121.  PRESENTATION – EAST SURREY HOSPITAL

It was reported that the Presentation by East Surrey Hospital scheduled for this meeting had been withdrawn.

RESOLVED that the position be noted.

122.  PLANNING APPLICATIONS FOR DECISION

RESOLVED that the list of planning applications to be determined under Agenda Items 6 to 12 be noted.

123.  planning application 06/00862/f – kingswood cottage, maybank, coverack, the paddock and lynwood, st.monica’s road, kingswood

The Committee considered a report on an application for the demolition of 5existing dwellings and the erection of 32 apartments in two blocks with associated parking, access alteration and landscaping at the above location. It was noted that a site inspection had been held in relation to this application.

A representative of Kingswood Residents’ Association objecting to the proposal and a representative of the applicant addressed the Committee.

RESOLVED that consideration of this application be DEFERRED to allow further negotiations on the affordable housing element and to ascertain whether side facing windows would need to be fully obscured.

124.  planning application 06/01285/f – cedar house, 39 london road, reigate

Consideration was given to a report on an application for the demolition of the existing office block and redevelopment of new office building with associated underground parking at the above location.

RESOLVED that consideration of this application be DEFERRED to allow further negotiations to take place in relation to the roof design and the financial aspects of the Travel Plan.

125.  planning application 06/01572/f – 22-28 brighton road, banstead

The Committee considered a report on an application for the erection of 8 x 4 bedroom semi detached houses with formation of access onto Brighton Road (including partial demolition of 24 Brighton Road) at the above location.

RESOLVED that subject to the prior completion (within six months of the date of this Resolution or such longer period as may be agreed by the Head of Building and Development Services) of all documentation required to create a planning obligation under Section 106 of the Town and Country Planning Act1990 (as amended) to secure (i) a contribution of £15,000 towards highway improvements in the vicinity; and (ii) the payment of the Council’s legal costs for drafting this obligation, then planning permission be GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason:

To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004.

2. Before the development hereby permitted is commenced the developer shall obtain the Local Planning Authority’s written approval of samples of the materials to be used in the construction of the external surfaces of the building works hereby permitted and the development shall be carried out in accordance with the approved details.

Reason:

To ensure that the development hereby permitted is only constructed using the appropriate external facing materials or suitable alternatives in the interest of the visual amenities of the area and with regard to policy Ho9 of the Reigate & Banstead Borough Local Plan 2005.

3. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, (or any Order revoking and re-enacting that Order) (with or without modification), no windows, dormer windows or other openings shall be constructed at or above first-floor level of the new dwelling, other than as shown on the approved plans, without the prior written approval of the Local Planning Authority.

Reason:

To ensure that the development does not affect the amenity of the neighbouring properties by overlooking and to comply with policy Ho9 of the Reigate & Banstead Borough Local Plan 2005.

4. No development shall take place until full details of both hard and soft landscape works including changes in ground level have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. If within a period of five years from the date of the planting of any tree, that tree, or any tree planted in replacement for it, is removed, or uprooted, or destroyed, or dies, or becomes, (in the opinion of the Local Planning Authority), seriously damaged or defective, another tree of the same species and size as that originally planted shall be planted. Such replacement tree shall be planted during the first planting season after the original tree is removed, or uprooted, or destroyed, or dies, or becomes seriously damaged, or defective, unless the Local Planning Authority gives written consent to any variation.

Reason:

To ensure good arboricultural practice in the interests of the maintenance of the character and appearance of the area, and to comply with policies Pc4, Ho9, and Ho13 of the Reigate and Banstead Borough Local Plan 2005, and policy SE4 of the Surrey Structure Plan 2004.

5. In this condition “retained tree” means an existing tree which is to be retained in accordance with the approved plans and particulars; and paragraphs (a) and (b) below shall have effect until the expiration of one year from the date of the first occupation of the building for its permitted use.

(a)  No retained tree shall be cut down, or uprooted, or destroyed, nor shall any retained tree be topped or lopped other than in accordance with the approved plans and particulars, without the prior written approval of the Local Planning Authority. Any topping or lopping approved shall be carried out in accordance with British Standard 3998:1989 (Recommendations for Tree Works).

(b)  If any retained tree is removed, or uprooted, or destroyed, or dies, another tree shall be planted at the same place and that tree shall be of such size and species, and shall be planted at such time as may be specified in writing by the Local Planning Authority.

Reason:

To ensure good arboricultural practice in the interests of the maintenance of the character and appearance of the area and to comply with policies Pc4, Ho9 and Ho13 of the Reigate and Banstead Borough Local Plan 2005, and policy SE4 of the Surrey Structure Plan 2004.

6. Before any works commence, tree protection fencing shall be carried out in accordance with the specification on drawing tpp1/22-28 brightonrd.

Such tree protection shall:

(a) Be erected before the commencement of any works, including site clearance and the construction of any foundations;

(b) be maintained to the satisfaction of the Local Planning Authority throughout the construction until either completion of the development, or implementation of approved landscaping works within those protected root areas;

(c) ensure that no level changes, including soil stripping, shall be undertaken within these protected tree root areas, unless clearly specified as part of any relevant detailed consent;

(d) ensure that no service routings, materials storage, site traffic, building operations, excavations, fires or other works shall take place within these protected tree root areas, unless otherwise agreed by the Local Planning Authority and any fires shall be located so flames are a minimum of 12.0 metres outside the canopy of any tree subject to the above protection, or more for a large fire;

(e) Ensure that all protection of trees and their root areas and any related works, shall otherwise conform to that detailed in British Standard 5837:2005 “Trees in relation to construction” or be as otherwise agreed in writing by the Local Planning Authority.

Reason:

To ensure good arboricultural practice in the interests of the maintenance of the character and appearance of the area and to comply with Policies Pc4, Ho9 and Ho13 of the Reigate & Banstead Borough Local Plan 2005, and policies SE4 and SE9 of the Surrey Structure Plan 2004.

7. The planting shown on the approved plan shall be carried out within the first planting season following completion of the dwellings hereby permitted, or such longer period as may be agreed, in writing, by the Local Planning Authority.

Reason:

In the interests of the character and appearance of the area, with regard to policy Ho9 of the Reigate & Banstead Borough Local Plan 2005.

8. Until the completion of the development hereby permitted, no site or building works (including excavation, construction of the development hereby permitted, tree works, laying of hard surfaces and landscaping of the site) shall be carried on outside the hours of 0800-1800 Mondays to Fridays inclusive; 0800-1300 hours on Saturdays and not at all on Sundays and Public Holidays. There shall be no deliveries taken at or despatched from the site outside these hours.

Note: For the avoidance of doubt “Public Holidays” includes New Year’s Day, Good Friday, Easter Monday, May Day, Spring Bank Holiday, all Bank Holidays, Christmas Day and Boxing Day.

Reason:

To ensure that the construction of the development hereby permitted does not unreasonably affect the amenities enjoyed by the occupiers of the residential properties in the vicinity and to comply with policies Ho9, Ho13 and Ho16 of the Reigate & Banstead Borough Local Plan 2005 and policy SE4 of the Surrey Structure Plan 2004.

9. No development shall start until a Method of Construction Statement, to include details of:

(a) Parking for vehicles of site personnel, operatives and visitors;

(b) Loading and unloading of plant and materials; and

(c) Storage of plant and materials

has been submitted to and approved in writing by the Local Planning Authority. Only the approved details shall be implemented during the construction period.

Reason:

In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to policy Mo7 of the Reigate & Banstead Borough Local Plan 2005 and policy DN2 of the Surrey Structure Plan 2004.

10. No development shall be occupied until the existing accesses from the site to Brighton Road have been permanently closed and any kerbs, verge, footway, fully reinstated by the applicant to conform with the existing surfaces.

Reason:

In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to policy Mo7 of the Reigate & Banstead Borough Local Plan 2005 and policy DN2 of the Surrey Structure Plan 2004.

11. No new development shall be occupied until space has been laid out in accordance with the approved plans for cars to be parked and for vehicles to turn so that they may enter and leave the site in forward gear. The parking and turning area shall be retained exclusively for its designated use.

Reason:

In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to policy Mo7 of the Reigate & Banstead Borough Local Plan 2005 and policy DN2 of the Surrey Structure Plan 2004.

12. Before any other operations are commenced (excepting for the tree protection measures required by condition 6) the vehicular access to Brighton Road shall be constructed and provided with visibility zones in accordance with a plan to be submitted to and approved by the Local Planning Authority and thereafter maintained with visibility zones and kept permanently clear of any obstruction.

Reason:

In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to policy Mo7 of the Reigate & Banstead Borough Local Plan 2005 and policy DN2 of the Surrey Structure Plan 2004.

13. The footway shall extend either side of the access to Brighton Road to a point behind the rumble strip. This shall be shown on a plan to be submitted to and approved by the Local Planning Authority.

Reason:

In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to policy Mo7 of the Reigate & Banstead Borough Local Plan 2005 and policy DN2 of the Surrey Structure Plan 2004.

14. The existing south facing ground floor flank window of 22 Brighton Road shall be bricked up with building materials to match existing, any variation must be agreed to in writing by the Local Planning Authority.

Reason:

To ensure that the development hereby permitted does not unreasonably affect the amenities enjoyed by the residential properties in the vicinity and to comply with policies Ho9, Ho13 and Ho16 of the Reigate & Banstead Borough Local Plan 2005 and policy SE4 of the Surrey Structure Plan 2004.

15. Prior to the commencement of any development works, including ground preparation or demolition, a detailed arboricultural method statement (AMS) shall be submitted to and approved in writing by the Local Planning Authority. This shall relate directly to the tree protection plan (TPP) approved. All works shall be carried out in strict accordance with these details when approved or as otherwise agreed in writing by the Local Planning Authority. These submissions shall be in accordance with British Standard 5837:2005 (Trees in Relation to Construction).
