Explanation: This Resolution authorizes the transfer of 14,350 gpd (gallons per day) sewer capacity from the Township of Raritan to Flemington Junction, LLC.

RESOLUTION #14-188
WHEREAS, Flemington Junction, LLC, is the equitable owner of that property identified as Lots 37.01 and 54 in Block 16.01 as shown on the Official Tax Map of the Township of Raritan, consisting of approximately 11.59 acres; and
WHEREAS,Flemington Junctionintends to construct eighty-four (84) affordable housing units consisting of fifteen (15) one-bedroom units, forty-eight (48) two-bedroom units, and twenty-one (21) three-bedroom units on the property and for which Flemington Junction received Preliminary Site Plan approval from the Township Planning Board in 2008; and
WHEREAS,Flemington Junction requires 19,350 gpd (gallons per day) sewerage capacity to service the development; and
WHEREAS, the Raritan Township Municipal Utilities Authority allocated to Flemington Junction 5,000 gpd for the development, leaving a balance that Flemington Junction requires of 14,350 gpd for the development; and
WHEREAS,the RTMUA’s current reservation for the Township is 15,060 gpd; and
WHEREAS, the Township desires to promote affordable housing within the Township and desires to transfer to Flemington Junction 14,350 gpd to provide Flemington Junction with the full sewer capacity Flemington Junction requires to construct this development, while leaving the Township with 710 gpd of sewer capacity for other affordable housing developments.

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Raritan, in the County of Hunterdon, and State of New Jersey, as follows:
- That the Township of Raritan hereby transfers 14,350 gpd of the Township’s sewer capacity to Flemington Junction, LLC.
- That the Township continues to reserve 710 gpd of sewer capacity.
- That in the event Flemington Junction, LLC, does not begin construction prior to December 31, 2016 or obtains a Certificate of Occupancy prior to December 31, 2018 for the development, the Township’s transfer of the 14,350 gpd of sewer capacity lapses and reverts back to the Township unless these dates are extended by the Township Committee.
- That the Mayor and Clerk are hereby authorized to execute those documents necessary to effectuate the transfer.
- That a certified copy of this Resolution be transmitted by the Township Clerk to the RTMA and Flemington Junction, LLC, within seven (7) business days of the adoption of this Resolution.
- This Resolution shall take effect immediately.
