III. POLICY

To help ensure the safety of persons who are victims of domestic violence, Maine law requires that local law enforcement agencies have a process to ensure that a victim recieves notification of the defendant’s release from jail.

VI.  PROCEDURES

Procedure A. Victim Notification of Release on Bail

1.  Notification Pursuant to Domestic Violence Arrest

a.  When a law enforcement officer has requested notification due to a Domestic Violence arrest, the arresting officer will provide a domestic violence arrest form with the victim contact information. The arrestee/inmate folder will be flagged with a Release Notification Flag

b.  Upon release of an arrestee/inmate with a Release Notification Flag, designated jaill staff will

1.)  Check the arrestee/inmate folder for the release notification flag.

2.)  Make telephone notification to the victim at the numbers provided on the arrest form.. Attempts should continue until contact is made with the victim or Victim Witness Advocate.

3.)  Document the date and times of notification, or attempts if contact is not made.

4.)  Notify the victim witness advocate at the prosecutors office if unable to make contact with the victim.

2.  ALL Victim notifications and attempts to do so will be documented and documentation will be maintained in a confidential section of the arrestee/inmate folder.

3.  Nothing in this policy prohibits notification of a release on bail of an inmate/arrestee who has been arrested for a non domestic violence offense when requested by the law enforcement officer.
