RULE 10.F - COLORADO LOTTERY JACKPOT GAME “Raffle 3”

BASIS AND PURPOSE FOR RULE 10.F

The purpose of Rule 10.F is to provide general rules and requirements for Colorado Lottery Jackpot game known as Raffle 3 such as sale of tickets, method of selecting winning numbers, payment of prizes and the allocation of revenues. The statutory basis for Rule 10.F is found in C.R.S. 24-35-208 (1) (a) and (2), 24-35-212 and 24-35-212.5.

10.F.1 Commission to Adopt Specific Rules and Regulations for Colorado Lottery Raffle 3Game

A Colorado Lottery Jackpot game to be known as Raffle 3 is authorized to be conducted by the Director under the following Rules and Regulations and under such further instructions and directives as the Director may issue in furtherance thereof. If a conflict arises between Rule 10 and this Rule 10.F, Rule 10.F shall apply.

10.F.2 Definitions

In addition to the definitions provided in Paragraph 1.2 of Rule 1 and Rule 10, and unless the context in this Rule 10.F otherwise requires:

a. “Raffle 3 Number” means the unique six (6) digit number beginning with 000001 through a possible 999999 inclusive that appears on a Ticket as a single numbered selection.

b. “Winning Raffle 3 Number” means one of the four thousand two hundred fifty-five (4,255) Raffle 3 Numbers selected from the total range of tickets sold in the nine hundred ninety-nine thousand nine hundred ninety-nine (999,999) possible, using a random selection process.

10.F.3 Price of Raffle 3Ticket

The purchase price of each Raffle 3 ticket shall be $5.00.

10.F.4 Ticket Purchases

a. Tickets will be on sale beginning at 4:30 am on October 1, 2012 and ending at 11:59 pm on January 1, 2013. Raffle 3 ticket sales end date may be modified at the Director’s, or designee’s, discretion. If the Raffle 3 sales end date is modified the adjusted date will be posted on the Lottery website and available at all retailers.

b. Raffle 3 tickets may be purchased only from a Lottery retailer authorized by the Director to sell Jackpot Game tickets.

c. Raffle 3 tickets will be available for sale during normal Colorado Lottery Jackpot Game operation and retailer business hours.

d. Raffle 3 tickets will contain one Raffle 3 Number per ticket.

e. Raffle 3 tickets shall show, at a minimum, the Raffle 3 game name, the Raffle 3 Number and validation information.

f. Raffle 3 tickets will be available for purchase until one of the following conditions is met:

1. The last sale date, set by the Director or Director’s designee has passed, or

2. The nine hundred ninety-nine thousand nine hundred ninety-nine (999,999th) Raffle 3 ticket is sold.

g. Raffle 3 tickets will be numbered and sold sequentially from 000001 up to 999999 inclusive.

h. A Raffle 3 ticket may not be cancelled.

10.F.5 Drawings

a. The Raffle 3 drawing shall be scheduled for January 2, 2013. This draw date may be modified based on sell out of Raffle 3 tickets by the Director or designee. If the official draw date is modified from January 2, 2013, the modified drawing date will be posted on the Colorado Lottery web page and available at all retail locations. In the event of force majeure the drawing shall be rescheduled at the Director’s, or the Director’s designee, discretion.

b. The drawing will be conducted by Lottery officials and comply with Colorado Revised Statutes.

c. The drawing shall determine, at random, four thousand two hundred fifty-five winning numbers within the range of 1 to the last ticket number sold (maximum 999999) inclusive. Any numbers drawn are not declared winning numbers until the drawing is certified by the Lottery. The winning numbers shall be used in determining all Raffle 3 winners for that drawing. If a drawing is not certified, another drawing will be conducted to determine actual winners.

d. The complete list of selected winning numbers will be posted on the Colorado Lottery web page and serve as official notification to players.

e. The drawing shall not be invalidated based on the liability of the Lottery.

10.F.6 Prizes For Raffle 3

a. Raffle 3 has a 50 % prize payout.

b. Raffle 3 prize levels are pari-mutuel and based on sellout of game are as follows:

1.  In the event nine hundred ninety-nine thousand nine hundred ninety-nine (999,999) tickets are not sold in Raffle 3 the prize levels will be awarded based on the percent of game sold. Example: ticket sales equals seventy-five percent (75%) of tickets available (750,000 tickets sold); therefore, each prize would be awarded at seventy-five percent (75%) of value.

i.  Percent of game sold will be rounded up to the nearest whole percent (i.e. seventy-four and twenty-eight one hundredths percent (74.28%) of game sold would be rounded up to seventy-five percent (75%) of game sold.

ii.  Pari-mutuel prize amounts will be truncated to the nearest whole dollar (i.e. fifty dollar ($50) prize awarded at seventy-five percent (75%) calculates to thirty-seven dollars and fifty cents ($37.50) and is truncated to a prize of thirty-seven dollars ($37))

10.F.7 Payment of Prizes

a. The holder of a prize winning ticket of five hundred ninety-nine dollars ($599) or less can claim the ticket at any licensed Colorado Lottery retailer. Retailers have discretion to pay tickets valued from one hundred fifty-one dollars ($151) to five hundred ninety-nine dollars ($599). Tickets can also be submitted to a Colorado Lottery Claim Center in person or by mail.

b. The holder of a prize-winning ticket of six hundred dollars ($600) and above shall complete all of the information detailed on the Colorado Lottery claim form and submit the completed form and ticket by mail or in person to a Lottery Claims Center. The Colorado Lottery shall pay the prize to the owner of the ticket upon validation.

1. A prizewinner, or a prizewinner’s legally authorized representative, shall sign the winning ticket and complete a claim form that is available from any licensee, Lottery Claim Center or the Colorado Lottery website. The claim form shall incorporate the following information:

i. Verification that the prizewinner is not a person disqualified by law or by these Rules and Regulations to claim or otherwise accept a prize from the Lottery;

ii. Notification that the prizewinner’s name, city of residence and prize amount are public information. This same notification is given to one signing on behalf of a ticket owner under a disability that prevents the prizewinner from signing in his/her own behalf;

iii. The Lottery is not liable for any loss caused by a misrepresentation by the ticket owner or the person claiming the prize on the winner’s behalf.

2. The claim form may contain any other provision that the Lottery Director may deem necessary and proper to promote the public interest and trust or security and efficient operation of the Lottery.

3. Payment for a winning ticket will not occur unless all of the requirements on the claim form and winning ticket have been met or an acknowledgement that the information is unknown or unavailable. There is no obligation or duty of the Lottery, its employees or licensees, to make any inquiry of the truthfulness of information that appears on the claim form before payment to the claimant.

c. Payment of prizes shall be made to the claimant in person or by mail to the address provided by the claimant.

d. All prizes shall be paid within a reasonable time after they are awarded and after the claims are validated by the Lottery.

e. The Lottery Director, or designee, may delay any payment in order to review a change of circumstances relative to the prize awarded, the payee, the claim, or any other matter that may have come to their attention. All delayed payments will be paid to date immediately upon the Lottery Director’s, or designee’s, confirmation that the payee is entitled to such payment; any remaining payments shall be paid per the Game Specific Guidelines.

f. The Lottery Director’s decision shall be final and binding upon all participants in the game with respect to the payment of all prizes.

g. The Lottery Director reserves the right to require a claimant to disclose the location or person from whom the claimant purchased the ticket.

h. Payment of any prize shall be made to the owner of the ticket or their designee. All liability of the State, its officers and employees, and the Commission shall terminate upon payment.

i. In the event that the intercept program reveals an outstanding obligation for a winner of a prize, the prize will not be awarded until the intercept obligation is paid as set forth in 24-35-212.5.
