  1. CONDITIONS FOR SPECIAL EVENT

7.1The applicant shall complete and submit the application to the relevant official of the Environmental Health Section of the Department of Health in the Region of the City of Johannesburg where the event will take place, at least 30 days prior to the event.

7.2Residents of adjacent residential and/or rural areas (within 1kmradius ora 2 Kmradius in an agricultural holding and/or rural setting) to be notified of the intended event. Dates, times and extent of the event as well as contact numbers of organizers and relevant Council officials in the region of the City of Johannesburg where the event will take place, to affordto be effected residents the opportunity tolaunch objections, if any.

Provethat possible effected residents had been notified shall be submitted with the application

7.3Ward Councillor to be informed regarding the event.

7.4If music is to be played or any other sound that will be generated during the event will be in excess of 95 dBA measured at any point which may be occupied by a member of the public at the venueand/or will cause a noise nuisance and/orthe ambient noise levelsto rise above the typical rating levels for ambient noise in districts as indicated in table 2 of SANS 10103, beyond the property boundaries, the premises must either be acoustically screened off or other measures be put in place and maintained throughout the event tominimise the sound levelsbeyond the property boundaries to the satisfaction of this Department.

The screening off and/or measures taken to be done in consultation with an Acoustic Consultant, deemed fit to do so by this Department, whom is to certify that the screening off and/or measures taken shall be sufficient to minimisethe effect of a disturbing noise and/or noise nuisance beyond the boundaries of the premises and to submit noise impact assessments or tests results in accordance with the specifications of SANS 10103 and SANS 10328 to prove same to this Department.

7.5Formal confirmation thatan application has been timeously submitted with the Department of Development Planning, Land Use Management Section for consentofthe land to be used temporarily to stage such an event, if the existing zoning and/or consent use of the property does not support entertainment/amusement as defined in the applicable Town Planning Scheme. (i.e. Event where amplified music is to be played by “disk jockeys” and/or “live” music, for the entertainment of patrons and/or to dance to.)

This Consent of the Department of Development Planning and this application are interdependent.

  1. The Environmental Health Section of the Department of Health need to be notified with regard to Food Safety and Ablution Facilities requirements during the event

An application may need to be launched with Events Joint Operations Committee of the Council in terms of the Safety at Sport and Recreational Events Act, 2010 (Act no 2 of 2010) and/or the Emergency Services By-Laws 2003 of the City of Johannesburg, depending on the risk the event may pose to public safety and/or other factors that will need to be assessed.

Kindly also be advised that exemption from complying with the Provisions of the Noise Control Regulations 1999 shall not take effect before the applicant has officially undertaken in writing to comply with all afore- mentioned conditions imposed by this Department.

Furthermore, compliance with the requirements of this Department does not exempt the organiser from compliance with any other legislation, procedure or policy of this Council, the State or any other institution and no rights or privileges to conduct this business/activity on this property are inferred to by compliance.
