SUBJECT: Response To The Report Of The 2005-2006 Santa Barbara County Civil Grand Jury Entitled “Legal Services In Santa Barbara, Very High Prices For Comprehensive Representation”

RECOMMENDATION:

That Council authorize the Mayor to provide the City Council’s Response to the report of the 2005-2006 Santa Barbara County Civil Grand Jury entitled “Legal Services in Santa Barbara, Very High Prices for Comprehensive Representation.”

DISCUSSION: State Penal Code Section 933(c) requires that the “governing body” of each public agency which is the subject of a report from the county civil grand jury comment on those findings and recommendations contained in the report which are relevant to that particular public agency. Attached is a draft response that the City Attorney’s office is suggesting is appropriate in response to the Santa Barbara County Civil Grand Jury 2005-2006 report concerning "Legal Services in Santa Barbara, Very High Prices for Comprehensive Representation." The recommended Council action would authorize the Mayor to send the attached cover letter and the required more detailed Grand Jury response attached to it. The attached is, of course, merely a suggested draft and may be edited or expanded as the Council deems appropriate.

The City Attorney is obligated by law to respond directly to the Grand Jury Report as well – our response will be very similar to this draft. That is, it will be edited only to delete the references to the City Council and to make it clear that response is from the Santa Barbara City Attorney.
