Council Meeting – June 5, 2014

Mayor Thomas L. Hardesty called the regular council meeting to order with the following council members present: Bobby Andriot, Mike Zoeller, Donna Eaton, Shane Suttor, Jon Swindler, and Frank Page.

City Employees Present: Inez Harris, Judy Smith, Jennifer Herrell, and Brent Bridgman

City Attorney: Steven Gregory

All present pledged allegiance to the flag.

Minutes Regular Meeting May 15, 2014 and Public Hearing May 15, 2014

Councilmember Page moved to approve the minutes of May 15, 2014 and the Public Hearing minutes of May 15, 2014 as read by council members prior to the meeting. Seconded by Councilmember Zoeller.

All voted “aye” and motion carried.

Ordinance/Amendment to an Ordinance Adopting the City of Shelbyville Budget for the Fiscal Year July 1, 2013 – June 30, 2014 – 1st Reading – Judith Smith

Judith Smith, Office Administrator, read an ordinance of the City of Shelbyville amending the 2013-2014 Budget Ordinance No. 2013-05-06.

It was introduced for first reading by Councilmember Suttor. Seconded by Councilmember Zoeller.

Ordinance/Enacting Text Amendments to the Zoning Regulations for Shelby County

1st Reading – Steven Gregory

Steven Gregory, City Attorney, read an ordinance of the City of Shelbyville whereas Triple S Planning and Zoning has proposed text amendments to zoning regulations relating to production and storage of distilled spirits. The adoption of the proposed text amendments will be added to the zoning regulations applicable to the City of Shelbyville.

It was introduced for a first reading by Councilmember Suttor. Seconded by Councilmember Swindler.

Councilmembers Page and Suttor will serve on a committee to work with zoning to work on changes for the text amendments.

Councilmember Zoeller moved to amend the ordinance from 5 acres to 25 acres in the Development Standards of the text amendments minimum lot area. It was seconded by Councilmember Swindler.

The vote was 4-2.

Resolution – Relating to Awarding a Franchise for Garbage Collection and Disposal Services in the City of Shelbyville – Steven Gregory

Steven Gregory, City Attorney, read a resolution relating to awarding a franchise for garbage collection and disposal services in the city.

Councilmember Page moved to approve the resolution. Seconded by Councilmember Swindler.

All voted “aye” and motion carried.

Mayor Hardesty appointed Jennifer Herrell, and Councilmembers Page and Zoeller to work with the city attorney to develop the request for proposal.

Appointments

Mayor Hardesty recommended Matt Burgin be appointed to the Tourism Commission for a 3 year term ending June 30, 2017; Laura Lynn Best to Shelbyville Housing Authority for a 4 year term ending June 30, 2018; and Christi Eye – Tax Appeal Board for a 3 year term ending June 30, 2017.

Councilmember Zoeller moved to approve the appointments. Seconded by Councilmember Eaton.

All voted “aye” and it was so ordered.

Re-Appointments

Mayor Hardesty recommended Wayne Anderson and Ann Morris be appointed to the Code Enforcement Board for 3 year terms ending June 30, 2017; Sherry Jelsma and Tom Francis to Historic District Commission for 3 year terms ending June 30, 2017; and Neil Hackworth to Shelbyville Water & Sewer Commission for a 3 year term ending June 30, 2017.

Councilmember Page moved to approve the re-appointments. Seconded by Councilmember Zoeller.

All voted “aye” and it was so ordered.

2013 MS4 Annual Report – Jennifer Herrell, City Engineer/Public Works Director

Jennifer Herrell, Public Works Director, gave a report on the MS4 Program for the City of Shelbyville. It is six programs in one. The programs are identified as follows: Public Education, Public Participation, Illicit Discharge, Construction Site Run off Control, Post Construction Storm Water Management and Municipal Operations. These programs are through the Kentucky Division of Water.

We are in Phase 2 of the MS4 Program. We have a permit with the Division of Water. There will be new mandates/regulations that must be followed in the next 5 year cycle. These regulations will get tougher in the coming years.

Public Comments

Mr. Richard Lane, 834 Henry Clay Street, conceded defeat on the Greece versus Galloway decision. He did not think the case would be defeated. Prayer will now be allowed at council meetings.

Department Reports

Jennifer Herrell, City Engineer/Public Works Superintendent, reported they are still chipping storm limbs and trees from the storm on May 21st. She reminded everyone Public Works will assist residents with limbs/debris but they must be 6 ft. long or less. Please cut them up, stack them neatly, and they will pick them up and put in the chipper on site. They will be staining the brick pavers from 6th St. to 8th St.

Eilene Collins, Executive Director, Shelby Development Corporation, reported the May 24th street party was a success. The next concert will be June 28th with Ralph Curtis and his All American Band. She has been encouraging business owners to put out extra flower containers. The Shelby Development Design Committee created attractive barricades for local events. They are curing at Public Works and will be painted for future use. Jubilee will be July 24th – 26th. We are in the planning stages.

Steven Gregory, City Attorney, reported the housing partnership at Clifton Court has met all the “conditional approval” items on their plat. They have submitted the Declaration of Covenants conditions and restrictions. I have reviewed them and they have met all requirements. We need to have a motion to lift the conditional approval and make it an approval. I will make copies for everyone to review for the next meeting.

Mayor’s Report

Mayor Hardesty reported the next meeting will be a Special Called Meeting on June 26th. The Lake Shelby Fish Fry started again on Friday nights. The Kentucky Association of Economic Development will play golf at Weissinger tomorrow. There will be a job fair at Shelby Christian Church on June 20th and 21st. The Chamber of Commerce, Shelby County Industrial Foundation, Tourism, City of Shelbyville, City of Simpsonville, and Shelby County Government are sponsors. Shelbyville has been designated as one of the 50 Safest Cities in the United States. We extend condolences to the family of Harold Tingle.

Council Report

Councilmembers Swindler and Suttor reported the recommendation on the agricultural properties should be grandfathered in under the 100 feet guidelines. There are 5 houses that meet the guidelines.

Councilmember Page thanked everyone that worked on Project Graduation.

Councilmember Suttor moved to adjourn at 8:15 p.m. Seconded by Councilmember Zoeller.
