SUPPLEMENTARYINFORMATION:
A.Background
Thisfinalruledeletesfromthe FederalManagementRegulation(FMR) thespecificrequirementsofthe InteragencyReportsManagement Program.GSAhasdeterminedthatthese requirementsnolongerserveauseful purpose,inviewoftheevolutionof Federalrecordsmanagementpractices affectingrecordscreationandFederal
policiesthatencourageagenciestoshare informationelectronically,when authorizedbylawandregulation, particularlyasanalternativeto collectingadditionalinformationfrom thepublic.Thisactionisbeing publishedasafinalrulebecauseit appliesonlytoagencymanagementand, therefore,isnotrequiredtobe
publishedintheFederalRegisterfor noticeandcomment.
Formorethan30years,GSAhashad anInteragencyReportsManagement Program,whichhasgovernedreporting requirementsimposedbyaFederal agencyononeormoreotherFederal agencies.Regulationsofthisprogram werepartofacentralized implementationofGovernmentwide reportsmanagementpoliciesand guidelinesspecificallyintendedto ensurethatinteragencyreportswere
cost-effective,non-duplicative,and compliedwithapplicableinformation lawsandregulations.TheGSA regulationsadoptedin1973were amendedseveraltimesbutremained substantiallysimilarincontentuntil September2001.Theyprovidedfora systemofoversightandapprovalthat includedaprocedureforadvance approvalbyGSAofproposed interagencyreportingrequirements, assignmentofGSAcontrolnumbersand expirationdates,andmaintenanceofan inventoryofapprovedinteragency reportingrequirements.Agencieswere askedtorefrainfromrespondingtonon- approvedreportingrequirementsandto informGSAofanysuchrequests.
InSeptember2001,GSAsubstantially reviseditsregulationsforthe InteragencyReportsManagement Program,eliminatingtherequirement foragenciestoobtainGSA’sapproval beforeinitiatinganinteragencyreport
(66FR48357,September20,2001).GSA
notedthatthischangewouldshorten thetimebetweenwhenanagency determinesaneedforinteragency informationandwhentheagencycould initiateaninteragencyreporttoobtain thatinformation.Thechangewas intendedtoletagenciestakeadvantage ofinformationtechnologytogetthe informationtheyneedtoaccomplish theirmissions.However,therevised regulations(41CFRPart102–195)still requireagenciestodoanannualreview ofthereportingrequirementsthey imposeonotheragenciestoassurethat theyremainnecessary,andtosubmit certaindatatoGSAandotheragencies, ifrequested.The2001rulesalsorequire agenciestonotifyGSAwhenareportis nolongerneededandtosubmittoGSA everythreeyearscostinformationand otherdetailsaboutallreporting requirementstheyimposeuponother agenciesforwhichrespondingagencies asawholewouldneedmorethan100 hourstocomply.
ThecurrentGSAregulationson interagencyreportingrequirementshave theirrootsinanerawhenalmostall suchreportingwasdoneonpaperand wasrelativelylabor-intensive.They wereoriginallyadoptedundera directiveoftheOfficeofManagement andBudgetthatwaseliminatedin1995 as‘‘nolongerpertinent’’(see60FR
30444,June8,1995).Withthe developmentofelectronicinformation technologyandtheshiftingoffocusto emphasizeelectronicinformation sharingamongagencies,retentionof eventhereducedrequirementsofthe
2001rulesplacesanunnecessary burdenonagenciesthatseemstohave minimalbenefit,ifany.

ruleisnotasignificantregulatoryaction forthepurposesofExecutiveOrder
