RESOLVED: THAT planning permission be granted subject to the conditions as detailed in the report now submitted and an additional condition in relation to external lighting, and that the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement under section 106 of the Town and Country Planning Act 1990, to secure the payment of a contribution towards the wider infrastructure works.

RESOLVED: (1) THAT the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement under section 106 of the Town and Country Planning Act 1990, to ensure that should the current planning application not be implemented that the property may not revert to its previous use as a health club.
(2) THAT the applicant be informed that the City Council is minded to grant planning permission subject to the conditions as detailed in the report now submitted, subject to an amendment to condition 3 to allow the premises to open on Saturdays between the hours of 9.00 a.m. and 5.00 p.m.
(3) THAT authority be given for the decision notice relating to the application to be issued, subject to the conditions as detailed in the report now submitted, on completion of such legal agreement.
(4) THAT authority be given to refuse the application if the applicant fails to complete the section 106 agreement within a reasonable time period.
