‘Breeder’ refers to the listed Breeder, ‘Buyer’ refers to all listed buyers, and ‘Dog’ refers to the described Rottweiler. This agreement is effective this ___ day of _____, 20__, between ‘Breeder’ and ‘Buyer’.

  1. Purchase Price

Price to be paid for Dogis $___. Receipt of payment is hereby acknowledged by Breeder.

  1. Buyer Responsibilities

a.Buyer is not acting as an agent in the purchase of Dog and Buyer will not sell Dog to any agent, private individual, pet store, or guard dog business.

b.Buyer accepts full responsibility for the proper health, care, well being and behavior of Dog, including but not limited to:

  1. Optimum diet as recommended by Breeder or Buyer’s veterinarian
  2. Sensible weight and exercise
  3. Proper training andsocialization
  4. Proper veterinary care
  5. Keeping Dog in a safe manner with a comfortable lifestyle where it cannot be injured.

c.Buyer absolves Breeder from all liabilities and damages by fault of Dog, including but not limited to destruction of property or physical damage to persons or animals.

  1. Transfer of Ownership or Possession

a.Buyer agrees that ownership or possession of Dog shall not be transferred to anyone other than Breeder. Transfer of ownership or possession of Dog to any individual other than Breeder shall be a violation of this agreement, subject to the stated damages. Exceptionsmust be mutually agreed to by all parties and must be stated in writing. Buyer is responsible for all transportation costs if dog is returned to Breeder.

  1. Buyer and Breeder Responsibilities

a.Breeder warrantsDog is in good health at the time of sale and will furnish Buyer with Dog’s vaccination and deworming records. Buyer shall have Dog examined by a licensed veterinarian within 72 hours of purchase. Buyer may return Dog to Breeder for any reason at Buyer’s expense within 72 hours of purchase with registration papers duly signed and Dog unaltered for a refund of $__ (purchase price less a $__ non-refundable fee).

b.Regardless of whether Dog is placed as a “Show Prospect” or “Pet/Companion”,Buyerwill have Dog radiographed for hip and elbow dysplasia,examined for heart disease by a board certified veterinary cardiologist, and examined for eye disease by a board certified veterinary ophthalmologist. These certifications will be done in accordance with the Orthopedic Foundation for Animals, Inc. (OFA) and Canine Eye Registry Foundation (CERF) procedures and submitted to OFA and CERF for evaluation.

c.If Dog develops ahereditary crippling defect or hip dysplasiaby 24 months of age that requires surgical repair or euthanasia, Breeder will offer a replacement puppy from a future litter, subject to availability and to the terms of this agreement. Prior to enforcement of this clause, Buyer will supply Breeder with all clinical information requested.

d.If Dog is placed as a “Show Prospect”, Breeder warrants Dog has no disqualifying faults under the American Kennel Club (AKC) breed standard as of the date of sale. Dog is not guaranteed to win in the show ring.

e.If Dog is placed as a“Show Prospect” and Dog develops a disqualifying fault per the AKC breed standard, a crippling hereditary defect, fails to pass OFA hips, or is definitively diagnosed with subaortic stenosis by a board certified veterinary cardiologist by 24 months of age, Breeder agrees to replace Dog with another “Show Prospect” from a future litter at the current pet price or refund $__ (the difference from “Show Prospect” to “Pet/Companion” from the date of sale). Breeder retains the right to ask for clinical information,a second opinion to confirm any diagnosis, proof of defect, and/or proof of sterilization of Dog prior to enforcement of this clause.

f.If Dog is placed as a “Show Prospect”, Breeder will provide an AKC Full Registration application for Dog.

g.If Dog is placed as a “Pet/Companion Animal”, Buyer agrees not to breed Dog for any reason, under any circumstance, and to spay or neuter Dog at an appropriate age per the recommendation of Buyer’s veterinarian.

h.If Dog is placed as “Pet/Companion Animal”, Breeder will provide an AKC Limited Registration application for Dog. Limited Registration renders Dog ineligible to compete in breed competitions in licensed or member dog shows. Dog will still be eligible to compete in any other licensed or member events including: Obedience, Tracking, Field Trials, Hunting Tests, Herding, Lure Coursing, Agility and Earthdog. Furthermore, no offspring of Dog will be eligible for breedregistration with the AKC.

i.If Dog is placed as “Pet/Companion Animal” and matures into a dog appropriate for breeding or breed competition in licensed or member dog shows, Buyer may apply to Breeder for an addendum to this contract. Pending written mutual agreement of the addendum, dog may be changed from Limited Registration to Full Registration and thus be eligible for breed competitions and to be bred according to the applicable stipulations of this contract.

j.Breeder does not accept responsibility for any costs of care or treatment of Dog after date of sale.

  1. Additional Terms and Damages

a.Failure to comply with the conditions of this contract shall constitute a “breach of contract” and will result in Dog being permanently returned to Breeder if Breeder deems necessary for the good of Dog. In this case, Buyer shall forfeit all monies paid for and spent on Dog and shall relinquish legal ownership ofDogand transfer AKC registration of Dog to Breeder. If Dog is returned to Breeder because of breach of contract, it shall be at the sole expense of Buyer.

b.Failure to comply with any of the terms of this agreement shall result in liquidated damages in the amount of $___, without changing the terms of this agreement.

c.Any litigation shall take place in the county of residence of Breeder.

d.Any modification to this contract shall be in writing, agreed to and signed by all parties. If any portion of this contract is void or invalid, the remaining provisions shallbe binding upon all parties.

e.Buyer agrees to the following conditions prior to Dog being bred:

  1. Dog shall have no disqualifying faults as defined by the AKC Rottweiler standard.
  2. Buyer must obtain a CHIC number on Dog by performing and reporting the results of OFA hip, OFA elbow, OFA cardiac, and CERF eye tests.
  3. Dog must receive a PASSING certification in the OFA hip, OFA cardiac, and CERF tests.
  4. Dog must be at least 24 months of age.

f.If Dog is bred and produces two or more live puppies at two weeks of age, Buyer agrees to offer Breeder first right of refusal on the purchase of what Breeder determines to be one ‘second pick’ puppy from any litter of her choosing. Buyer shall determine ‘first pick’puppy then Breeder shall have her choice from the remaining litter. Said second pick puppy shall be available to Breeder at the purchase price of $___ and agreement of the same terms of this contract.

g.If Dog is used for breeding purposes, Buyer agrees to abide by the Medallion Rottweiler Club Code of Ethics or the American Rottweiler Club Mandatory Practices.

h.Notification shall be deemed as provided by one of either methods: certified mail to Kate Player, 128 Stone Gate Drive, Oswego, IL 60543 and/or email, with a ‘read receipt’ dated proof of email sent/received to and/or
