The Bureau of Blindness and Visual Services, Business Enterprise Program "BEP" is soliciting an expedited procurement request for food services.

STATEMENT OF WORK

Labor & Industry Café/L& I Stand 490: The café space is owned by the Department of General Services (DGS) and is located on the 4th Floor at the Labor and Industry Building located at 651 Boas Street, Harrisburg, Pa 17121.

There is a large dining room attached to the café that DGS and the responsible bidder must be in partnership to clean and maintain. The approximate square footage of the location is 8559 sq. ft.

The café is a full service location with items such as breakfast and lunch specials, a full line of hot foods, grill items, soups, hot dogs, pre-packaged and made to order sandwiches, fruit cups, yogurts, salad bar, coffee, soda, juices, sundries, snacks, baked goods, occasional catering and a possible lottery business. BEP Agents will be conducting site QA Reports.

A.  Services shall be provided five (5) days a week, Monday through Friday, 7AM to 3:30PM (except holidays observed by the State Government) with at least 4 employees.

B.  Monthly Gross Sales figures for June 2013 through May 2014 were $13,235.00. The Labor & Industry Café 490 is to be operated for the benefit of approximately 1200 employees.See Attachment A for details

C.  The awarded contractor shall operate and manage the café in the name as shown on the contract with the BEP at the Labor & Industry Café. The awarded contractor may not assign, in whole or in part, the contract or its rights, duties, obligations, or responsibilities hereunder without the prior written consent of the BEP, which consent may be withheld at the sole and absolute discretion of the BEP.

D.  The BEP will provide all equipment to run the café; however, all repairs will be done by the awarded contractor. Repairs are to be done by an authorized service provider approved by the BEP.

E.  The awarded contractor will obtain all licenses and permits required by state and local authorities, and all applicable building, health, sanitary, and other regulations and laws shall be observed at all times.

F.  The awarded contractor will submit a bid including at least a 5% commission of gross sales per month. Gross sales are defined to be the total invoice value of sales before deducting customer discounts, returns or allowances. The percentage provided in the bid proposals must be the same regardless of the price charged for product. The BEP will not accept proposals with a sliding scale of commissions.

The awarded contractor will be responsible for the following:

·  Setting the menu

·  Maintaining inventory

·  Any startup costs

·  All areas meet ServSafe Certified requirements

Term Of Contract: The contract will be a two (2) year contract, with the option to exercise three (3) one (1) year renewals. The BEP reserves the right to award the café to a BEP Licensee at the end of the original term or at the time of any of the subsequent renewals. If the BEP choses to award the café to a BEP Licensee, the awarded contractor is expected to assist the incoming BEP Licensee with taking over the operation during the 30 days prior to the date of the contract expiration. In addition, any staff working for the awarded contractor at the café is required to have security clearances and a Commonwealth issued badge displayed at all times. The BEP will assist in obtaining those clearances and badging process.

Method Of Award: Award will be made to the most responsive/responsible bidder with the highest commission offered (over the 5% of gross sales requirement minimum) that meets all the eligibility requirements set forth in the SOW.

Eligibility Requirements:

Awarded contractor and their employees shall have at least five (5) years of experience operating and managing a café in a government setting. After bid opening and prior to award, the tentative selected contractor must provide proof of this requirement as well as resumes for persons who will be assigned to the Labor & Industry Café. Changes in Contractor’s assigned personnel from those presented to and approved by BEP are not permitted unless a written notice is provided at least 30 days in advance of the proposed change(s), accompanied by corresponding resume(s), and corresponding written consent is granted by the BEP.

Only Proposals with a minimum of 5% commission on gross sales will be considered.

The awarded contractor shall have at least one (1) year of experience with individuals who are blind or visually impaired. After bid opening and prior to award, the tentative selected contractor must provide proof of this requirement via resumes and possible references.

After bid opening and prior to award, the tentative selected contractor must provide proof of valid ServSafe Certification and any other required permits and licenses necessary to operate the café. The BEP also reserves the right to request the awarded contractor provide such required documents throughout the term of the contract.
