This Sewer Division F.O.G. (Fats, Oils, Grease) Agreement (“Agreement”) is entered into between each of the undersigned owners of real property, and the City of Kirkland, in consideration of approval by the City of a permit under City of Kirkland File/Permit No. for the hereinafter described real property in Kirkland, King County, Washington.

Each undersigned business owner (“Business Owner”)and property owner (“Property Owner”) hereby represents and warrants that the business operating on the Property is not dispersing more than the allowable amount of F.O.G. (Fats, Oils, and Grease) into the waste water system in the City of Kirkland and therefore requests to be exempt from the requirement to install a grease trap or interceptor. Business Owner and Property Owner understand and acknowledge that pursuant to Kirkland Municipal Code 15.36.030, it is unlawful to discharge or cause to be discharged any of the following described waters or wastes in any public sewer, drain, ditch or natural outlet:

(1)Any liquid or vapor having the temperature higher than one hundred fifty degrees Fahrenheit;

(2)Any water or waste which contains more than one hundred parts per million by weight of fat, oil or grease.

Business Owner and Property Owneracknowledge that thebusiness has been given information on the best management practices (BMPs) recommended by the City of Kirkland in order to minimize F.O.G. dispersal levels. Business Owner agrees to follow the BMPs and acknowledges that it has adopted and integrated these BMPs into its workplace.

If Business and Property Owner’s side sewer or the waste water main conveyance line becomes obstructed by F.O.G. from the business,Business and Property Owner agree that they are fully responsible for all costs associated with the cleanup, damage, and repairs resulting from that sewer line(s) obstruction. Business and Property Owner understand that, in the event of a sewer line obstruction from the business,they will be required to install an appropriately-sized grease trap or interceptor to be approved by the City. Pipe video inspections will confirm the presence, quantity, and source of all F.O.G. entering the public waste water conveyance system.
