On the eve of colourful festival, Holi, the undersigned takes the opportunity to convey good wishes to all members and their family members on behalf of the All India body. Festival comes and goes but the fate of the Superintendent cadre remains as grim as ever. The members are also not ready to go all out to achieve the goal. The members are required to be told in clear language that the situation cannot be changed until and unless they are ready to sacrifice.
Recently on 19th of February, the Association met the Hon’ble Revenue Secretary and requested to use his good office to issue direction to the CBE&C to solve the problems confronted with by the Superintendents. It has been also contended that due to insufficient numbers of Deputy/Assistant Commissioner, the bonafide tax payers are unable to derive the benefit of liberalization and discharge their obligation in a hassle free way.
Also tried to meet Hon’ble MOS Sri S. S. Palanimanickam through MP Sri Adhir Ranjan Chowdhury but the meting could not be held. Sri Choudhury who wanted to arrange the meeting, told to hand over all the papers so that he would be taking up the case with Hon’ble FM Sri Pranab Mukherjee.
The Memorandum to the Study Groups has been sent with the amendment suggested in the AEC Kolkata. The major addition is to demand 2360 posts of Assistant Commissioner for 118000 assessees under Service tax after creation of groups with 500 assessees. Earlier Chief Commissioners’ conference in the year 2000 recommended one Assistant Commissioner for 1000 assessees, but now because of the exemption to the small service providers and extension of facility of Cenvat credit, thereduction of number of assessees has been shown in the Memorandum.The Memorandum has already been circulated.
The Association requested to clarify the manner of counting of four years for granting benefit of NFSG scale, benefit of ACP scheme to the Superintendents who have been given the benefit of NFSG and date of increment. The Board has clarified the availability of NFSG scale on 21.11.2008, which is confusing and contradictory to earlier clarification given in case of Section Officers. The main purpose to give the benefit of the said scale to remove the disparity between the Secretariat and Field level officers. The said purpose already stood defeated when some officers including Superintendents were given the scale of Rs.8000-13500/ in the PB-2. Again the clarification as mentioned above is a clear attempt to delay the benefit which is clearly available to the Superintendents who completed four years in the grade on 1.01.2006. Again the Association has written letter to the Hon’ble Chairman to reconsider the matter. The letter is reproduced hereinafter.

Hope,all concerns have received the minutes of the AEC Kolkata Meeting. As you know that the Association is required to apply for renewal of recognition and for that matter DDOes’ certificates showing the names of the Superintendent who have opted for deduction of subscription are necessary. All unit Secretaries are requested to collect the said certificates in the first week of April, 2009 which would show deduction for the month of March but deducted in the month of April. The Certificates may please be sent within April.
As requested in the AEC Kolkata, all the unit Secretaries and all India Office bearers are requested to send their suggestions to prepare memorandum to the Anomaly Committee.
The Regional Presidents and Secretaries are requested to co-ordinate with the

“Subject:- Request for intervention in the matter of granting of NFSG scale – Reg.
Most respectfully, the Association likes to bring to your kind notice that it drew your kind attention in letter under even (1958) and (2021), copies enclosed for ready reference and marked collectively as Annexure-A, for clarification of counting of service for grant of NFSG scale of Rs.8000-13,500/ after four years in the line of Section Officer when the same was granted to them along with other issues. Till date no clarification has been issued except the issue of counting of four years.
The CBE&C in its letter under F.No.A.26017/98/2008-Ad.II.A dated 21.11.2008 has clarified that the 4-year period is to be counted w.e.f. the date on which an officer is placed in the pay scale of Rs.7500/-12,000/ (pre-revised). It has also been stated that if an officer has competed 4 years on 01.01.2006 or earlier, he will be given the non-functional upgradation w.e.f. 01.01.2006. If the officer completes 4 years on date after 01.01.2006, he will be given non-functional upgradation from such date on which he completes 4 years in the pay scale of Rs.7500/- 12,000/ (pre-revised).
The above clarification has baffled the entire cadre members in the circumstance that the Board is well aware that the scale of Rs.7500/- 12,000/ had been granted to them w.e.f. 21.04.2004, then how the instance can arise where any Superintendent would be completing 4 years on 01.01.2006(!). Moreover, it is not understood if an Inspector who was given the scale of Rs. 7500/- 12,000/ under ACP scheme and after promotion to the post of Superintendent, whether he would be required to complete 4 years as Superintendent again.
The Association believes that NFSG scale of Rs. 8000-13,500/ is available to all Superintendents who have completed four years as Superintendents on 01.01.2006 or thereafter, whichever is earlier. In support of the above contention the Association submits the following:-
(a). that DoPT under OM No.5/4/2005-CS.1 dated 30.03.2006 clarified that all Section Officer of CSS who had completed approved service of four years or more in the grade on 01.01.1996 will be eligible for being placed in the scale of Rs.8000/- 13,500/(Copy enclosed and marked as Annexure-B);
(b). that the Department of Expenditure in its letter under F.No.22/2/2008-IC.II dated 24.10.2008 in reply to application by Sri Raziv Kumar Srivastava under the R T I Act, 2005, the four years service would be counted for granting the grade pay of Rs.5400/ from the date when the officers joins the Group B cadre or the four years of service should be counted from 01.01.2006 or four years would be from 21.04.2004 when the scale of Rs.6500/ - Rs.10,000/ was replaced by Rs.7500/ - Rs.12,000/, informed that four years regular service rendered in the pre-revise scale of Rs.7500/- Rs.12,000/ will be counted fromthe date of promotion in this grade (copies of the application and reply are enclosed and marked collectively as Annexure-C);
(c). that under DoPT Office Memorandum No.22011/10/84-Estt. (D) dt.4.02.1992, in respect of upgradation involving only higher replacement scale without any higher responsibilities but the officers concerned have to fulfil the

Sri Asoke Sarkar / higher eligibility service, prescribed the criteria that where the upgradation involves a higher replacement scale without higher responsibilities or higher qualification but with a higher eligibility service, the incumbent need not be assessed for their suitability, but, it should be ensured that they have completed the requisite qualifying service for appointment to the upgraded post. In case they had completed the qualifying service on or before the date notified by the Government, they may be appointed to the upgraded post from that date. In the case of others, who fulfil the qualifying service on a later date, they should be appointed to the upgraded post from the date on which they complete the qualifying service. This would be subject to the condition that irrespective of the date of appointment , the original Seniority of the incumbent in the grade prior to the upgradation will be maintained for appointment to the upgraded post(copy enclosed and marked as Annexure-D);(d). that DoPT, under its letter No. 21/2/2004-CS.I dated 08.03.2004, clarified regarding grant of NFSG Scale of Rs. 8000-13500 to the Section Officers of CSS, that the Section Officers on deputation, who become eligible for the grant of NFSG Scale in terms of DoPT’s Order No. 21/36/03-CS.I dated 13.11.2003, shall also be entitled to exercise the option for fixation of pay in the new scale under F.R. 22(I)(a)(2) while continuing in the deputation post (copy enclosed and marked as Annexure-E);
(e). that DoPT’s Order, under F. No. 10/3/2004-CS.II(Pt.I) dated 24.06.2005, observed that the NFSG scale of Rs. 8000-13500 is admissible to the Private Secretaries of CSSS on completion of four years of approved service in that grade, subject to their vigilance clearance and the said NFSG scale was given to the Private Secretaries borne in the Rs. 6500-10500 (copy enclosed and marked as Annexure-F);
(f). that GNCTDSD, in its Order No. 2/50/2003/S.I/Pt.I/38 dated 01.02.2007, has observed that NFSG scale of Rs. 8000-13500 to be given to the grade of DASS Cadre, Senior PA and also to the Grade-1 (DASS)/Sr. PA who have been appointed to the ex-cadre post of DANICS on ad-hoc basis, on completion of four years of regular service (copy enclosed and marked as Annexure-G) ; and
(g). the Ministry of Defence, under letter No. A/24644/SO/CAO/CP dated 25.09.2008, clarified that NFSG scale of Rs. 8000-13500 is admissible to the Section Officers of Armed Forces Head Quarter Civil Service (CS) on completion of four years of approved service in that grade, subject to their vigilance clearance (copy enclosed and marked as Annexure-H).
In view of the above, the Association requests your kind honour to look into the matter so that all Superintendents are given NFSG scale of Rs.8000-13500 with effect from 1.1.2006, who have completed 4(four) years in the grade of Superintendent on 1.1.2006.
