(1)(2) SEWPordersareDeliveryOrdersplacedagainstexistingIDIQcontracts. TheSEWPVacquisitionisa Part12commercialacquisition,whichusedformalSourceEvaluationBoard(SEB)procedures,inaccordance withFARSubpart15.3andtheNASAFARSupplement(NFS)1815.3. The SEWP V solicitation was comprised of 5 separate classes of IT equipment and products. Each class of IT equipment was evaluated as a separate requirement and competition, resulting in awards in the solicited classes of equipment.
ThisDeliveryOrderisissuedunderthefollowingcriteria: SEWPOrdersplacedundermulti-awardcontracts
FAR16.505(b) (l)providesthatprovideeachcontractorshallbegivenafairopportunitytobeconsideredfor eachorderexceeding$10,000issuedundermultipledelivery-ordercontracts. Inaccordancewiththe requirementsofFAR16.505(b), thismemorandumtothefiledocumentsthefairopportunityconsiderationfor eachcontractorinthefollowingSEWPmulti-awardclass,exceptasprovidedinFAR16.505(b)(2)andinthe supportingdocumentationtothismemorandum.
TheSEWPon-lineClassSearchIRFQtoolat andtoaugmenttherequireddecisiondocumentation requiredbyFAR16.505 (b) (4), which specifies that the contracting officer must document the rationale for placement and price of each orders.TheSEWPRFQtool automaticallyincludesthecontractorswithinaselectedclassintheRFQISearchprocess. SEWPcontractsarepre-competedandthereforeformalcompetition(includingsynopsis, formalRFPs, etc.)isnotrequired.However, as withallmulti-awardcontracts(includingGSA),fairopportunity mustbeprovidedtoallassociatedmulti-awardContractHolders.TheSEWPwebsitecontains informationon FairOpportunityrequirementsandtheSEWPRFQ toolautomaticallypromptsyou with thesetof ContractHolders for whichFairOpportunityshouldbeprovided.For moreinformationsee FAR 16.505 (b) (1).
How does one satisfy FairOpportunity /Competition Requirements when using a SEWP
contract?
FAR 16.505(b) (1)providesthateachcontractorshallbegivenfairopportunitytobeconsideredfor eachorderexceeding$3,000 andissued undermultipleawardcontracts.At aminimum,toprovide
FairOpportunity,allContractHolders withinanyoneof thefour individualcompetedGroups mustbe providedOpportunity.For maximumcompetitionone,two, threeor allfour Groups canbeselected. TheSEWPonlineRFQ toolistherecommendedmethodtoassistinthisactivityandtoaugmentthe requireddecisiondocumentation.
Onlyone company has the itemI need on theirSEWPcontract.Can I just directlyaward to them?
Whileatagivenmoment,theremaybeonlyonecompanywithaproductsolutionyou requireon a SEWPcontract,FairOpportunityisstillrequiredtoallContractHolders atleastinthesameGroup as thesuggestedsource.Itispossiblefor otherContractHolders toaddtheproductsolutionintimeto alsoprovideaquote.
Do I need to obtain 3 quotes?
No, FairOpportunity,notthe“3quote”ruleappliestotheSEWPcontracts.You mustprovideFair OpportunitytoallContractHolders withinatleastoneof the4 ContractGroups. If afterproviding theFairOpportunity(preferablyusingtheSEWPon-lineQRT tool),onlyonecompanyprovidesa
quoteyou mayproceedwiththeawardandorder.Notethatthisisnotasolesourcesinceyou provided opportunitytotheotherContractHolders.
ItisrecommendedthatifonlyoneContractGroup isqueriedandonlyonequoteisobtained,theQRT
shouldbere-issued,includingall4 ContractGroups inordertomaximizecompetition.
Can I limitmy QRTto 3 suggested sources?
No.At aminimum,FairOpportunitytoallContractHolders inasuggestedsource’sGroup mustbe provided.
