Subject: Regarding grant hearing to Pb.Govt. College Teachers’ Association (Pb.GCTA)
Respected Madam,
It is respectfully submitted that we need an urgent meeting with your good self on the following issues:-
- That , we had discussed many issues in detail in our meeting on 06-12-2007, presided by the Hon’ble Minister of Higher Education. In spite of clear decisions on many issues nothing concrete has emerged so for on many of such issues, so we demand that a review/follow-up meting be held on those issues.
- That the Hon’ble Punjab and Haryana High Court had ordered on 05-08-2008 to give the benefit of ad-hoc service 11 lectures of G.C.W. Ludhiana, for placement in senior scale/selection grade as was given to Mrs.Indu Bala Singh and to pay them arrears within one week. Whereas they have got some arrears ( not based on actual calculation) but they are stll to get their pay fixed in senior scale/selection grade. On the basis of writ petition in Jaspal Rai and others v/s State of Punjab & others 14 lecturers have also got a similar order, by the Hon’ble Court to pay them arrears within one week as per order given in CWP No’s 15413 and 15272 of 2007. 104 lecturers in CWP No’s 16579, 14891, 14877, 15097, 15140, 15281, 15298, and16298 of 2008 have also got a similar order by the Hon’ble court.
- However even one month of these orders, there seems to be solution to their problem. So much so, the 11 lecturers of GCW No’s 15413 and 15272 of 2007 are still awaiting to get their pay fixed in senior scale/ selection grade after counting their part ad-hoc service as has been done in case of Mrs. Indu Bala Singh.
- That the letter adopted by the Govt. to count the past ad-hoc service of Mrs. Indu Bala Singh is UGC letter dated 25-12-1998 and this letter is a clarification of clause 1(e) of UGC letter dated 27-11-1990, which is a case of clear-cut discrimination against those letterers who have rendered service in lecturers scale whether in private colleges, universities or in those private colleges which were later on taken over by the Govt.
So, we earnestly request yourgood self to implement the spirit of orders passed by the Hon’ble Punjab and Haryana High Court and extend this benefit to all others who have renderd adhoc service and have not yet filed any CPW or who have served elsewhere and satisfy the conditions stipulated in UGC letter dated 27-11-1990.
- That the Hon’ble Punjab and Haryana High Court has given its judgment in CWP No. 12113/2008 namely Pawan Kumar Bansal v/s State of Punjab & others. Thejudgment clearly establishes the preferential right of regularly selected lecturers to retain posts after restructuring and to shift part-time lecturers if there is no vacancy after adjusting the regularly selected lectures. Though the Hon’ble Court has given 6 weeks from 30-06-2008. (the date of judgment) to do the needful, even then we feel if the same is done earlier, it will be beneficial to the all-over academic atmosphere in the colleges.
So ,we request your good self to grant an early hearing to our organization and sort out the above mentioned issues as early as possible.
