RENTAL AGREEMENT

Terms & Conditions of Agreement

For use of Banquet Hall @ He‘eia State Park

Arrangements for the availability of the Banquet Hall @ He‘eia State Park may be made through Kama‘aina Kids at or (808) 235-6509. Reservations are accepted up to 12 months in advance.

Rental fees for use of the Banquet Hall @ He‘eia State Park (hereafter referred to as the “Banquet Hall”) follow and are based on the charges set forth in theRENTAL AGREEMENT. Rental fees are due 30 days prior to the reservation date.

  1. Security Deposit

A security deposit shall be paid to secure the requested date of event and full and faithful performance of all terms and conditions contained in theRENTAL AGREEMENT. If all conditions of the CLEANING GUIDELINES (attached) are met, the Security Deposit will be refunded. All violations will be deducted as stated in DEPOSIT DEDUCTIONS (attached). The RENTOR is informed and understands that the processing period for full and partial refund of Security Deposit requires a period of approximately 2 weeks.

  1. Service Charges

Canceled/returned checks and late payments shall be assessed a $25service charge.

  1. Overtime Fee

If the RENTER unexpectedly runs past the agreed end time at the conclusion of RENTER’s event, the RENTER will be assessed an overtime fee of $25 per 15 minutes or a fraction thereof incurred against the Security Deposit.

  1. Confirmation

Reservation date is confirmed upon receipt of $500 (weekend) or $300 (hourly) Security Deposit (see page 4)AND the signing of the RENTAL AGREEMENT. If more than one party is interested in a specific date, reservations will be done on a “first come, first served” basis. Payment shall be made by check, money order, MasterCard, or VISA. Checks should be made payable to Kama‘aina Kids. There will be a $25charge for any check that is returned due to insufficient funds.

  1. Cancellation

Kama‘aina Kids will refund all FEES, except Security Deposit and Service Charges, for any cancellations made within 30 days of reservation date. Cancellations made less than 30 days of reservation date are subject to additional charges at the discretion of Kama‘aina Kids based on seasonal usage and inability to secure another RENTER. Cancellation within 30 days and less of the reservation date must be made in writing.

  1. Excused Non-Performance

If, for any reason beyond its control, but not limited to accidents, acts of war, or acts of God, Kama‘aina Kids is unable to perform its obligations under this Agreement, such non-performance is excused and Kama‘aina Kids may terminate this Agreement without liability of any nature upon return of RENTER’s fees and deposit. Kama‘aina Kids will not be liable for consequential damages of any nature, under any circumstances, for any reason, whatsoever.

  1. Admissions Charges

Persons attending the event contemplate herein will / will not be paying an admission for this event.

  1. Alcoholic Beverages

The use or possession of alcohol shall be confined to the PREMISES (Not allowed on park grounds) and shall be in accordance with all applicable State and City & County ordinances, rules and regulations.

  1. Rubbish/Garbage Removal/Recycling

The RENTER shall be responsible for the removal of all rubbish/garbage from the premises and surrounding parking lot area immediately following the event. All rubbish/garbage should be discharged into designated dumpsters on the premises. A charge of $100 shall be assessed if Kama‘aina Kids staff must remove rubbish/garbage. Kama‘aina Kids will deduct this charge from the security deposit. Recycling bins will be provided for items that meet the current state recycling codes. See also CLEANING GUIDELINES for other applicable guidelines.

  1. General Clean-Up

The RENTER shall be responsible for sweeping and mopping the floors in the Banquet Hall, bathrooms, kitchen, and conference room immediately following the event. Toilets & bathroom sinks must also be cleaned. Kama‘aina Kids shall provide cleaning supplies and equipment. The tables and chairs also need to be cleaned and put away in the proper storage area, and the kitchen counters, sink, and stove should be wiped down and free from any food or liquid. A charge of $100 shall be assessed if Kama‘aina Kids staff must perform any or all of these tasks. Kama‘aina Kids will deduct this charge from the Security Deposit.   1. Park Grounds

The RENTER shall be responsible for any damages to the surrounding flora. There is NO CUTTING of any surrounding flora found within the park grounds for personal decorations or usage. Damages to be assessed and levied against the Security Deposit.

  1. Set-Up/Decorations

Glitter and/or throwing confetti or rice is not allowed. Decorations may not be nailed, stapled, or tacked to any part of the facility. If decorations need to be mounted on the walls, use of white putty tack or tape is allowed. Decorations must be removed immediately following RENTER’s event, and must comply with governmental laws, rules, regulations and ordinances, including but not limited to, fire code regulations.

No decorations will be allowed on the outside of the Banquet Hall except for balloons and streamers. No signs will be allowed on the outside of the Banquet Hall except atthe entrance doorway.

  1. Security

Security is mandatory when renting the banquet hall for any and all functions. The RENTER will be provided security through He’eia State Park when renting Fri-Sun blocks. Hawaii Security Services will provide security for up to 5 hours, any additional time needed will cost an additional $35 per hour.

  1. Smoking

Smoking is not permitted within any of the buildings at the Banquet Hall or within the restrooms located on property. In accordance with State law, smoking will only be allowed in the designated smoking area outside of the building. Any smoking done inside the building will result in the forfeiture of the security deposit.

  1. Discrimination Policy

The use of the Banquet Hall shall not be in support of any policy which discriminates against anyone based on race, creed, color, gender, religion, national origin, sexual orientation or physical handicap.

  1. Conduct

Kama‘aina Kids reserves the right to terminate any event under the following circumstances:

  1. 1.The event is not properly chaperoned.
  2. 2.The conduct of the guests attending the event presents a threat to the health and safety of the individuals, or could damage the Community Center or Surrounding properties.
  3. 3.Rules and regulations are not complied with.
  1. Indemnity

The RENTER shall indemnify, defend, and hold Kama‘aina Kids, He‘eia State Park, City & County of Honolulu and the State of Hawaii harmless from and against all claims, proceeding, suits, damages, settlements, and awards arising in connection with or attributable to the use of the premises by the RENTER and/or its guests, invitees, agents, or assignees. This indemnification shall, among other things, include indemnification against any and all actions, proceedings, attorney’s fees, costs demands and any damages.

  1. Exculpation of Kama‘aina Kids, He‘eia State Park, City & County of Honolulu, State of Hawaii

Kama‘aina Kids, He’eia State Park, City & County of Honolulu and the State of Hawaii shall not be liable to the RENTER for any damage to the RENTER or RENTER property or RENTER’s guest(s) from any cause. The RENTER waives all claims against Kama‘aina Kids, He‘eia State Park, City & County of Honolulu and the State of Hawaii for damage to person or property arising for any reason.

  1. Default

In the event of any default by the RENTER of any of the terms herein, RENTER shall be liable for all damages, including attorney’s fees and costs, which may be incurred as a result of said default, and steps taken to address said fault.

The undersigned has fully read and agrees to the Terms and Conditions of the RENTAL AGREEMENTand hereby confirms payment of Security Deposit in the amount of $______to Kama‘aina Kids for the engagement and usage of the Banquet Hall. The RENTER agrees to pay $______rental fee 30 days prior to the rental date (______). Failure to submit payment by this date will result in forfeiture of the Security Deposit and the termination of this agreement.

The RENTER hereby agrees to and assumes full and all responsibilities and liabilities for any damages, destruction, and/or losses incurred by Kama‘aina Kids during or as a result of the RENTER’s engagement and usage of the Banquet Hall. The RENTER also agrees that Kama‘aina Kids may assess charges to the RENTER for any damage, destruction or loss to the Banquet Hall property as a result of RENTER’s usage of the Banquet Hall.

Basic Cleaning Includes:

  • Cleaning of floors (sweep and mop) in banquet hall, kitchen and bathrooms.
  • Cleaning of bathrooms (counter, sinks, toilets and urinals).
  • Cleaning of kitchen (counter, sinks and refrigerators).
  • Breakdown and removal of tables and chairs.

Extensive Cleaning Includes:

  • Use of Dumpsters
  • Removal of decorations and rubbish (does not include cleaning of park grounds).
  • Cleaning of floors (sweep and mop) in banquet hall, kitchen and bathrooms.

Cleaning Guidelines

DEPOSIT DEDUCTIONS

Banquet Hall @ He‘eia State Park

Purpose of this sheet is to provide contractual itemizations for potential deductions made to SECURITY DEPOSIT for Kama‘aina Kids He’eia State Park Banquet Hall.

  • Use of staples, nails and tacks...... $5/per
  • Failure to clean kitchen sink and counters...... $10

  • Failure to sweep and mop the kitchen and main hall...... $100
  • Failure to re-stack all tables and chairs neatly...... $100

  • Closing time will be clocked when the Park Manager or designated representative closes the park gate after the last person leaves the parking lot. The RENTER will be charged $25 per 15 minute increments after the stated rental period

CLEANING GUIDELINES

Banquet Hall @ He‘eia State Park

Purpose of this sheet is to provide contractual guidelines for clean-up of Kama‘aina Kids He’eia State Park Banquet Hall.

The Park Manager or designated representative will provide an orientation of the facilities and discuss the checklist with the RENTER or designated representative(s). The Park Manager or designated representative will check with the RENTER or the designated representative(s) as to the closing time; making sure the RENTER or the designated representative(s) knows where the cleaning supplies are, location of light/fan switches and that the RENTER or the designated representative(s) know that it will take at least one and one half hours (1.5) to accomplish all the cleaning prior to scheduled closing time. Security will be responsible to make sure RENTER follows cleaning guidelines. The final check out will be given the following morning with the Park Manager or designated representative.
