products AR, LLC.,WNFAF, LLC., and their agents, servants, employees, instructors, organizers, officers, directors, sponsors, officials, and/or anyone acting on their behalf or at their direction. I acknowledge receipt of the rules pertaining to Josey Enterprises, Ind. by the execution of this application.

MODEL RELEASE & PERMISSION TO PUBLISH: (______) initial

I hereby give Fiber Energy Products AR, LLC.,and WNFAF, LLC., their photographers, writers, legal representatives, sponsors and assigns, the right and permission to publish and reproduce without charge, photographs, motion pictures, video tape images, and interview contestants. Said photographs, motion pictures, video tape images and interviews may be used in publications, audio visual presentations, promotional literature, advertising, calendars, or in any other manner so chosen by the above named parties.

Warning: Under Arkansas Law (Code 16-120-201), an Equine Activity Sponsor or Professional shall not be liable for any injury to, or the death of a participant in Equine Activities resulting from the inherent risk of Equine Activities.

**If persons other than parents sign, (Guardian or proof of Guardianship) must be attached. If only one parent signs, proof of custody must be attached or student must be 18 years old.
