Subject : Diversion of posts of JTO from DR quota to 35% Departmental quota – orders of the Hon’ble High Courts of Punjab and Haryana in CWP No. 5608/2007 dated 30.05.2008 – regarding.

We are constrained to bring to your kind notice that BSNL Pers-IV section in the above cited reference and subject matter has issued order that there will be no further diversion of DR quota posts to 35% deptt. quota whereas earlier BSNL Board on 30.03.2001 took a decision to divert 500 JTOs posts every year from DR quota to 35% deptt. quota to promote qualified TTAs as JTOs. As per the decision of BSNL Board, 3500 posts of JTOs were diverted from DR quota to 35% deptt. quota for promoting these qualified TTAs to JTO cadre.As you know still about 2500 qualified TTAs are waiting for their promotion to JTO but as per the above BSNL Management Committee decision in its 104th meeting dated 04.11.2008 there will be no further diversion of DR quota posts to 35% deptt. quota has created a situation wherein remaining qualified TTAs will not get promotion as JTO. It has caused serious frustration and demoralization amongst them.

BSNL Management has taken the decision in pursuant to the orders of Hon’ble High Courts of Haryana and Punjab in CWP No. 5608/2007 dated 30.05.2008 whereas to safeguard the interest of 2500 remaining qualified TTAs and honouring the commitment for promoting them as JTO in BSNL the matter could have been taken up in the double bench of the Hon’ble High Courts of Haryana and Punjab and thereafter to Hon’ble Supreme Court if required but instead of challenging the judgments of Hon’ble High Courts of Haryana and Punjab in the higher bench/court, BSNL Management preferred to implement the judgments to the great disadvantage of the qualified TTAs who are waiting for their promotion as JTO for the last 6-7 years and working as JTO officiating in so many Circles.

We would therefore request you to kindly intervene in the matter so that as one time measure on restructuring basis the 2500 TTAs posts are upgraded to JTOs posts on matching saving concept and these qualified TTAs who are presently working as JTO officiating are regularly promoted as JTOs.
